At approximately 2:18, LPA Clayton arrived at the above mentioned facility. Upon arrival LPA Clayton was greeted by teacher Esma Itzate. LPA Clayton entered the school and observed 15 napping pre-school children in the first room. LPA Clayton asked was the Director available, and was advised by teacher Esma that the Director had left the facility to go to lunch, but that they had texted her to let her know that I was at the facility.

LPA Clayton walked further into the school and was met by teacher Jessica Handa, who was holding a 7 month old infant girl. LPA Clayton noticed a "sit me up" baby seat in the hallway, on the floor. LPA Clayton asked the teacher was she using the seat and she replied that she had just taken the child in her arms out of the seat.

LPA Clayton walked further into the center and observed a 1 month old infant crying in a MamaRoo infant swing, unattended, and not strapped in. LPA Clayton asked the teacher to remove the child from the swing.

LPA Clayton then asked teacher Jessica where do the infants sleep and she stated in their cribs, in the infant room. Teacher Jessica walked LPA Clayton to the infant room, and opened a fully closed door, where 5 children ages 16 months - 23 months were sleeping on cots and in cribs, with no visible supervision.

Based on LPA Clayton observation of the children sleeping in a room, behind closed doors, with no supervision, and the child in the infant swing, unsupervised, the Title 22 Regulations were cited and Civil Penalties assessed (see LIC 809D).

101429 Responsibility for Providing Care and Supervision for Infants(a) In addition to Section 101229, the following shall apply: (1) Each infant shall be constantly supervised and under direct visual observation and supervision by a staff person at all times. 2) Sleeping infant(s) shall be directly observed by sight and sound at all times. (A) This shall include when the infants are going to sleep, are sleeping, or are in the process of waking up. (B) Staff shall physically check on sleeping infant(s) every 15 minutes and document the following:1. Labored breathing.2. Signs of distress, which includes but is not limited to flushed skin color, increase in body temperature and restlessness.

Director is to have staff watch videos of Supervising Children in Child Care Centers at www.ccld.gov, and provide LPA Clayton with a signed declaration of the understanding of Supervision and the protocols that have been emplemented by the facility to maintain complaince no later than 02/24/2023
