32 | This is an amendment of the original report created on 11/20/24. This is to amend the qualifying pronouns. The RP raised concerns about the risks of leaving the unattended, like the potential dangers of kidnapping, traffic accidents, or other harm. The Licensee justified leaving a child in the car by saying they were having a rough day and had fallen asleep during a ride.
Per Title 22 Regulations 102417(k)(1) Operation of a Family Child Care Home (k)(1) Children shall not be left in parked vehicles.
Per Licensee, the RP did not say anything that day or on another occasion regarding the child being left in the car alone. The licensee explained to the RP why the child was in the car alone and thought everything was ok. Per licensee, they had picked up another 7-year-old child from school and parked the car on the sidewalk and ran in the house and sat the 7-year-old down at the table. Licensee states they only left the child in the car for a few minutes because the was asleep and knew the parent was on the way to pick the child up. Licensee stated they were not sure why they did not bring both children in at the same time even though the child could walk on their own. Licensee disclosed the child was left in the car alone and understands they must always supervise children.
Based upon observations and evidence obtained during this investigation, the allegation of “Licensee left day care child unattended in a vehicle” have been determined to be Substantiated. A finding that the complaint is substantiated means that the allegation is valid because the preponderance of the evidence standards has been met. A Type "A" is being issued. See LIC9099-D for deficiency cited.
LPA Jeanine Lipsey informed Licensee Laura Villagrana that this report dated 11/20/2024 documents,
1 Type A citation which shall be posted for 30 consecutive days as there is immediate risk to the health, Safety, or personal rights of children in care.
Also, LPA Jeanine Lipsey informed the licensee to provide a copy of this licensing report dated 11/20/24 that documents any Type A citation to parents/guardian of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC9924), or written statement, must be placed in the child's file for verification.
Notice of site visit was given and must remain posted for 30 days. Exit interview conducted and report was reviewed with Licensee Laura Villagrana. |
