25 | On 08/14/24 at 10:04AM Licensing Program Manager (LPM)Rita Ramos, Licensing Program Analysts (LPAs) Lilia Hernandez and Roberto Luque-Avila, met with Sheryl Matheu, Licensee for an informal meeting.
The purpose of the informal meeting was to discuss a recent annual inspection conducted on 07/15/2024 by LPA Katrina Chicote in which Licensee had 24 children in care. Licensee Sheryl Matheu is licensed for a capacity of 14 children, therefore, during the annual inspection conducted on 07/15/2024, Licensee exceeded their capacity by 10. Licensee was cited a Type A deficiency. Licensee was also cited for 10 Type B citations which included non-compliance in Infant Safe Sleep.
Per Licensee, they have disenrolled 10 children from their facility and will ensure that they do not go over capacity again.
LPM reminded Licensee that previous annual inspections have been conducted by the Department and Licensee was found to be over capacity on 04/21/2016, 4/22/2016, and 09/17/2018 (copies of the reports were provided to Licensee). Licensee had previously made similar statements in the past when found to be over capacity but has continued to be non-compliant by exceeding their capacity. LPM went over capacity limitations with Licensee and discussed that although they have a license for a large capacity of 14 the limitations are that at least one child has to be enrolled in and attending kindergarten or elementary school and a second child is at least six years of age. In addition, no more than three infants are cared for during any time when more than 12 children are being cared for. LPM provided Licensee with a copy of a capacity worksheet. LPM also discussed the Department’s Technical Support Program (TSP) and advised Licensee that they would benefit if referred to receive assistance, support, and resources by TSP. Licensee declined referral and assistance. LPM also advised Licensee that they watch the Race-to-the Top video on How Many Children can Attend a Family Child Care Home that can be found via the Department’s website. LPAs provided Licensee with guidance and link on how to access the video and website.
