Licensing Program Analyst (LPA) Lilia Hernandez conducted an unannounced inspection on 08/26/2024. The purpose of the visit was to ensure that the health, safety, personal rights, licensing conditions and limitations are as required by Title 22 Regulations. LPA arrived at the facility at 1:00 PM and met with Sheryl Matheu, Licensee, who guided LPA on a tour of the facility. Also present was Assistant #1 and Assistant #2.

Sheryl Matheu, Licensee, is licensed for a capacity of 14 children.

At 1:05PM, LPA observed 19 children in care. Licensee had in her care 4 infants, 13 preschool age children, and 2 school age children in care upon arrival. Licensee exceeded their total capacity by 5 children.

Licensee has been found operating over capacity 5 times including this inspection.

On 4/21/2016, during an inspection for change of location, Licensee was observed providing care to 12 children, 5 of which were infants. Licensee exceeded the total number of infants a Family Child Care Home can have in care.

On 04/22/2016, during an case management, plan of correction visit, Licensee was observed providing care to 11 children, 5 of which were infants. Licensee exceeded the total number of infants a Family Child Care Home can have in care.

On 09/17/2018, during an annual random inspection, Licensee was observed providing care to 15 children, 8 of which were infants. Licensee exceeded their total capacity by 1 and exceeded total number of infants a Family Child Care Home can have in care.

On 07/15/2024, during a Required – 3 Year annual inspection, Licensee was observed providing care to 24 children, 5 of which were infants. Licensee exceeded their total capacity by 10 children, and total number of infants a Family Child Care Home can have in care.

On 08/14/2024, the Department conducted an informal meeting with Licensee to address operating over capacity. During the informal meeting, Licensee was reminded that previous inspections have been conducted by the Department and Licensee was found to be over capacity. The Department also discussed capacity limitations with Licensee and discussed that although they have a license for a large capacity of 14 the limitations are that at least one child has to be enrolled in and attending kindergarten or elementary school and a second child is at least six years of age. In addition, no more than three infants are cared for during any time when more than 12 children are being cared for. Licensee agreed to stay in compliance by ensuring that they will not exceed their license capacity of 14.

The following deficiencies listed on the attached LIC 809D are being cited in accordance with California Code of Regulations Title 22. Deficiencies that are being cited need to be cleared to protect the children’s health & safety.

A copy of this report shall be provided to the parent/guardian of children currently enrolled by the next business day or immediately upon return. A copy of this report shall also be provided to the parent/guardian of any newly enrolled children for the next 12 months (1 year). The Acknowledgement form must be maintained in each child’s file immediately upon receipt from parent.

A copy of the LIC 9224 - Acknowledgement of Receipt of Licensing Reports was provided during this visit.

The Notice of Site Visit must remain posted for 30 days during the hours of operation after each site visit by a licensing representative. Failure to maintain posting as required will result in a civil penalty of $100.00.
