On November 24, 2021 at 9:28AM, Licensing Program Analyst (LPA) Brigitte Tsutaoka conducted an unannounced complaint inspection to deliver findings on the above allegations. LPA disclosed the purpose of inspection and was granted entry by Assistant Director, who guided LPA on a tour of the facility. LPA observed 11 children in care with 1 staff.
During the course of the investigation, LPA conducted staff interviews and obtained facility records. Interviews and incident report obtained disclosed Child 1 was upset upon arrival to the faciltiy at approximately 12:45PM on 9/21/2021 due to an altercation at his elementary school. Child 1 hit himself and call himself "stupid" during pick up from school.
At approximately 5:30PM, children came inside the facility after outdoor play and were instructed to do a worksheet, which Child 1 refused to complete and became upset.
At approximately 5:40PM, Child 1 banged on a desk in the school aged room for approximately ten (10) straight minutes. Staff 4 eventually was able to calm Child 1.

Child 1 then proceeded to drag a chair across the room stating his parents had arrived at the facility, which they had not done so. Staff calmed Child 1 again and he was with the other children.

At approximately 6:00PM, Child 1 got up from his seat and began to hit Child 2 which caused Child 2 to become upset and ask facility staff to have Child 1 to leave him alone. Child 1 then obtained "counting bears" and began to throw them at Child 3, who was already upset from Child 1 coloring on her worksheet. Child 3 told Child 1 to stop and the two children got up as if they were going to get into a physical altercation, which caused Staff 1 to get between them to stop the altercation from escalating. Child 1 then began to chase and hit the other children in the room.

Staff 1 took the children into the preschool room to separate them from Child 1 and enable Staff 2 to speak with Child 1 to calm him down. Child 1 ran way from Staff 2 and proceeded to hop the white gates that separated the school aged classroom from the preschool classroom. Staff 2 attempted to put herself between Child 1 and the rest of the children as Child 1 was pushing and taunting them. Child 1 was also pushing staff. A bleach solution was left on the counter in the preschool room which was closed at the time. Child 1 grabbed the bleach solution and sprayed Staff 1, Staff 2, and the children. Child 4 was sprayed in the face by the solution. Child 1 proceeded to grab toys and throw them at the children separated in the preschool room.

At approximately 6:10PM, Staff 2 contacted Director who instructed Staff 2 to contact the sheriff's department. Director contacted Child 1's authorized representative (AR) to come to the facility. Child 1 proceeded to grab a cup and fill it with toilet water in an attempt to poor it on the children and staff. Child 5, Child 6, and Child 7 were frightened and began to cry. Child 1 and Child 3 got into a physical altercation because Child 1 began to throw toys at and threaten Child 8. Staff 1 stood between them and was hit by both children in the process.
Staff 5 took the children into the supply closet which has a lock and to separate them from Child 1. Staff 1 blocked Child 1 from entering the supply room and released him once the children were secure in the supply closet. Child 1 obtained scissors to try to pick the lock, then proceeded to kick and throw items at the supply closet door.

At approximately 6:30PM, AR arrived at the facility and was let in through the back door to maintain all doors locked at the front of the facility. Child 1 was observably upset and fought AR, who was trying to get Child 1 to come outside. Approximately 5 minutes later at 6:35PM, the Sheriff Department arrived and escorted Child 1 out of the facility in handcuffs with AR.

Based on evidence obtained and interviews conducted, the preponderance of evidence standard has been met, therefore the above allegations are found Substantiated. California Code of Regulations, Title 22, Division 12 Chapter 1 101223 Personal Rights Type A violation is being cited during this inspection. See LIC9099D for deficiency details.

Director was advised that the Notice of Site Visit must be posted at the entrance of the facility for a period of 30 days. A copy of this licensing report (LIC9099) must also be posted for 30 days. If these requirements are not met, civil penalties in the amount of $100 per violation will be assessed. Copies of the reports must also be provided to each parent. A copy of the Acknowledgment of receipt of licensing report (LIC9224) was
provided and must be kept in each child's file. In addition, any child enrolled within the following 12 months must also receive a copy of the Type A Citation.

An exit interview was conducted, a copy of this Report, Appeal Rights, and Notice of Site Visit were provided to Director.
