On November 24, 2021 at 9:28AM, Licensing Program Analyst (LPA) Brigitte Tsutaoka conducted an unannounced complaint inspection on the above allegation. LPA disclosed the purpose of inspection and was granted entry by Assistant Director Jessica Donis. Upon entry, LPA counted 11 child in care with 1 staff on association list.
During investigation, LPA interviewed staff and children. Children disclosed they wear masks at all times while at the facility, but are not required to wear the masks at home or outside. Staff stated children are required to wear masks at all times except during meal times. LPA observed children wearing masks during this inspection and throughout the course of the investigation.
Based on evidence obtained and interviews conducted, the above allegation is deemed Unsubstantiated. A finding that the complaint is unsubstantiated means that although the allegation may have happened or is valid, there is not a preponderance of the evidence to prove that the alleged violation did or did not occur. An exit interview was conducted, this Report, Appeal Rights, and Notice of Site Visit were provided to Assistant Director.

On November 24, 2021 at 9:28AM, Licensing Program Analyst (LPA) Brigitte Tsutaoka conducted an unannounced complaint inspection on the above allegations. LPA disclosed the purpose of inspection and was granted entry by Assistant Director Jessica Donis, who guided LPA on a tour of the facility. Upon entry, LPA counted 11 children with 1 staff on association list.
During initial inspection, LPA observed gum stuck to the bottom of tables in the school age room. Director required staff to clean gum from beneath tables. During inspection at 10:55AM, LPA observed gum removed from under the tables during initial inspection, but gum still under table in the middle of the school age room.
During investigation, LPA conducted interviews with staff, children, and obtained/reviewed facility records. Based on evidence obtained, the Admission Agreement stipulates famlies are provided a two week notice prior to termination from the program.

LPA reviewed 2 (two) separate termination letters from families which provide less than the 2 week's notice as agreed upon with the facility. One letter was provided the day after termination of care, and the other letter provides only 4 days notice. LPA additionally reviewed facility files of children who were terminated from care and did not observe a termination letter in the files.

During child interviews, it was disclosed Director intimidates children by yelling in close proximity to their face during discipline.

Based on evidence obtained and interviews conducted, the preponderance of evidence standard has been met, therefore the above allegations are substantiated. California Code of Regulations, Title 22, Division 12 Chapter 1 101238 Buildings and Grounds and 101219 Admission Agreement Type B violations are being cited during this inspection. California Code of Regulations, Title 22, Division 12 Chapter 1 101223 Personal Rights Type A violations is being cited during this inspection. See LIC9099D for deficiency details

Director was advised that the Notice of Site Visit must be posted at the entrance of the facility for a period of 30 days. A copy of this licensing report (LIC9099) must also be posted for 30 days. If these requirements are not met, civil penalties in the amount of $100 per violation will be assessed. Copies of the reports must also be provided to each parent. A copy of the Acknowledgment of receipt of licensing report (LIC9224) was
provided and must be kept in each child's file. In addition, any child enrolled within the following 12 months must also receive a copy of the Type A Citation.

An exit interview was conducted, a copy of this Report, Appeal Rights, and Notice of Site Visit was provided to Assistant Director.
