On January 13, 2022 at 8:20AM, Licensing Program Analyst (LPA) Brigitte Tsutaoka conducted an unannounced complaint inspection on the above allegations. LPA disclosed purpose of inspection and was granted entry by Director, Ana Garcia who guided LPA on a tour of the facility. Upon entry LPA observed 0 school age children present and 0 school age teachers present. During inspection, school is in session so no children are present. At 8:53Am, 1 staff and 1 child arrived at the facility.

During investigation, LPA interviewed staff, children, and obtained facility records. Based on staff interviews it was disclosed an additional 2 wandering away incidents occurred with Child 1 from the facility where law enforcement was contacted. Facility self-reported the third wandering away incident that occurred on 12/29/2021. LPA conducted a Case Management inspection on the self-reported incident, a Type A violation and civil penalties were assessed. The first incident occurred approximately beginning of November, staff were unable to provide exact date.

Director agreed to create a plan to prevent children from eloping from the facility and submit to the Department no later than 01/14/22. Director also is working with fire marshal to replace white gates with doors. Director also agreed to participate in NCC.

Based on interview and observation, facility staff failed to prevent Child 1 from exiting the facility and running away, requiring the Sherrif's Department to intervene and return the child to the facility, which causes an immediate Health and Safety Risk to children in care.

Though Child 1 was able to wander away from facility, the doors are in no observable disrepair and the doors themselves are not mechanically unsafe. Additional supervision is required to prevent children from wandering away from facility. The facility is also working with the fire marshal to replace white gates in day care rooms with solid doors.

Based on evidence obtained and observations conducted, the above allegation is deemed Unsubstantiated. A finding that the complaint is unsubstantiated means that although the allegation may have happened or is valid, there is not a preponderance of the evidence to prove that the alleged violation did or did not occur. An exit interview was conducted, this Report, Appeal Rights, and Notice of Site Visit were provided to Director.

Child 1 was having a bad, which led him to curse at staff and become upset. Child 1 ran out the facility and Director chased after him. Director contacted the Sheriff's Department and Child 1 was returned to the facility approximately 20 to 30 minutes later.
On 12/21/2021, Child 1 was climbing on the arcade in the school age room, and staff requested he come down and sent him to the office with Staff 6, who was normally able to calm him down. Child 1 ran outside the the front door and ran in front of a vehicle. Staff 6 was able to get between the vehicle and Child 1 and was required to restrain him to return him to the facility. A parent came inside and informed facility Staff 6 required assistance to bring in Child 1 from outside. Staff contacted Assistant Director, who is also Child 1's foster parent, to inform her of incident. Facility staff also contacted the sheriff department. Staff 2 came outside to assist Staff 6 with Child 1, who was kicking, biting, and hitting, expressing statements indicative of suicidal ideation. The two staff had to restrain Child 1 for approximately 30 minutes, then pick him up and carry him inside to the facility where they took him to the front office.
Additionally, it was disclosed staff that are not fully-qualified teachers provide supervision to children. Staff disclosed Staff 1, Staff 4, and Staff 5, who do not have the required units to be a fully-qualified teacher, are alone providing supervision to children either when they are short-staffed or to cover breaks. During inspection, LPA observed Staff 1 provide supervision to the school-age room without a fully qualified teacher present.

Based on evidence obtained and interviews conducted, the preponderance of evidence standard has been met, therefore the above allegations are found Substantiated. California Code of Regulations, Title 22, Division 12 Chapter 1 101229 Responsibility to Provide Care and Supervision Type A violation and 101216.1
Teacher Qualifications and Duties Type B violations are being cited during this inspection. See LIC9099D for deficiency details.

Director was advised that the Notice of Site Visit must be posted at the entrance of the facility for a period of 30 days. A copy of this licensing report (LIC9099) must also be posted for 30 days. If these requirements are not met, civil penalties in the amount of $100 per violation will be assessed. Copies of the reports must also be provided to each parent. A copy of the Acknowledgment of receipt of licensing report (LIC9224) was
provided and must be kept in each child's file. In addition, any child enrolled within the following 12 months must also receive a copy of the Type A Citation.
An exit interview was conducted, a copy of this Report, Appeal Rights, and Notice of Site Visit were provided to Director.
