Assistant dropped child off at wrong school resulting in child being unsupervised for an extended period of time

On 8/30/23 at 2PM, Licensing Program Analyst (LPA) V. Wheatley conducted an inspection regarding the above allegation. LPA met with Licensee Gayane Vorobyeva today and observed 11 children and one assistant Staff #1. The children were playing and observed eating snack.

On 6/15/23, LPA conducted an investigation and met wit the licensee who stated that she was unavailable she asked her assistant, Staff #1 to take the child to the elementary school on Plummer. Licensee states that adult stated she dropped the child off at the office and asked if the child was at the right schoo when she dropped the child off.

LPA Wheatley contacted the Carlos Santana School and spoke to Adult #1 who states that the child was dropped off at the wrong school. Adult #1 also stated that the camera shows the child wandered unto the yard and was unsupervised. The office staff searched to find the child's correct school which is Plummer. The staff also searched and contacted the child's mother. The mother came to pick up the child. See Page 2

102417(a) -Operation of Family Child Care Home.The licensee shall be present in the home and shall ensure that children in care are supervised at all times. When circumstances require the licensee to be temporarily absent from the home, the licensee shall arrange for a substitute adult to care for and supervise the children during his/her absence. Temporary absences shall not exceed 20 percent of the hours that the facility is providing care per day.

Licensee will ensure that children are supervised at all times regardless to if they are on the premises or during transportation. The licensee will ensure staff / assistants are properly trained on supervision. If children are transported a permission slip will be completed by the parents.

This is evidenced by: The licensee's assistant took Child #1 to the wrong elementary school. The child ended up on the playground and unsupervised. This is a Type A violation which is an immediate health and safety risk to children in care.

Today, LPA interviewed Staff #1 who states she did drop the child off inside of the office and that she thought the child was dropped off at the right school.

Based on the LPA’s observations and interviews which were conducted the allegation is Substantiated. A substantiated finding means the allegation is valid because the preponderance of the evidence standard has been met.

While the licensee arranged for a substitute adult to transport an enrolled day care child (Child #1) to a local school, the assistant did not ensure that the child was assigned to the correct school. After drop off the child wandered to the play ground and was left unsupervised. This is a Type A violation of Care & Supervision.
