On 06/13/2024 at 9:30 AM, Licensing Program Analyst (LPA) Andrew Alemoh met with Director Wendy Ruiz for the purpose to deliver the finding of the above allegation. Upon arrival, LPA observed 13 children with 2 teachers and the Director at the time of this visit.

The investigation consisted of interviews with Director, staff, parents, and other complaint relevant parties. The investigation revealed the following: children are provided with the proper safety, care, and supervision. A cellphone policy is in place in that staff/teachers are allowed to use cell phones and or iPads for the Brightwheel application, along with providing pictures and communication for the day care children parents. Directors, staff, and parent’s statements corroborated in that cell phones/iPads are not being utilized for personal use, but for the use of the Brightwheel application for communication amongst teachers, parents, and other relevant parties.

Children statements stated that the teachers are providing safety and supervision at all times along with the 2-3 teachers present in the classroom and the outside play yard area. No children have sustained any injuries in the classroom or outside play yard area.

Based on the evidence obtained, the allegation of staff does not provide adequate supervision for the children in care is unsubstantiated. A finding that the complaint is unsubstantiated means that although the allegations may have happened or is valid, there is not preponderance of the evidence to prove that the alleged violations did or did not occur.

An exit interview was conducted, a copy of this report was provided along with the appeal rights.
