Allegation 1 - Staff commingles preschool children with infants in care

On 4/1/2025, Licensing Program Analyst (LPA) Suzette Ornelas conducted an unannounced follow up complaint inspection for the purpose of delivering the findings for the above-mentioned allegation. Upon arrival, LPA was greeted and let into the facility by Director, Karen Beninati to whom the reason for the inspection was announced. LPA toured the facility and observed 14 daycare children and 4 staff.

During the course of the investigation, LPA Ornelas made observations, obtained documentation in the form of pictures, children’s roster and conducted interviews with the Reporting Party (RP), staff and parents in regard to the above allegations.

-Pertaining to the allegation that - Staff commingles preschool children with infants in care.
According to the Reporting Party (RP), several times at pick up, there are infants mixed in with their toddler and preschool kids.

According to Staff interviewed during the course of the investigation, staff stated that they do not commingle preschool children with infants in care. Staff stated that when infants are dropped off or picked up they go through the younger preschool classroom to get to the infant classroom. Staff further stated that as of recently they added a baby gate where there was once a closed/covered door so that parents can drop their infants off directly on the infant side of the facility and avoid any confusion.

According to Parents interviewed during the course of the investigation, parents stated that they have not observed infants commingled with preschool children. Parents further stated that they have directly dropping off/picking up infants on the infant side through the newly accessible baby gate.

Based on the evidence as documented above, the allegations have been determined to be Unsubstantiated. A finding that the complaint is unsubstantiated means that although the allegation may have happened or is valid, there is not a preponderance of the evidence to prove that the allegation occurred.

A notice of site visit was given and must remain posted for 30 days.

According to Staff interviewed during the course of the investigation, there was a substitute teacher assisting one day. Per staff, the substitute teacher closed the nap room doors leaving napping infants unattended. Staff further stated that there is a poster placed on both sides of the double doors that reads, " STOP! Before closing the door please make sure there is enough number of friends to teachers".

According to parents interviewed during the course of the investigation, they have no concerns regarding supervision. Parents stated that their children have not sustained any serious injuries or injuries that are out of the norm. for their infant children. Parents further stated that they have not observed sleeping infants left alone without adult supervision.

Based on the information obtained through observations and interviews, the allegation is substantiated. A substantiated finding means that the complaint is substantiated and the allegation is valid because the preponderance of the evidence standard has been met.

1 Type A deficiency is being cited on the attached LIC9099-D.

Upon receipt, the Licensee shall post the Notice of Site Visit and the Licensing report. This report and the Notice of Site Visit shall be posted for thirty (30) consecutive days. Failure to maintain posting as required will result in a $100 civil penalty. A copy of this report shall be provided to the parents/guardians of the children currently enrolled by the next business day or immediately upon return. A copy of this report shall also be provided to the parents/guardians of any children newly enrolled at the facility for the next twelve (12) months. The LIC 9224 Acknowledgement of Receipt of Licensing Reports must be maintained in each child's file immediately upon receipt from the parent.


A copy of this report, notice of site visit, and appeal rights were provided. The Notice of Site Visit (LIC 9213) – must remain posted for 30 days during the hours of operation after each site visit by a licensing representative. Failure to maintain posting as required will result in a civil penalty of $100.00.
