25 | Licensing Program Analyst (LPA) Austin Estrada conducted an unannounced case management inspection. This inspection is to deliver the findings on an Unusual Incident Report (UIR) that was received by Monterey Park South West Child Care Regional Office on 2/28/23. LPA previously conducted a case management inspection regarding the same UIR on 3/28/23.
Upon arrival, LPA met with Director, Yolanda Lopez, and informed her of the purpose for the visit. Director provided LPA a tour of the facility. LPA observed 12 children and one teacher in room 1A, 11 children and two teachers in room 2A, 10 children and one teacher in room 3A, and eight children and one teacher in room 4B.
During the investigation, LPA confirmed Child 1 (C1) was in attendance at the time of the incident that was reported to the department. LPA conducted interviews with three children, four parents of children currently attending facility, two teachers currently working at facility, and the Director. All interviews conducted with staff, parents and children did not support the allegation. LPA was unable to interview C1. LPA also reviewed video surveillance of the day of the incident, which did not provide any evidence to support the allegation. LPA’s review of incident reports also did not support the allegation. On 3/28/23 and again on today’s date, LPA observed teacher/child ratios to be within regulatory requirements.
Although the allegation may have happened or is valid, there is not a preponderance of evidence to prove the alleged violation did or did not occur, therefore the allegation is unsubstantiated.
LPA provided a copy of LIC 811 (Confidential Names) to the Director. Exit interview conducted with Director Yolanda Lopez. A copy of the appeal rights were provided and explained. The Notice of Site Visit shall be posted for thirty (30) consecutive days. Failure to maintain posting as required will result in a $100.00 civil penalty. |
