On December 1, 2023, at 10:30 AM, Licensing Program Analysts (LPAs) Angelica Wallin and Jeanette Estrada, conducted an unannounced Annual Required Inspection for the infant center license. During today’s inspection, LPA met with program director Angela Washington, and toured the facility indoors and outdoors. Days and hours of operation are Monday through Friday from 6:00 AM – 6:00 PM. This facility consists of 3 classrooms and outdoor play area.

All areas identified on the Facility Sketch were inspected. Upon arrival, licensee informed LPAs that facility had 9 children and three staff present at time of inspection. Per director, nine infants enrolled at this time. LPAs observed three classrooms. LPAs observed two teacher staff present in preschool room during time of inspection.

The following was observed during the tour of the facility: furniture and equipment were inspected for age appropriateness and good repair. Telephone service, heating, lighting, and ventilation were evaluated. Carbon monoxide detectors were observed and are operable. Children have their own cubby to store their belongings. Linens are washed by the facility weekly. The facility has sufficient age appropriate furniture, and equipment including cribs, cots or mats, changing tables and feeding tables. General sanitation was observed. During inspection, LPAs observed staff’s belongings placed inside unused crib. LPAs informed staff regarding purpose of infant cribs. Staff immediately removed belongings from cribs. A technical violation citation issued.

Drinking water via water dispenser was observed in classrooms. Per PIN 21-21-CCP lead testing to be conducted for all equipment used for drinking consumption. Per staff water tested is used for drinking and food preparation. LPA observed negative lead testing results conducted 1/24/23. Disinfectants, cleaning solutions, medication and other items that are dangerous to children, were inaccessible to children. Menus are posted outside each classroom one week in advance.

All kitchen, food preparation, and storage areas are clean, free of litter, rubbish, and rodents/vermin. All food is protected from contamination. All storage containers for solid waste, including moveable bins, have tight fitting covers on and are in good repair.

Outdoor playground equipment is in a safe condition, free of sharp, loose or pointed parts. The surface of the outdoor activity space is maintained in a safe condition and is free of hazards. There is adequate shade in the play yard. LPAs advised that no children shall be left without the supervision of a teacher at any time. During inspection, LPAS observed no outside drinking water provided. Staff stated that drinking water is provided in water dispenser and is usually brought by kitchen staff. Staff stated kitchen staff forgot to bring out dispenser. A technical violation citation issued. All floors were observed to be clean and safe. All materials accessible to children were observed to be toxic free. There are no firearms stored on the premises. There are no pools or bodies of water at the facility.

During inspection of outdoor play area, LPAs observed two staff present with 7 infants. During record review, LPAs observed that one staff is qualified teacher, while second staff had missing 6 units of teacher’s aide education qualifications. Over course of inspection, LPAs observed additional qualified teacher arrived 15 minutes after staff and infants transitioned from outside to inside time. Staff-infant ratio out of compliance during outdoor play. Type B citation issued.

LPAs reviewed 5 children’s file and observed that one out of five children’s file is missing updated immunizations. A technical assistance violation citation issued. Per staff record review, LPAs observed that director’s file is maintained and updated: Education, LIC-501: Personnel Record, LIC 508- Criminal Record Statement, LIC 9052- Employee Rights, LIC 503- Health Screening, Proof of immunization against measles, pertussis and influenza or influenza declination, TB clearance or risk assessment, LIC 9108- Statement Acknowledging Requirement to Report Child Abuse. At least one person trained in CPR and Pediatric First Aid is present when children are at the facility or at offsite activities. LPAs observed one staff with CPR and Pediatric First Aid with EMSA approved sticker.

During staff record review, LPAs observed teacher’s aide file missing the following: updated mandated reporter certificate and education qualifications. LPAs also observed the teacher’s aide did not have six units of college classes in file. Per director, teacher’s aide to be enrolled in classes and is part of an education plan pending her employment. A Type B citation issued.

The name of the child care center director or fully-qualified teacher(s) designated to act in the director’s absence has been reported to the Department. The person who signs the child in/out of the facility shall use their full legal signature and record the time of day. LPAs reviewed the following documentation to be kept in facility: facility license, LIC610, PUB 393, daily schedule, PUB 269, fire drills and monthly menus. During inspection, LPAs observed staff completing infant 15-minute check log only for 2 infants sleeping in cribs. LPAs informed staff that 15-minute check logs need to be conducted for all infants between ages of 0-2. A technical violation citation issued.

Director was reminded that all adults 18 and over, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a Child Care Center. A civil penalty of $100.00 minimum/day for a maximum of 5 days or, if the penalty is for a repeat violation, for a maximum of 30 days per person will be assessed if this regulation is violated.



Assembly Bill (AB) 2370, Chapter 676, Statutes of 2018, requires all licensed Child Care Centers (CCCs) constructed before January 1, 2010, to test their water (used for drinking and food preparation) for lead contamination before January 1, 2023, and then every 5-years after the date of the first test. For child care center licenses issued after July 1, 2022, the licensee shall test their water for lead within 180 days of licensure pursuant to Written Directives section 101700 (PIN 21-21.1- CCP). LPA verified that the lead testing was completed in accordance to the Written Directives outlined in PIN 21-21.1-CCP
LPA referred licensee to the Department website for lead: Lead Toxicity Prevention and Water Testing Information.

LPA discussed the safe sleep regulations with director and discussed the Child Care Licensing Safe Sleep webpage at https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-andresources/safe-sleep as an additional resource. LPA also informed director of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment.
