On 02/27/2024 at 9:45 am, Licensing Program Analyst (LPA) Silva Garibyan arrived at City Kids LA to deliver the findings of a complaint received by the Department on 11/17/23 associated to Complaint Control Number 58-CC-20231117141814. LPA met with Paul Conway, Director of Strategic Operations, and explained the purpose of the visit. During today’s visit, there were 13 staff providing care to 89 children.

The investigation was initiated by Licensing Program Manager (LPM) Betty Emiko Bell and LPA Janine Lipsey, who made observations, conducted inspections and interviews, and obtained copies of the personnel roster, sign-in/sign-out sheets from 06/01/2023 to 11/27/2023 and children's roster from 09/2022 to current.
The investigation was then continued by LPA Silva Garibyan, who made observations, conducted interviews, and obtained copies of the sign-in and sign-out sheets from 08/29/2022 to 09/20/2022 and from 01/03/2024 to 02/20/2024.

The allegation indicates that “Licensee operated the facility outside of license terms and conditions.”

Per Reporting Party (RP), although the facility was licensed for a capacity of 45 children between 2018 and 2022, the facility was operating over capacity with 49, 51, and 58 children present during the 2018 to 2022 period. The reporting party is referring to a YouTube video where the licensee states the availability of 95 spots for the enrollment of pre-school children.

LPA reviewed the sign-in and sign-out sheets for the period between 08/29/2022 to 09/20/2022 and observed that on at least 15 days, before the approval of their capacity increase from 45 to 90 on 09/21/2022, the facility was operating over the capacity of 45. Based on record review for the period between 01/03/2024 and 02/20/2024 after the capacity was approved from 45 to 90, the facility is currently in compliance and operates within capacity limitations. Although the licensee can be seen stating the availability of 95 spots for the enrollment of pre-school children in the YouTube video, after reviewing their records the facility is currently in compliance and has never enrolled more than 90 children.

Based upon observations and reviews of records, the allegation has been determined to be Substantiated. A finding of Substantiated means that the preponderance of evidence standard has been met. California Code of Regulations, Title 22, Division 12 Chapter 1, Article 02. Limitations on Capacity, Section 101161 “Limitation on Capacity" is being cited.

The allegation indicates that “Staff provided false statements regarding the child care center.”

Per Reporting Party, Licensee made a false statement to the Licensing Program Analyst (LPA) from the Department of Social Services on the report dated 12/10/2019 by saying that the preschool provides catered meals. RP stated that snacks and full meals are prepared on site and cooking home-made vegetarian meals on-site is a signature program of the school.

When interviewed, Licnesee stated that they prepare all meals on-site using fresh ingredients, however, they have pizza delivered once a week from a vendor. The Facility Evaluation Report dated 12/10/2019 indicates that the food preparation area was inspected, availability of food and menus were reviewed, and the facility was found to be in compliance. Licnesee was not sure as to why that was said on the report, it may have been a misunderstanding or a mistake by LPA. Licensee explained that they had no reason to lie about the preparation of the food as it was reviewed and checked by LPA during their visit. On the report from 07/25/2022, LPA noted that the facility has a cook, and they are preparing breakfast, snacks, and lunch all in-house by the cook. The report also shows that the LPA inspected the food preparation area.
When interviewed, A2 explained that in the summer of 2019 when the licensee was out of town, A2 was instructed to explain to the licensing program analyst that they do not prepare food in-house and the food is catered from an outside vendor. In the Department of Social Services database, no report was found documenting the visit during that time. Further, no reports identify A2's name as the individual who provided a tour or met a licensing representative.

The reporting party also stated that the licensee was operating multiple family childcare homes by using their employees’ names and one unlicensed care which they falsely presented as a parent co-op. A3 emailed LPA and confirmed that the Family Child Care home whose license was issued to them was really owned and operated by the same owners of City Kids LA. Care at these facilities took place between 2015 to 2022. These facilities are currently closed and no longer in operation. The department will not be conducting any investigations regarding these mentioned facilities and allegations. Further, the individuals who were issued licenses for the Family Child Care homes are responsible for any unlawful conduct and are responsible for reporting such conduct to the department. Regarding the co-op at the address where unlicensed care took place, the department never received any complaints of unlicensed care. The alleged unlicensed care and operation of the multiple Family Child Care Homes have no direct relationship with City Kids LA current operation.

Per Reporting Party (RP), from June 2020 to May 2021, the licensee commingled preschool children with elementary children. Per A2 elementary/day camp students had to walk through the preschool to access the upstairs classroom.

No disclosures were made by the three parents interviewed. All stated that they never observed commingling between the preschool and elementary school children. The children were not commingling, they were transitioning through the facility to their designated classroom, which were upstairs and were not in the same area as the preschool children.

Per the reporting party, from 2018 to 2022, there was a pet pig housed at the preschool and there were multiple incidents when the pet pig bit the children. During the department's inspection on 07/25/2022, the pet pig was noted to be seen in an area that is gated off from the main outdoor space. Per the licensee, the pet pig was moved to the elementary school in 2022. The department has never received any complaints from any of the children's parents relating to a biting incident by the pet pig.


Based on the investigation conducted by the Department, the allegation has been determined to be Unsubstantiated. A finding that the allegation is unsubstantiated means that although the allegation may have happened or is valid, there is not a preponderance of the evidence to prove that the allegation occurred.
