32 | preschool classroom because licensee was not aware that she was a school age child and should have been enrolled in the school age program. LPA conducted an interview with the school age children who stated that they would have am/pm snack, lunches and outdoor play activities while being comingled with the preschool children.
LPA requested that licensee provide a copy of the Child Care Facility Roster (LIC 9040), Personnel Report (LIC 500), Children’s sign in/sign out sheet for the period of March 29-April 09, 2021 and Staff sign in/sign out sheet for the period of March 29-April 09, 2021.
Based on LPA’s observations during today’s visit, interviews with children and licensee’s disclosure, the allegation that staff are commingling school aged children with the preschoolers is substantiated. A finding that the complaint is substantiated means that the allegation is valid because the preponderance of the evidence standard has been met.
The allegation of commingling was observed and has been substantiated. However, no deficiency was cited due to the Child Care Licensing Division’s flexibility in response to the Governor’s Order and Provider Information Notice 20-06-CCP, which allowed mixed groups of children in cohorts during the COVID-19 pandemic.
