On 08/24/2023, Licensing Program Analyst (LPA) Adrian Risher conducted a complaint subsequent visit regarding the above mentioned allegations to deliver the findings. LPA Risher provided the purpose of the visit and observed 12 children in care with 2 staff. LPA Risher met with Toni Hayes, Licensee.

On 05/18/2023 ESCCRO received a complaint regarding staff hit day care child causing injury, staff purposefully dropped day care children, provider is not providing safe environment for daycare children, provider leaves children in car seats for extended periods of time and provider is not present in the daycare for the majority of the day. Information was reported that staff dropped a child while in care and the babies are left in their car seats.

On 05/22/2023, LPA Risher conducted the initial complaint visit. During the visit, LPA Risher conducted interviews with staff and children. LPA requested a copy of the facility roster from Licensee. LPA was provided a copy of Injury Report from 05/08/2023.

Staff have the children sit down and talk to them about their behavior. Children stated they have to sit down when they are not behaving at the daycare. Staff redirect the children as well

Staff report children have not been inappropriately handled while at the daycare. Staff report when a child comes to the daycare with injuries. Staff will inquire about where the injuries came from when they are observed on the child. Licensee submitted an Unusual Incident Report to regional office when injuries were observed on the child. Licensee acknowledged what was observed and confirmed the injuries did not occur at the daycare home.

The facility has a naptime that is part of their daily schedule. The children wake up on their own from the nap. Staff do not force the children to get up. Car seats are used during drop off and pick up time. LPA observed the carseats outside near the front porch. LPA observed the children napping in cribs during inspection.

Licensee acknowledges she leaves to run errands or to go to the store. Staff confirmed the Licensee is present unless she leaves to run to the store. Children stated the Licensee is present at the daycare but sometimes she leaves.

A full investigation was conducted which included observations and interviews. The information received did not reveal evidence that personal rights or license violations occurred. Although the allegations may have happened or is valid, there is not a preponderance of evidence to prove the above alleged violations did or did not occur, therefore the allegations are found to be unsubstantiated. Facility utilizes redirecting as a form of discipline. Licensee provided an Unusual Incident Report when she observed injuries on a child while they were at the daycare. Licensee inquired about the injuries with the parent since the injuries did not occur at the daycare. The carseats are used properly for transporting the infants and children in care. Licensee is present at the daycare but may leave as needed.

Exit interview was conducted and report was provided to Toni Hayes, Licensee. Appeal rights will be provided.
