On 4/28/2025, Licensing Program Analyst (LPA) Suzette Ornelas conducted an made an unannounced visit for the purpose of conducting an initial investigation regarding the above allegations. Upon arrival, LPA was greeted and let into the facility by Licensee, HUETE, LUZMILA SEVERA, to whom the reason for the inspection was announced. LPA toured the facility and observed 3 daycare children and 2 staff.

During the course of the investigation, LPA Ornelas made observations, obtained documentation in the form of children’s roster, and conducted interviews with adults, parents and children in regard to the above allegations.

-Pertaining to the allegation that -Licensee restrained daycare child in high chair when not eating
According to the Reporting Party (RP), RP observed child propped up on a high chair upon pick up multiple times.

According to adults interviewed during the course of the investigation, children are on high chairs as needed to eat. Adults further stated that it does take time to bring multiple children down from eating but high chairs are not used as a restraining device.

According to parents interviewed during the course of the investigation, Parents have no concerns regarding children being restrained in a high chair while at the Family Child Care (FCC). Parents stated that they have not observed children on high chairs for long periods of time or seeming to be in distress. Parents stated that they have observed children in high chair waiting for a meal or after a meal waiting to be put down.

-Pertaining to the allegation that - Licensee does not ensure day care child had safe and comfortable accommodations

According to the Reporting Party (RP), RP stated that child was sleeping in a stroller.

According to adults interviewed during the course of the investigation, adults stated that all children have an assigned bed to sleep on.

According to parents interviewed during the course of the investigation, parents stated that children sleep in the sleep room where there are beds and cribs for them available.

LPA observed an on limit bedroom that is designated for sleep and multiple beds/cribs for children available to accommodate the capacity.

-Pertaining to the allegation that - Licensee does not ensure the day care home is clean and sanitary

According to the Reporting Party (RP), RP stated that the licensee didn’t sanitize, used a role of toilet paper to wipe children hands, when that toilet paper was in bathroom. RP further stated that there were no disinfectant wipes to wipe down and she is not a clean provider.

According to adults interviewed during the course of the investigation, Adults stated that the home is cleaned regularly and as needed. Adults stated that everything is wiped down and moped daily when children are no longer present. Adults further stated that toilet paper is used because it is soft and it is a different roll and not the same one being used in the bathroom.

According to parents interviewed during the course of the investigation, Parents stated that the home is clean and in good repair. Parents stated that they did not observe the home to be unsanitary but what seems like normal child play. Parents further stated that shoes must be removed upon entry.

LPA observed licensee request LPA remove her shoes upon entry.

-Pertaining to the allegation that - Licensee accepts children with signs of illness into care

According to the Reporting Party (RP), RP stated that child was sick for 2 weeks because provider let sick children into the day care.

According to adults interviewed during the course of the investigation, Adults stated that sick children can not go to the day care and parents are aware of that. Parents are good at making sure that children do not go. Adults further stated that if a child is observed to not be feeling well, parents are called to pick their child up.

According to parents interviewed during the course of the investigation, Parents stated that children are not allowed to go to the day care if they are sick or have a fever, Parents stated that the provider will call them to pick their children up if they are showing symptoms of being ill. Parents stated that children tend to get sick often are understand that.

Based on the evidence as documented above, the allegations have been determined to be Unsubstantiated. A finding that the complaint is unsubstantiated means that although the allegation may have happened or is valid, there is not a preponderance of the evidence to prove that the allegation occurred.
A notice of site visit was given and must remain posted for 30 days.
