On 04/11/2024 at 1:24 p.m. Licensing Program Analyst (LPA) Cristina Castellanos conducted an unannounced Annual Required Inspection at the above-mentioned facility. LPA was greeted by Licensee Jenny Gandy. LPA disclosed the purpose of the inspection and was granted entry into the home by the Licensee. LPA toured the home both inside and outside. Present during today’s inspection was Licensee Jenny Gandy, uncleared assistant Z. Zhang and ten (10) children in care.

Capacity as specified on the license is being maintained during today’s inspection. Capacity Regulations for Family Child Care Home Licensed flyer was provided to Licensee Gandy. At approximately 2:15 p.m. two children were picked up. Moreover, at 2:23 p.m. the uncleared assistant left the home. From that point Licensee was in compliance with capacity requirements for a Small Family Child Care Home with only eight (8) children in care.

The purpose of this inspection is to ensure that health, safety, and personal rights as required by Title 22 Regulations governing California Child Care Homes will be met by the licensee. The facility is licensed for a Large Family Child Care with a max capacity of 14 children. Currently the facility is available to take children ages two-years-old to five years old. The facility hours of operation are 8:00am to 6:00pm Monday through Friday. Licensee is not available for evening, overnight or weekend care. Per licensee the individuals currently residing in the home is only the licensee.

The home is a single-family home, consisting of 2 bedrooms, 1 bathroom, a living room, a kitchen, a dining room and a detached garage. Families enter the home through the main entrance, who are lead directly to the living room. Licensee confirmed childcare is primarily conducted in bedroom No. 2 (Clasroom). LPA observed a dual open face heater in the living room/hallway barricaded by white hardboard pegboards. Per licensee the living room and classroom are used for napping and the classroom is used for eating.

Licensee confirmed the following areas as OFF LIMITS: bedroom no. 1, the kitchen and the detached garage. LPA observed child proof gates in the kitchen’s main entrance as well as in the dining room’s door frame which also leads into the kitchen, making the area inaccessible to all the children in care. LPA reminded licensee that any area designated as OFF LIMITS should be made inaccessible during the hours of operation and/or while children are present.

There are no firearms or ammunition on the premises. No bodies of water were observed on the premises. Detergents and cleaning compounds are kept primarily underneath the kitchen skin cabinet which has a safey latch.

Licensee confirmed the home is not available to take in a child that might need Incidental Medical Services (IMS). Currently there are no children that require medication.

Licensee confirmed the home does provide meals and snacks. Licensee confirmed the home does participate in a Child Care Food Program. LPA discussed the importance of maintaining a system where allergies and food restrictions are noted.

LPA observed licensee test the carbon monoxide and all smoke detectors throughout the home. LPA observed a working fire extinguisher in the kitchen, near the rear exit door. Additionally, LPA observed a Pull Fire Alarm system in the kitchen. LPA reminded licensee to maintain proof of an annual service for the fire extinguisher.

Adequate heating and ventilation for safety and comfort were observed in the space. Safe toys and play equipment were observed. The home has a working telephone service.

Licensee ensures that children in care are supervised at all times and is aware children shall not be left in parked vehicles. Car seats are used for transportation purposes only and are not used for sleeping children.

Licensee was unable to provide current Mandated Reporter Training, it was last taken on 01/02/2019. The Pediatric CPR/Pediatric First Aid was taken on 10/28/2023. LPA reminded Licensee the importance of completing the renewal training for both the Mandated Reporter and the Pediatric CPR/ First Aid every two years following the date of which she completed the initial training. Additionally, LPA reminded licensee the importance of making sure all vendors providing Pediatric CPR and Pediatric First Aid need to be EMSA approved. LPA reviewed 6 children’s files and observed files to be

complete. LPA reminded Licensee to maintain updated immunization records on file. LPA provided licensee with a current copy of the LIC 311D and LIC126 translated in Chinese to use as a reference when auditing files.

Based on observation, interview and record review Licensee did not comply with Criminal Record Clearance section 102370(d) All individuals subject to a criminal record review pursuant to Health and Safety Code Section 1596.871 shall prior to working, residing or volunteering in a licensed facility. After reviewing the Guardian Employee Roster, LPA further conducted a person search, using the uncleared assistant’s Driver License information and received the following message: No applicants that match your search criteria were found in the background checking system.


Family Child Care Home Licensee was reminded that all adults 18 and over living or working in the home, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a licensed Family Child Care Home. A civil penalty of $100.00 minimum/day for a maximum of 5 days or, if the penalty is for a repeat violation, for a maximum of 30 days per person will be assessed if this regulation is violated.

LPA discussed the safe sleep regulations with licensee and discussed the Child Care Licensing Safe Sleep webpage at https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-andresources/safe-sleep as an additional resource. LPA also informed licensee of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment.

Incidental Medical Services (IMS) policy was discussed. For IMS information see PIN 22-02-CCP. When any IMS is provided, a Plan for Providing IMS must be submitted to the Department. Licensee was informed of the MyChildCarePlan.org website; a consumer education website that helps families obtain child care by connecting them to child care providers and Resource and Referral Agencies (R&Rs) throughout California.

Per Title 22, Division 12, Chapter 3, of the California Code of Regulations, there were two (2) deficiencies cited at this time for violation of Title 22 regulation; (see LIC809-D).

An exit interview was conducted and Plans of Correction were reviewed and developed with Licensee Jenny Gandy. A copy of this report and appeal rights were discussed and left with Licensee Gandy. A Notice of Site Visit was given and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.
