On 4/30/26, Licensing Program Analyst (LPA) Angela Luz met with Licensee, Jenny Gandy, to conduct an unannounced annual/random inspection. The home was toured to conduct a Health and Safety Inspection. Entrance checklist for Family Child Care Home was provided and licensee was reminded of documents to be posted in a prominent, publicly accessible area of the facility. Days and hours of operation are from Monday to Friday 8:00AM to 6:00PM.  Mandarin and English are spoken to the children in care. Licensee is bilingual Mandarin/English and their preferred language is Mandarin. The facility is doing business as Mandarin Family Childcare.

Also present at the time of inspection was 8 preschool aged children. There was no assistant present. The facility is not within capacity compliance. LPA reviewed capacity requirements with Licensee for when there is no assistant present and the definition for school aged children. One child was picked up around 2:30PM. Another child was picked up around 3:10PM. After pick up of the second child, Licensee is within capacity compliance. Licensee understands that until they get a fingerprint cleared and associated assistant the most children in care they can have at one time is 6 preschool aged children. There are no enrolled infant children.

Licensee toured the on limit areas of the facility with LPA. The home is neat and free of debris with heating and ventilation for safety and comfort. The ON LIMIT AREAS are the living room, bathroom, classroom, kitchen, and backyard. The kitchen is used as a walkway to get to the backyard. The OFF LIMIT AREAS are the bedroom, dining room, and garage. LPA noted there are large chairs that block the entryway to the dining room. The garage doors are locked.

FACILITY EVALUATION REPORT California law requires a public report of each licensing visit/inspection. This report is a record for the facility and the licensing agency. This report is available for public review; therefore, care is taken not to disclose personal or confidential information. Inquiries concerning the location, maintenance, and contents of these reports may be directed to the Licensing Program Analyst or Regional Office whose address and telephone number are listed on the front of this form.

DEFICIENCIES A deficiency is an instance of noncompliance with licensing requirements, including applicable statutes, regulations, interim licensing standards, operating standards, and written directives. Applicants/ licensees must be notified in writing of all licensing deficiencies. Deficiencies are listed on the left side of this form, and the applicable licensing requirement upon which the deficiency is identified. There are two types of deficiencies:
  • Type A deficiencies are violations of licensing requirements that, if not corrected, have a direct and immediate risk to the health, safety, or personal rights of persons in care.
  • Type B deficiencies are violations of licensing requirements that, without correction, could become a risk to the health, safety, or personal rights of persons in care, a recordkeeping violation that could impact the care of said persons and/or protection of their resources, or a violation that could impact those services required to meet the needs of persons in care.

PLANS OF CORRECTION (POCs) The licensing agency is required to establish a reasonable length of time to correct a deficiency. In order to set the time, the licensing agency must take into consideration the seriousness of the violation, the number of persons in care involved, and the availability of equipment and personnel necessary to correct the violation. Applicants/licensees are requested to provide a specific plan for each violation on the right side of the form across from each deficiency. The more specific the plan, the less chance exists for any misunderstanding in setting time limits and reviewing corrections. The applicant/licensee who encounters problems beyond their control in completing the corrections within the specified time frame may request and may be granted an extension of the correction due date by the licensing agency.

CORRECTION NOTIFICATION The applicant/licensee is responsible for completing all corrections and promptly notifying the licensing agency of corrections. Applicants/licensees are advised to keep a dated copy of any correspondence sent to the licensing agency concerning corrections, or if corrections are telephoned to the licensing agency, the date, person contacted, and information given.

CIVIL PENALTIES The licensing agency is required by law to issue a Penalty Notice, when applicable, to all facilities holding a license issued by the licensing agency, or subject to licensure, except Certified Family Homes, Resource Families, and Foster Family Homes, or any governmental entity.

PENALTY NOTICE GIVEN The statement concerning civil penalties serves as a penalty notice on this Licensing Report and failure to correct cited licensing deficiencies will result in civil penalties. Applicants/ licensees are required to pay civil penalties when administrative appeals have been exhausted and in accordance with any payment arrangements made with the licensing agency.

APPEAL RIGHTS The applicant/licensee has a right without prejudice to discuss any disagreement in this report with the licensing agency concerning the proper application of licensing requirements. The applicant/ licensee may request a formal review by the licensing agency to amend or dismiss the notice of deficiency and/ or civil penalty. Requests for review shall be made in writing within 15 business days of receipt of a deficiency notification or civil penalty assessment. Licensing deficiencies may be appealed pursuant to the procedures in the LIC 9058 Applicant/Licensee Rights.

AGENCY REVIEW The licensing agency review of an appeal may be conducted based upon information provided in writing by the applicant/licensee. The applicant/licensee may request an office meeting to provide additional information. The applicant/licensee will be notified in writing of the results of the agency review within 60 business days of the date when all necessary information has been provided to the licensing agency.

EMAIL REQUIREMENT Adult Community Care Facilities, Residential Care Facilities for the Chronically Ill, and Residential Care Facilities for the Elderly are required to provide and maintain an active email address of record with the licensing agency.

Licensee stated they use the half of the backyard that is closest to the home. LPA noted a fence separating the halves of the backyard. There is a large play structure with wood chips underneath the structure. LPA stated that children in care do not use the structure.

There have been no changes from the areas previously identified as OFF LIMITS or alterations to existing building or grounds. There are no bodies of water. All hazardous materials and toxins are kept out of the reach of children. Licensee understands that any materials that are labeled “Keep out of reach of children” or have similar messaging should be kept out of reach from children in care.

Licensee states that there are no firearms in the home. The home has a fully charged 3A40BC fire extinguisher that was last serviced on 6/20/23, working smoke detector, working carbon monoxide detector, and working telephone. LPA reminded that fire extinguishers should be serviced or newly purchased once a year.

There are ample age-appropriate toys that appear to be safe and in good condition. Licensee states they use talking with the child as forms of discipline. Licensee understands that children's personal rights should not be violated, including but not limited to, no corporal punishment, interference with eating, intimidation, or other actions of a punitive nature. Licensee understands that children are treated with dignity, receive safe, healthful, and comfortable accommodations. When children in care are sick, they wear a face mask while waiting for their parents to pick them up. They are separated from the group but remain in the same area as other children for supervision. LPA reminded that Licensee is required to be present for 80% of operating hours per day. Licensee understands how to report Unusual Incidents/Injuries.

Licensee Pediatric CPR/First Aid is current and expires 5/17/27. Licensee Mandated Reporter Training for Child Care Providers expired on 4/17/26. Licensee was reminded that Mandated Reporter Training (AB1207) and CPR/First aid certifications needs to be renewed every two years. A copy of the licensee’s immunization is on file. The Licensee conducts and documents fire and disaster drills every six months, last drill was on 3/10/26. A current copy of the facility roster was viewed, and a copy was obtained. LPA noted Affidavit Regarding Liability Insurance (LIC 282) in children’s files. LPA reviewed 5 random children's files and noted they all had the required documentation. LPA reminded Licensee to transfer children's immunizations to the California Pre-Kindergarten and School Immunization record and gave a blank copy to utilize.
