According to the Allegations, on 10/05/22, facility staff allowed Child 1 (C1) to climb onto a chair and C1 fell but did not sustain any injuries. Facility provided the parent with written and verbal notification of the incident. On 10/06/22, facility staff allowed C1 to climb onto a table to see what would happen. C1 was able to climb back down and did not sustain any injuries. Facility provided parent with verbal notification of the incident.

Staff 2 (S2) is reporting that on 10/05/22, S2 was present when C1 fell of a chair. According to S2, C1 pulled a chair out from under a table and repeatedly kept standing on the chair and leaning over on to the table. S2 repeatedly redirecting C1 off the chair and C1 would not get of the chair. S2 had to physically get C1 off the chair to keep C1 from falling. S2 tried to redirect C1 to another area but C1 kept going back to stand on the chair until C1 fell. S2 was standing next to C1 but turned around when C1 stood on the chair and fell. S2 is reporting that C1 did not sustain any injuries and parent was notified of the incident. S2 is reporting that on 10/05/22, C1 stood on the bench in the playground, leaned over the table and attempted to jump onto the table from the bench. Without incident, C1 was redirected back to the play structure.

LPA received a copy of the Incident report that was provided to the parent of C1, for the Incident that occurred on 10/05/22. LPA received email thread from the facility to the parent dated 10/06/22. The email is to following up on the incident that occurred on 10/05/22, facility is requesting assistance from parent to continue to tell C1 not to stand on chairs, because when the facility tells C1 not to stand on chairs C1 laughs or screams. LPA received email thread dated 09/27/22, informing parent of the child’s behaviors and standing on classroom chairs.

Allegation, Staff are not treating day care children equally.

According to the Allegations, C1 is not being exposed to the same activities as other children. The Reporting Party (RP) is reporting that C1 is not exposed to the same activities because on 10/07/22, S2 provided C1s writing package which was smaller than other children’s packages. RP was told that C1s package was smaller because they could not get C1 to give them the answers. Rp stated that this are in class packages they work on and since C1 cannot finish the first page C1 cannot get the next page.

Staff 2 (S2) is reporting that not all children are on the same writing packages. The school has biweekly packages that go home, sometimes the packages vary in size and content. Children get packages based on their ability to trace, recognition of sounds, numbers, or activities they are working on. S2 provided the first biweekly package and explained to the parent what to expect every two weeks. S2 explained the reason the package was smaller was because C1 was starting with tracing and sounds, and C1 could not say the “C” sound. S2 explained to the parent that every child is working at their own rate and every child is different.

Although the allegations may have happened or is valid, there is not a preponderance of evidence to prove the alleged violations did or did not occur, therefore the allegation is unsubstantiated.

A copy of this Report, Notice of Site Visit, and Appeal Rights were explained and provided to Roshawn Dobbins, Office Manager.
