On 01/09/2024 Licensing Program Analysts (LPA) Laticia Thompson met with Marina Olshansky (Owner) and Sara Poage (Director). The purpose of the visit was an announced decrease in capacity inspection at the facility to ensure that health, safety and personal rights as required by Title 22 and Health and Safety Regulations governing California Child Care Centers will be met. There were 55 children present during this inspection. This is an application for 75 children ages 2- to entry into the 1st grade. The child care center will operate Monday – Friday 6:30 a.m – 6:00 p.m. The fire clearance was approved on 12/5/2023. LPA toured and measured the on-limits areas. The facility has a total of 4 classroom. Children will have access to 6 sinks, 6 toilets and 1 urinal.

Classroom measurements are:

The Indoor total measurements contain a total of 2330.59 divided by 35 square feet, which will not accommodate Applicant’s request for 75 children. Based on today’s measurement the facility capacity limit for indoor space is 66 children.

Outdoor Play measurements are:

The outdoor activity space total measurements contain a total of 4552.58 divided by 75 square feet, which will not accommodate Applicant’s request for 75 children. Based on today’s measurement the facility capacity limit for outdoor space is 60 children.

The facility shares two addresses at this time 4946 W. 20th Street and 5005 W. 21st Street. The facility is decreasing capacity due to a fire located at an additional address of 4950 W. 21st Street. This facility address has been temporarily closed. LPA observed the location of 4950 that has been barricaded with a mesh fence and inaccessible to children.

Indoor/Children’s Area:

The following was observed.



Parents will enter and exit through the front entrance area located at 4946 W. 20th street and 5005 W. 21st street. Parents will sign in and out electronically under the Pro Care Application. For best practice purposes, LPA advised facility there should be a plan in place on how the records would be backed up, and how they would be made available in the event of a power failure or disaster.

There are 2 staff restrooms, one located at the 4946 address & and one located at the 5005 addresses.

There are cameras throughout the facility.

LPA observed trash cans having tight fitting lids.

The facility has filtered water faucets located inside the facility to provide children with water for outdoor and indoor activities. Parents provide children with personal water bottles for usage at the facility.

There is an operable carbon monoxide detector located in the classroom area located at 4946 20th St and 2 in the classrooms located 5005 W 21st.

Licensee was advised to place facility licensing number on outside advertisement.

LPA observed 3A40B:C fire extinguishers at both addresses with an inspection date of 11/09/2023.

LPA observed First aid kits at both addresses and a handheld digital thermometer. The facility will provide a copy of the First Aid operating Manual.

Furniture and equipment were observed to be maintained in good condition, free of sharp, lose or pointed parts.

Tables and chairs were observed to meet the needs of the children. There are cots and mats for napping.



All play equipment and materials used by children were observed facility was unable to provide proof of age appropriateness for play apparatus.

There are cubies in all classrooms for storage of children clothing and personal belongings.

There are two refrigerators located in kitchens at both address. There are refrigerators in the classrooms at the 5005 address. All are equipped with a thermostat to regulate the temperature.

All medication and medication that require refrigeration will be stored in the office area.

The entire facility is equipped with central heating and air.

The classrooms and restrooms were clean in good repair.



Windows were in good repair free of chipping paint, dirt, insects or debris.

Classrooms have adequate lighting.

The facility is equipped with landline telephone service located in the front office. Facility has walkie/talkies.



The required postings are posted at both address were parents and visitors to review.

Ill children will use the office for isolation and the staff restroom located at the 4946 W.20th Street address.


The program provides lunch and snacks. Menus are posted in writing and shall be posted at least one week in advance in an area accessible for review by the child's authorized representative. Copies of the menus as served shall be dated and kept on file for at least 30 days. Menus shall be made available for review by the child's authorized representative and the Department upon request.

The owner stated disinfectants, cleaning solutions, and other items that are dangerous to children are stored in the kitchen cabinet under the sink with a safety latch. The kitchen has a keyed lock for entering.

Outdoor

The entire outdoor activity grounds are enclosed by a fence to protect children and to keep them in the outdoor activity area. The fence is at least four feet high. The surface of the outdoor activity space that has a play apparatus, slide and swings has artificial turf for cushioning to prevent injury from falls. The outdoor activity space was observed to be maintained in a safe condition and is free of hazards. There is adequate shade in the outdoor activity area. LPA observed benches for resting. The outdoor activity area located on the side of the building of 5005 W. 21st street requires cleaning, debris removal and corrections (see POC).

The following items were discussed:

The director was reminded that all adults 18 and over responsible for administration or direct supervision of staff, persons who provides care and supervision to children, and staff who have contact with children, including employees and volunteers, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a Child Care Center. A civil penalty of $100.00 minimum/day up to $500.00 maximum per day/per person will be assessed if this regulation is violated.

LPA reviewed with facility representative the LIC 311A, Records To Be Maintained At The Facility, for child’s records, personnel records, administrative records, and documents to be posted.

Assembly Bill (AB) 2370, Chapter 676, Statutes of 2018, requires all licensed Child Care Centers (CCCs) constructed before January 1, 2010, to test their water (used for drinking and food preparation) for lead contamination before January 1, 2023, and then every 5-years after the date of the first test.

For child care center licenses issued after July 1, 2022, the licensee shall test their water for lead within 180 days of licensure pursuant to Written Directives section 101700 (PIN 21-21.1-CCP).
LPA verified that the lead testing was completed in accordance to the Written Directives outlined in PIN 21-21.1-CCP.

LPA discussed the safe sleep regulations with licensee [or facility representative] and discussed the Child Care Licensing Safe Sleep webpage at https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-and-resources/safe-sleep as an additional resource. The following corrections are needed before a licensure will be considered.

· Place lock on crawl space at 5005 W.21st Street.
· Repair barricade around central air unit
· Place cushioning under gate located at the 5005 W. 21st Street address
· Remove debris and plastic pole near the storage area
· Place a barrier near the stair area to prevent children from access the off limit area on the side yard area of the 5005 W 21st street building.
· Provide proof of First Aid Manual.
· Provide a waiver request for outdoor activity space usage.

Corrections are due by 01/29/2024.

An exit interview was conducted with plans of corrected items discussed. LPA provided the owner with appeal rights and a copy of this report. Final license determination will be made upon review by the Licensing Program Manager and corrections.
