On 08/10/2026 at 08:19am Licensing Program Analyst (LPA) DeCondia Ferguson conducted a subsequent complaint investigation to deliver findings regarding the allegation that Emunah Hebrew Academy was operating out of required teacher-child ratios. Upon arrival LPA met with facility Secretary as Director Sara Yasharpour was not present. LPA explained the purpose of the visit. LPA observed no staff or children as the facility was closed for cleaning, painintg and other repairs. LPA was later joined by Director Sara Yasharpour at 09:36am.

During the initial visit, the investigation consisted of observations made during the complaint inspection conducted on July 24, 2026. Interviews were conducted with the Licensee and six (6) Junior Counselors/Volunteers. LPA also collected and reviewed facility records, including children's sign-in/sign-out sheets, camp rosters, camp calendars, facility sketches, and admission records.

During the inspection, LPA observed three classrooms operating with one qualified teacher assigned to each classroom and two Junior Counselors/Volunteers assigned to each classroom. Room 101 consisted of nine children ages 18 to 24 months, one Teacher, and two Junior Counselors/Volunteers (JC1 and JC2). LPA observed Junior Counselor JC1 alone inside the classroom supervising one child while the teacher and remaining children were outside with Junior Counselor JC2. Room 103 consisted of fourteen (14) children ages 18 to 36 months, one (1) teacher, and two (2) Junior Counselors (JC3 and JC4). Room 203 consisted of sixteen (16) children ages 4 to 5 years, one (1) Teacher, two (2) Junior Counselors (JC5 and JC6), and three (3) support staff from an outside agency. Thirty-nine (39) children were present during the inspection.

Based on the number of children observed and the number of qualified teaching staff assigned to each classroom, each classroom required additional qualified teaching staff to meet the minimum teacher-child ratios established by Title 22. Without counting the Junior Counselors as classroom staff, Room 101 required two qualified teachers, Room 103 required three qualified teachers, and Room 203 required additional qualified classroom staff to maintain the required teacher-child ratio.

LPA interviewed Director Sara Yasharpour regarding the facility's staffing practices. The Director stated the facility utilizes volunteers between the ages of twelve (12) and fifteen (15) years, referred to as "Junior Counselors," to assist teachers during the summer program. The Director stated the Junior Counselors assist with supervision, helping children, bringing snacks, assisting older children to the restroom, and classroom activities. The Director acknowledged that the Junior Counselors are volunteers, are not employees, and that no volunteer documentation is maintained other than telephone numbers.

When questioned regarding staffing practices, the Director stated the Junior Counselors receive an orientation and are instructed not to leave children unsupervised. However, when asked how required teacher-child ratios are maintained throughout the day, the Director stated, "I use Junior Counselors to maintain ratios." The Director further acknowledged there is no documentation identifying classroom staff assignments.

LPA conducted interviews with all six Junior Counselors assigned to the classrooms. Their statements consistently established that they routinely performed child supervision duties while teachers temporarily left classrooms. Specifically, JC1 (age 12) reported supervising approximately five (5) children while the teacher stepped away. JC2 (age 12) reported supervising approximately ten (10) children for two to three minutes while the teacher stepped away. JC4 (age 14) reported supervising approximately ten (10) children without another person in the room while the teacher stepped away. JC5 (age 15) reported supervising approximately fifteen (15) to seventeen (17) children alone for approximately thirty (30) minutes during nap time while the teacher was absent. JC6 (age 13) reported supervising approximately ten (10) children for less than twenty (20) minutes while the teacher stepped away.

These statements were consistent with one another and with LPA's observations during the inspection.

Title 22, California Code of Regulations, Section 101216(c), provides that volunteers may be utilized only when supervised and are not included in the center's staffing plan. During the investigation, the Director stated, "I use Junior Counselors to maintain ratios." Interviews with multiple Volunteers further established they routinely supervised children while teachers temporarily left classrooms.

Based on LPA observations, review of facility records, the Director's admissions, and corroborating witness interviews, the preponderance of evidence establishes that the facility utilized Junior Counselors/Volunteers, ages twelve (12) through fifteen (15), to provide supervision of children and included those volunteers in the facility's staffing plan to supplement required classroom staffing and maintain required teacher-child ratios. The evidence further establishes that the classrooms observed on July 24, 2026, did not have sufficient qualified teaching staff to meet the required teacher-child ratios without relying on the Junior Counselors/Volunteers. This practice is inconsistent with Title 22, California Code of Regulations, Sections 101216.3 and 101216 (c). The Department has determined that the facility's reliance on minor volunteers to perform supervision duties in lieu of qualified teaching staff created an immediate risk to the health and safety of children in care.

Accordingly, the allegation that the facility was operating out of ratio is SUBSTANTIATED. A finding that the complaint is substantiated means that the allegation is valid because the preponderance of the evidence standard has been met.

Therefore, a Type A deficiency is being cited.
