On 10/31/2024, Licensing Program Analyst (LPA) Lisa Clayton made an unannounced visit to the Family Child Care Home to conduct the Required 3-year inspection. LPA was greeted by Licensee Marie Villafan. LPA Clayton observed 9 children being cared for by the licensee and her fingerprint cleared assistant (sister). Per Licensee the hours of operation are Monday through Friday 7:30am – 6:00pm. Licensee provides breakfast, lunch and afternoon snack, small dinner, milk and water.

LPA Clayton toured the home inside and outside for a Health and Safety inspection. The home has working telephone and LPA Clayton confirmed the number is (424) 228-5001.

During the inspection LPA Clayton observed Infant #1 (not eating) restrained in a low feeding chair with (per licensee) a ripped receiving blanket tied around her chest and neck. LPA Clayton instructed licensee to remove the infant immediately. LPA Clayton observed a pink/red mark on the child’s neck under the tie and the restrained infant was crying at the time. LPA Clayton observed 2 other low feeding chairs with the restraint tied to the chairs (no children were in the chairs).

LPA Clayton observed a wood and metal play structure with a slide constructed by the licensee without the prior knowledge and inspection of the department.

LPA Clayton confirmed that the single-family home consists of the following: living room, dining room/kitchen, 3 bedrooms, 2 bathrooms, fenced back yard, and detached garage with laundry room.

The plan must include positive measures that do not violate personal rights of children. The plan must include the licensee assistant. Licensee will have the stucture completely removed no later than Friday November 1, 2024. Licensee has made the structure inaccessible to children in care during the inspection. LPA Clayton will conduct a tour of the backyard via Zoom meeting on Monday November 4, 2024.
Licensee acknowledges understanding that prior to getting another play structure the department must be notified in advance.
Failure to correct the cited deficiency(ies), on or before the Plan of Correction (POC) due date, may result in a civil penalty assessment.

The ON LIMIT AREAS are as follows: living room (napping room), dining room/kitchen (to access the living room and the bathroom), bedroom #3 (infant nap room), bathroom #1, a section of the detached garage and part of the fenced backyard. The ISOLATION AREA will be in the napping room (living room).

The OFF-LIMIT AREAS are as follows: bedroom #1, bedroom #2, bathroom #2, laundry room, section of the fenced backyard and a part of the detached garage all of which are inaccessible to children in care by child safety gates and/or closed and/or locked doors and visual supervision.

Furniture and equipment are in good condition and free of sharp, loose, or pointed parts.

There are no pools, ponds or any other bodies of water on the premises. There are no firearms or ammunition on the property.



The home has a fully charged 2A10BC fire extinguisher in the kitchen, a working carbon monoxide detector in the hallway and working smoke detectors in the hallway and the napping room (bedroom #1).

LPA Clayton reviewed 5 children’s files and observed them to be in compliance as they contain current contact information for authorized representatives and/or relatives who can assume responsibility for the child, immunization records, and signed Parent’s Rights.

Both licensee and her assistant have current CPR/First Aid certificate that expire in 2025. Licensees Mandated Reporter training expires 2026. Licensee and staff have immunization records and are in compliance with immunizations required for childcare providers.

LPA Clayton observed Sleep Logs for children in care under 2 years of age. LPA Clayton provided Licensee with a copy of the Safe Sleep regulations and reminded license of the Safe Sleep webpage at https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-and­resources/safesleep as an additional resource. LPA Clayton informed applicant of the importance of checking for recalled infant devices on the United States Consumer Products Safety Commission (CPSC) website at https://www.cpsc.gov/, and recommended they register all infant devices with the CPSC to be notified of any recalls on the purchased equipment.


Incidental Medical Services (IMS) are currently being provided. LPA Clayton provided licensee with an IMS Plan sample. Licensee is aware that an IMS plan is required to be submitted to the licensing office upon completion. Information regarding Americans with Disability Act (ADA) can be obtained by contacting US Department of Justice toll free ADA Information line at (800) 514-0301(voice), (800) 514-0383 (TDD) and website link https://www.ada.gov/childqanda.htm.

LPA reminded Licensee of the Community Care Licensing website www.ccld.ca.gov which will provide access to Provider Information Notices (PINs), Quarterly Updates, COVID-19 Information and Resources, Mandated Reporter Training, Safe Sleep in Child Care, Lead Poisoning Facts, Forms and Regulations.

Licensee was reminded that all adults 18 and over living or working in the home, including employees and volunteers, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a licensed Family Child Care Home. A civil penalty of 100.00 minimum/day up to $500.00 maximum per day/per person will be assessed if this regulation is violated.

Licensee was informed of the MyChildCarePlan.org website; a consumer education website that helps families obtain childcare by connecting them to childcare providers and Resource and Referral Agencies (R&R) throughout California.


During the exit interview, Licensee Marie confirmed that there are no Registered Sex Offenders living in the home and LPA completed the RSO profile in FAS.

No later than Monday November 4, 2024, licensee will submit the following to LPA Clayton and the department via Zoom call and/or email:
· Proof of removal of the wooden play structure and the wire mesh on the garden boxes via Zoom call
· Updated/revised Emergency Disaster Plan
· Update/revised Facility sketch to show current off/on limit areas
· Current Mandated Reporter Training certificate for her assistant

Per Title 22 Regulations and Health and Safety Codes, deficiencies and Technical Violations were cited today (see LIC 809D, LIC 9102).

Licensee will provide parents of currently enrolled children and parents of children enrolled over the next 12 months copies of the Licensing Report containing the Type A violation and maintain a signed LIC 9224 the above-mentioned children’s files.

An exit interview was conducted, a copy of this report and Appeals Rights was read and provided to license Marie.

LPA Clayton posted a Notice of Site Visit which is required to be posted for 30 days.
