On 4/23/26 Licensing Program Analyst (LPA) Angela Luz, met with Licensee Tracie West to conduct an unannounced Annual/Required inspection.  Also present were 12 preschool children. Licensee is in ratio with the children today. The facility is within capacity and ratio compliance today. LPA provided the Entrance Checklist (LIC 125) and the facility was toured indoors and outdoors for a Health and Safety Inspection. Days and hours of operation are Monday to Friday 8AM to 5PM. The facility also has an infant license (197493360) at the same address.

While inspecting the outdoor play area, LPA noted it was a loose T shape, which can make visual supervision difficult due to blind spots. The main part of the outdoor play area is a rectangle shape and there is a section that branches off away from it in another rectangle area. There is an additional blind spot created by the outdoor bathroom building. Children in care could walk around the building, preventing visual supervision from staff on the other side. LPA expressed their concern about supervision to Licensee. Licensee stated they tell the children to stay in the yard but sometimes they do not listen. LPA suggested using child gates to restrict the blind spot areas. Licensee agreed.

At 10:20AM LPA observed Child 8 (C8) walk away from the group in the outdoor play area and use the bathroom by themselves without supervision from Licensee. LPA asked C8 if "teacher" (Licensee) knew they were in the bathroom. C8 stated no and that they were just going potty. LPA asked if they were supposed to tell "teacher" that they needed to use the bathroom. C8 nodded. After C8 was done in the bathroom, LPA informed Licensee immediately. Licensee spoke to the group about needing to stay together.
A civil penalty was assessed.

FACILITY EVALUATION REPORT California law requires a public report of each licensing visit/inspection. This report is a record for the facility and the licensing agency. This report is available for public review; therefore, care is taken not to disclose personal or confidential information. Inquiries concerning the location, maintenance, and contents of these reports may be directed to the Licensing Program Analyst or Regional Office whose address and telephone number are listed on the front of this form.

DEFICIENCIES A deficiency is an instance of noncompliance with licensing requirements, including applicable statutes, regulations, interim licensing standards, operating standards, and written directives. Applicants/ licensees must be notified in writing of all licensing deficiencies. Deficiencies are listed on the left side of this form, and the applicable licensing requirement upon which the deficiency is identified. There are two types of deficiencies:
  • Type A deficiencies are violations of licensing requirements that, if not corrected, have a direct and immediate risk to the health, safety, or personal rights of persons in care.
  • Type B deficiencies are violations of licensing requirements that, without correction, could become a risk to the health, safety, or personal rights of persons in care, a recordkeeping violation that could impact the care of said persons and/or protection of their resources, or a violation that could impact those services required to meet the needs of persons in care.

PLANS OF CORRECTION (POCs) The licensing agency is required to establish a reasonable length of time to correct a deficiency. In order to set the time, the licensing agency must take into consideration the seriousness of the violation, the number of persons in care involved, and the availability of equipment and personnel necessary to correct the violation. Applicants/licensees are requested to provide a specific plan for each violation on the right side of the form across from each deficiency. The more specific the plan, the less chance exists for any misunderstanding in setting time limits and reviewing corrections. The applicant/licensee who encounters problems beyond their control in completing the corrections within the specified time frame may request and may be granted an extension of the correction due date by the licensing agency.

CORRECTION NOTIFICATION The applicant/licensee is responsible for completing all corrections and promptly notifying the licensing agency of corrections. Applicants/licensees are advised to keep a dated copy of any correspondence sent to the licensing agency concerning corrections, or if corrections are telephoned to the licensing agency, the date, person contacted, and information given.

CIVIL PENALTIES The licensing agency is required by law to issue a Penalty Notice, when applicable, to all facilities holding a license issued by the licensing agency, or subject to licensure, except Certified Family Homes, Resource Families, and Foster Family Homes, or any governmental entity.

PENALTY NOTICE GIVEN The statement concerning civil penalties serves as a penalty notice on this Licensing Report and failure to correct cited licensing deficiencies will result in civil penalties. Applicants/ licensees are required to pay civil penalties when administrative appeals have been exhausted and in accordance with any payment arrangements made with the licensing agency.

APPEAL RIGHTS The applicant/licensee has a right without prejudice to discuss any disagreement in this report with the licensing agency concerning the proper application of licensing requirements. The applicant/ licensee may request a formal review by the licensing agency to amend or dismiss the notice of deficiency and/ or civil penalty. Requests for review shall be made in writing within 15 business days of receipt of a deficiency notification or civil penalty assessment. Licensing deficiencies may be appealed pursuant to the procedures in the LIC 9058 Applicant/Licensee Rights.

AGENCY REVIEW The licensing agency review of an appeal may be conducted based upon information provided in writing by the applicant/licensee. The applicant/licensee may request an office meeting to provide additional information. The applicant/licensee will be notified in writing of the results of the agency review within 60 business days of the date when all necessary information has been provided to the licensing agency.

EMAIL REQUIREMENT Adult Community Care Facilities, Residential Care Facilities for the Chronically Ill, and Residential Care Facilities for the Elderly are required to provide and maintain an active email address of record with the licensing agency.

The outdoor play area is fully fenced and has shade available. All equipment and surfaces are free from hazards.  LPAs observed age-appropriate outdoor toys and materials for the children. Drinking water is provided in water bottles when children are outside. LPA reminded Licensee to ensure children's water bottles are labeled with their name. Per Licensee, there are no firearms or other weapons on the premises. There are no bodies of water, or free-standing water accessible to children.

All classrooms were inspected for age-appropriate furnishings, equipment, and adequate storage for children’s belongings. LPA observed most furniture and equipment are in good condition and free of sharp, loose or pointed parts. LPA observed 1 blue plastic chair with metal legs used in the classroom that had a sharp edge on the seat. LPA observed additional blue plastic chairs with metal legs that were not currently in use with cracked plastic. LPA noted sufficient toys and play materials in good condition. LPA observed crumbs on the floor throughout classroom #2. LPA reminded Licensee to sweep thoroughly to prevent pests.
Forms of discipline used at the facility is redirection and talking with the child.

LPA inspected the napping equipment and observed mats with ripped vinyl and exposed foam. LPA informed Licensee that the nap mats need to be replaced. Licensee agreed and stated they are usually replaced in June but the children have been picking at the tears so they need to be replaced sooner. Nap bedding is provided by families and is sent home weekly to be washed.

Facility has separate staff and child designated bathrooms. Children's toilets and faucets are in safe and sanitary operating condition. The children can reach their designated sinks, toilets, and supplies.

LPA observed the presence of a fully functional carbon monoxide detector, smoke detector/fire alarms, and a fully charged fire extinguisher that is accessible throughout the facility. All cleaning solutions/poisons are kept on high shelves in the classrooms, inaccessible to children in care. No poisons were observed to be accessible to children during the inspection. The center is equipped with a fully stocked first-aid kit that is available in the classrooms. The isolation area for when a child is sick is the classroom #2 or the office. Cleaning solutions/poisons are kept in cabinets with child locks.

The facility provides AM/PM snacks and lunch. The facility uses the same weekly menu. Licensee stated they write any changes on a chalkboard for families to view. All center provided food items are properly labeled & stored separately from cleaning supplies. LPA observed Licensee cutting an apple on the sink counter. LPA noted the presence of a cutting board within arm's reach. LPA observed Licensee to tear pizza slices with their hands to make them into smaller pieces to serve to children. LPA reminded Licensee to practice food service sanitation practices that protect food from contamination. Drinking water is accessible by children in the classrooms via water bottles. Additional water is provided by the facility via gallon jugs. LPA reminded Licensee to label children's water bottles with their name.

Facility roster and personnel report were not available for review. Licensee file was not available for review. LPA reviewed 8 random children files. 2 of 8 files were missing Personal Rights (LIC 613A) and TB clearance. 1 file was missing Consent for Emergency Medical Treatment (LIC 627). 1 file was missing Notification of Parents' Rights receipt (LIC 995). 3 of 8 files were missing admissions agreement. Child 3 had LIC 700 and LIC 802 in their file that was blank except for a guardian signature. 1 of 8 files had transcribed immunizations on the California Pre-Kindergarten and School Immunization Record (CDPH 286). LPA reminded to utilize the CDPH 286 for all children's immunizations. LPA reminded Licensee of the requirement to ensure a complete and current record for each child is maintained.

LPA observed most required postings in a publicly accessible area, with Notification of Parents' Rights was missing. LPA gave a copy of the posting to Licensee to utilize. LPA reviewed the sign in/out sheets and noted most families use the actual time and complete signature. LPA advised to remind families to use the actual time and complete signature for accuracy. Fire/disaster drills are recorded and performed at least every six months; the last drill was on 1/10/26.

Licensee was reminded that all adults 18 and over, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a Child Care Center. A civil penalty of $100.00 minimum/day for a maximum of 5 days or, if the penalty is for a repeat violation, for a maximum of 30 days per person will be assessed if this regulation is violated.

Assembly Bill (AB) 2370, Chapter 676, Statutes of 2018, requires all licensed Child Care Centers (CCCs) constructed before January 1, 2010, to test their water (used for drinking and food preparation) for lead contamination before January 1, 2023, and then every 5-years after the date of the first test as specified in Health and Safety Code section 1597.16.

For child care center licenses issued after July 1, 2022, the licensee shall test their water for lead within 180 days of licensure pursuant to Written Directives section 101700 (PIN 21-21.1-CCP.).
