32 | The allegation that staff hits child in care, has been found to be unsubstantiated. Per Licensee, when challenging behavior is displayed by children, they are redirected and given education on the topic. Per staff, when challenging behavior is displayed by children, staff will sit with child to calm them down, redirect the behavior and given education on the topic. Per parents, their children have not told them of being hit by an adult while in care. Per children, Josephine Luu, Licensee and Staff #1 have not hit them or their friends.
Based on LPA investigation, documents obtained, and statements obtained, it has been determined that the complaint alleging staff hits child in care is unsubstantiated. Although the allegation may have happened or is valid, there is not a preponderance of evidence to prove the alleged violation did or did not occur, therefore the allegation is unsubstantiated.
The Notice of Site Visit (LIC 9213) must remain posted for 30 days during the hours of operation after each site visit by a licensing representative. Failure to maintain posting as required will result in a civil penalty of $100.00.
Exit interview was conducted with Josephine Luu, Licensee, including, but not limited to Provider Rights, Appeal Procedures and Agencies Consultative Role.
