1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25	On 4/11/2023 Licensing Program Analyst (LPA) Judy Laureano conducted an unannounced Annual Required Inspection at The Toddler Garden located on 1249 26th Street, Santa Monica, CA 90404. LPA was greeted by Lynette Bravo, facility director. LPA toured the facility both indoors and outdoors and observed 21 children and 5 staff members providing care and supervision, including director. Facility operates Monday through Friday 8:30 am to 11:45 am with an extended day option that runs till 2:30 p.m. Facility has a maximum capacity of 31 preschool age children, ages 2 to 5 years old. There is no swimming pool or other bodies of water on the premises. There are no firearms or ammunition allowed or stored on the premises. Medications are made inaccessible and stored in the First Aid Kits located outside each classroom. Currently facility has one child that requires medication; Epi Pen. Facility is aware of all necessary paperwork that needs to be included with medication. LPA advised facility to include a copy of LIC form with medication for added precaution. Teachers do the day to day cleaning in the classrooms. Disinfectants, cleaning solutions and other hazardous items are made inaccessible in locked bottom sink cabinet and kitchen cabinet. Kitchen area was observed with a safety children's gate; making the area inaccessible to the children in care. The outdoor area was observed and inspected. Furniture and equipment are in good condition, free of sharp, loose or pointed parts. Playground equipment is in safe condition, free of sharp, loose or pointed parts. The surface of the outdoor activity space is maintained in a safe condition and is free of hazards. Sand box area is racked/cleaned monthly.

All toilets and handwashing facilities are in safe and sanitary operating condition. Floors in the facility are clean and safe. All kitchen, food preparation and storage areas are clean, free of litter/rubbish and free of rodents/vermin. Facility provides snacks and menus are posted on each classroom parent board and kitchen area. Parents also received a copy of the menu electronically, via email. All food is protected against contamination and any contaminated food is discarded immediately. Drinking water is available both indoors and outdoors via filter water pitcher.

All necessary forms associated with administering medication are kept in each children’s file. Each classroom was observed with an emergency bag pack that includes emergency contacts, children’s roster and any necessary forms.

Solid waste storage containers have tight-fitting covers and are in good repair. Areas around high climbing equipment and slides have cushioning material to absorb falls. The facility is free of flies, insects and rodents. Facility contracts with a Pest control vendor to ensure that facility stays pest free. LPA observed working fire extinguishers in the kitchen area and back classroom. LPA observed director test the carbon monoxide detector. Facility has a centralized fire alarm and sprinkler system throughout the facility.

Prior to working or volunteering in a licensed childcare facility, all individuals subject to a criminal record review have received a criminal record clearance or exemption. Upon notification from the Department, the licensee will comply and act immediately to terminate the employment of, remove from the facility or bar from entering the facility for any person it is deemed necessary while the Department considers granting or denying an exemption.

LPA reviewed 6 staff files and observed 5 out of 6 files missing proof of immunization. LPA issued a Technical violation. All staff has proof of current Mandated Reporter Training. At least one person trained in CPR and Pediatric First Aid is present when children are at the facility or at offsite activities.

LPA reviewed a sample of children’s files, 6 files, and observed files were complete. LPA provided facility with a copy of the LIC 311A and LIC 125 to use as a reference to ensure all files have current documents.
The name of the child care center director or fully-qualified teacher(s) designated to act in the director’s absence has been reported to the Department. Facility is currently using an electronic sign in and out system, Curraby. Each individual who is authorized to sign in/out, has an personalized PIN assigned, PIN is assigned to the individual and is not transferable. Hard copy is available for LPA’s review and if the electronic system is not currently working parents are able to sign in via the hard copy.The person who signs the child in/out of the facility shall use their full legal signature and record the time of day. All children are under supervision, including visual supervision, of a teacher at all times. Facility maintains a ratio of one teacher supervising no more than 12 children in care.

Facility representative, Lynette Bravo was reminded that all adults 18 and over, including employees and volunteers, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a Child Care Center. A civil penalty of $100.00 minimum/day up to $500.00 maximum per day/per person will be assessed if this regulation is violated.

Incidental Medical Services (IMS) currently IS being provided. Licensee is aware that an IMS plan is required to be submitted to the licensing office if they provide any of these services. Information regarding Americans with Disability Act (ADA) can be obtained by contacting US Department of Justice toll free ADA Information line at (800) 514-0301(voice), (800) 514-0383 (TDD) and website link https://www.ada.gov/childqanda.htm.

LPA and facility admin discussed the Community Care Licensing website www.ccld.ca.gov which will provide access to Provider Information Notices (PINs), Quarterly Updates, COVID-19 Information and Resources, Mandated Reporter Training, Safe Sleep in Child Care, Lead Poisoning Facts, Forms and Regulations.
A notice of site visit was given and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100. Exit interview conducted and report was reviewed with the licensee facility representative Lynette Bravo. Facility was provided with a copy of their appeal rights.
