On 10/21/2021 at 8:25 a.m. Licensing Program Analysts (LPAs) Deborah Lowe and Carolyn Tuba met with applicant Zahra Haddadi. The purpose of the visit was an announce pre-licensing inspection at the facility to ensure that health, safety and personal rights as requires by Title 22 and Health and Safety Regulations governing California Child Care Centers will be met. No children were present during this inspection. This is an application for 29 infants, ages 0 months to 24 months. The child care center will operate Monday – Friday 7:00 a.m. – 6:00 p.m.

Niaz Saee Haddadi and Mehry Ramzani were also present during visit.

The fire clearance was approved on 09/16/2021. Facility has a second level, per fire clearance No Children are Allowed Upstairs. There is an office, breakroom, and an adult bathroom located upstairs on the second level.

LPAs Lowe and Tuba toured and measured the on-limits areas and classrooms located at the facility. The facility has a total of 4 child care rooms. Children will have access to 2 sinks, 3 toilets and 1 changing table.

Classroom measurements are:

· Room #1 = (12.0 x 24.75) = 297.0 + (5.83 x 16.92) = 98.64 – (1.0 x 1.25) = 1.25, - (2.0 x .67) = 1.34, (1.33 x .92) = 1.22. Total measurement for room 1: 391.83

· Room #2 = (12.33 x 10.33) = 127.37, + (10.33 x 8.05) = 83.16 Total measurement for room 2: 210.53

· Room #3 = (10.67 x 25.17) = 268.56 – (0.58 x 1.42) = 0.82 Total measurement for room 3: 267.74

Total indoor activity space with rooms 1-3 calculated 391.83 + 210.53 + 267.74 = 870.1 divided by 35 sq feet = 24 Infants.

considering removing the cribs and using as an activity area to meet requested capacity. A second crib area was observed.

Total indoor activity space with rooms 1-4 calculated 391.83 + 210.53 + 267.74 + 153.30 = 1,023.4 divided by 35 sq feet = 29 Infants.

Outdoor Play measurements are:

Front outdoor area (18.0 x 28.75) = 499.50, + (17.0 x 18.58) = 315.86, + (8.05 x 3.42) = 27.53, (3.42 x 7.58) = 25.92, - (1.58 x 11.67) = 18.44, (5.0 x 3.0) = 15.0 Total measurement for front outdoor area 499.50 + 315.86 + 27.53 + 25.92 – 18.44 – 15.0 = 835.37 divided by 75 sq feet = 11 Infants

Backyard outdoor area (27.75 x 13.67) = 379.34 + (17.58 x 10.05) = 176.68 Total measurement for backyard outdoor area 379.34 + 176.68 = 556.02 divided by 75 sq feet = 7 Infants

Indoor/Children’s Area:

All outdoor and indoor passageways, stairways, inclines, ramps, open porches and other areas of potential hazard were observed to be free of obstruction. The child care center was observed be clean, safe, sanitary and in good repair at all times to ensure the safety and well-being of children, employees and visitors. Floors of all rooms have a surface that is safe and clean. A comfortable temperature for children was observed to be maintained.

The infant care center was observed to be equipped with appropriate furniture and equipment including, but not limited to, cribs, cots or mats; a changing table; and feeding chairs. Furniture was observed to be maintained in good repair and safe condition. The type, height and size of furniture and equipment was observed to be age appropriate. All play equipment and materials used by infants was observed to be age-appropriate. Toys shall be safe, and shall not have sharp points or edges or splinters, or be made of small parts that can be pulled off and swallowed. LPAs advised rattles shall be large enough so that they cannot become lodged in an infant's throat and constructed so that they will not separate into small pieces. LPAs advised swings, playpens and all such equipment and furniture shall be assembled or installed according to the manufacturer’s instructions, and shall be maintained in good repair and safe condition.

LPAs observed individual permanent space for child’s clothing, personal belongings and/or bedding. All materials and surfaces accessible to children, including toys, was observed to be free of toxic substances.

LPAs advised drinking water from a noncontaminating fixture or container shall be readily available both indoors and in the outdoor activity area. Applicant stated they will use a filtered water system for drinking water. Applicant stated they have a pet control service to take measures to keep the center free of flies, other insects, and rodents. All containers used for storage of solid wastes, including moveable bins, shall have a tightfitting cover that is kept on; shall be in good repair; and shall be leakproof and rodent-proof. No fireplaces or open-faced heaters were observed. LPAs advised all window screens shall be in good repair and free of insects, dirt and debris. Room 1 windows need screens, applicant stated they are being replaced.

Disinfectants, cleaning solutions, poisons and other items that could pose a danger if readily available to children were observed be stored where inaccessible to children. Storage areas for poisons was observed to be locked. As an added security applicant stated they will move cleaners to a cabinet outside of the child care area. LPAs advised the licensee shall maintain the following first-aid supplies in a location accessible to staff but inaccessible to children: a current edition of a first-aid manual, sterile first-aid dressings, bandages or roller bandages, adhesive tape, scissors, tweezers, thermometer, and antiseptic solution. First Aid supplies were observed to be incomplete.

LPAs advised a center shall be equipped to isolate and care for any child who becomes ill during the day. Any infant in the isolation area shall be under constant visual observation by a director, an assistant director, a teacher or an aid. The isolation area shall be equipped with a crib, cot, mat or playpen for each ill infant. LPAs advised the isolation area shall not be located in the kitchen area or the general-use toilet area. Facility currently does not have an designated isolation area.

LPAs observed 5 carbon monoxide detectors in the facility. Applicant tested carbon monoxide detector in room 3 and LPAs were able to hear a successful test. LPAs advised all child care centers shall have working telephone service on the premises. Applicant stated working land line in the upstairs office.

LPAs advised In addition to the sign-in procedure requirement of Section 101226.1(b), the licensee shall develop, maintain, and implement a written procedure to sign the child in/out of the child care center that shall, at a minimum, include the following: The licensee shall be responsible for ensuring that children with obvious symptoms of illness including, but not limited to, fever or vomiting, are not accepted. Applicant stated they will use an electronic sign in system through the Sandbox program and will complete wellness checks of children upon arrival to facility.

LPAs advised smoking is prohibited on the premises of a child care center as specified in Health and Safety

Code Section 1596.795(b). LPAs advised a baby walker shall not be allowed on the premises of a child care center in accordance with Health and Safety Code Sections 1596.846(b) and (c).

There shall be at least 35 square feet of indoor activity space per child based on the total licensed capacity.

There shall be a minimum of one hand washing sink to every 15 infants and one potty chair to every five infants being toilet trained.

Napping:

A standard size six-year crib or porta-crib meeting the following requirements shall be provided for each infant who is unable to climb out of a crib: Stacking wall cribs or cribs stacked one on top of another, often referred to as tiered cribs, shall not be permitted. LPAs observed 8 cribs in crib area near room 3, room 4 was observed with 5 cribs. Applicant stated Room 4 cribs may be removed and room changed to activity space.

Cribs shall not limit the ability of staff to see the infant.

Crib mattresses shall be: Maintained in a safe condition with no exposed foam, batting or coils.

Floor mats or cots that meet the requirements of Section 101239.1(b) shall be provided for all infants who have the ability to climb out of a crib.

Each crib, mat or cot shall be occupied by only one infant at a time.

Each infant's bedding shall be used for him/her only. Such bedding shall be replaced when wet or soiled, or when the crib, mat or cot is to be occupied by another infant.

LPAs advised cribs, mats or cots shall be arranged to provide a walkway between cribs, mats or cots to allow staff to reach each infant without having to step over or reach over any other infant.

The calculation of indoor activity space for infants shall not include space designated and used for cribs.

The sleeping area for infants shall be physically separate from the indoor activity space. Main crib area was observed with no separation from room 3. Applicant stated they have a plan to install a child gate to keep area separate.

The licensee shall provide a variety of age-appropriate equipment, toys and materials in good condition and in sufficient quantity to allow children present to fully participate in planned activities.

Restrooms:

All toilets, handwashing and bathing facilities were observed to be maintained in safe and sanitary operating condition. Additional equipment, aids and/or conveniences shall be provided as needed in centers that serve children with physical disabilities.

LPAs advised Hot water temperature controls shall be maintained to automatically regulate temperature of hot water delivered to plumbing fixtures used by children to attain a hot water temperature of not less than 105 degrees F (40.5 degrees C) and not more than 120 degrees F (48.8 degrees C).Notwithstanding (e) and (e)(1) above, handwashing fixtures shall not be required to deliver hot water.

Common towels or washcloths are prohibited.

Infant Changing Tables:

LPAs observed changing table to have a padded surface no less than one-inch thick and be covered with washable vinyl or plastic. Have raised sides at least three inches high. Be maintained in good repair and safe condition. While in use, be placed within arm’s reach of a sink. Changing table was observed in the child’s bathroom.

Outdoor:

LPAs advised outdoor area shall provide a shaded rest area for the children. LPAs advised outdoor area shall be free of hazards including, but not limited to, holes, broken glass and other debris, and dry grasses that pose a fire hazard. As a condition of licensure, the areas around and under high climbing equipment, swings, slides and other similar equipment shall be cushioned with material that absorbs falls. Backyard outdoor area has debris, fence panels, and a ceiling fan that need to be removed.

LPAs observed the playground to be enclosed by a fence to protect children and to keep them in the outdoor activity area. LPAs advised the fence shall be at least four feet high. The front yard fence with access to main street was observed with a fence of 3.2 feet high with shrubs along the fence taller than 5 feet in height.

LPAs advised any construction or equipment that could pose a hazard in the outdoor activity area shall be made inaccessible to children in care. This shall include, but not be limited to, incinerators, air- conditioning

equipment, water heaters, and fuse boxes. Front yard area has area near hose that will need to be made inaccessible to children.

No pools or bodies of water was observed at facility.

There shall be at least 75 square feet per child of outdoor activity space based on the total licensed capacity.

Health Related Services:

Medications shall be kept in a safe place inaccessible to children. A refrigerator shall be used to store any medication that requires refrigeration. Applicant stated only prescription medication will be allowed.

LPAs advised the licensee shall develop and implement a written plan to record the administration of prescription and nonprescription medications and to inform the child's authorized representative daily when such medications have been given.

Food Service:

LPAs advised all food shall be safe and of the quality and in the quantity necessary to meet the needs of the children. Each meal shall include, at a minimum, the amount of food components as specified by Title 7, Code of Federal Regulations, Part 226.20, (Revised January 1, 1990) Requirements for Meals, for the age group served. All food shall be selected, stored, prepared and served in a safe and healthful manner.

LPAs advised All foods or beverages capable of supporting the rapid and progressive growth of microorganisms that can cause food infections or food intoxications shall be stored in covered containers at 45 degrees F (7.2 degrees C) or less.

LPAs advised prior to the infant's first day at the center, the infant care center director or assistant director shall complete a needs and services plan for the infant. High chairs or other appropriate seating equipment shall be used to seat infants during feeding.

Infants who are unable to sit unassisted in a high chair or other seating equipment shall be held by a staff person or other adult for feeding. LPAs advised bottles, dishes and containers of food brought by the infant’s authorized representative shall be labeled with the infant’s name and the current date.

LPAs advised the infant care center shall not serve honey or corn syrup to any infant.

Applicant stated facility will not provide any foods, all foods will be provided by the family.

LPAs advised pesticides and other similar toxic substances shall not be stored in food storerooms, kitchen areas, food-preparation areas, or areas where kitchen equipment or utensils are stored.

Soaps, detergents, cleaning compounds or similar substances shall be stored in areas separate from food supplies.

Facility does not have a kitchen but has a refrigerator and counter top with sink located in room 2.

The food-preparation area shall not be used for: Children's play activities, unless such activities are part of a supervised food-education program. Full-day programs shall offer a midmorning and a midafternoon snack.

Full-day programs shall ensure that each child has a lunch. Half-day programs shall offer a midmorning or midafternoon snack.

Postings:

LPAs did not observe the postings within the facility. LPAs advised the following: the license shall be posted in a prominent, publicly accessible location in the center along with copy of the LIC 613A (9/96), the PUB 393 (8/02), Child Care Center Notification of Parents' Rights Poster, post signs at the entrance to the child care center that provide the telephone number of the local health department and information on child passenger restraint systems pursuant to Health and Safety Code section 1596.95(g) and Vehicle Code sections 27360 and 27360.5 FORM: LIC 610.

LPAs advised each licensee shall have a disaster and mass casualty plan of action. The plan shall be in writing and shall be readily available. Contingency plans for action during fires, floods and earthquakes including, but not limited to, the following: FORM: LIC 9148

Applicant stated facility will not provide the food, all food including snacks will be provided by the parents. LPAs advised menus shall be in writing and shall be posted at least one week in advance in an area accessible for review by the child's authorized representative. Copies of the menus as served shall be dated and kept on file for at least 30 days. Menus shall be made available for review by the child's authorized representative and the Department upon request.

The following was discussed:

Criminal Record Statement

Applicant was reminded that all adults 18 and over, including employees and volunteers, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a Child Care Center. A civil penalty of $100.00 minimum/day up to $500.00 maximum per day/per person will be assessed if this regulation is violated.

Incidental Medical Services (IMS) policy was discussed.



Regulation and Procedures for Child Care Centers Sections 101173 and 101226. When any IMS is provided, an updated Plan of Operation that includes IMS must be submitted to the Department. Safe Sleep

LPA discussed the safe sleep regulations with applicant and discussed the Child Care Licensing Safe Sleep webpage at https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-and-resources/safe-sleep as an additional resource. LPA also informed applicant of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment.

Mandated Reporter: Beginning on January 1, 2018, AB 1207, requires all licensed providers, applicants, directors and employees to complete training as specified on their mandated reporter duties and to renew their training every two years. Volunteers are encouraged but not required to take the training.

Senate Bill (SB) 792: This bill, commencing September 1, 2016, prohibits a person from being employed or volunteering at a child care facility or family day care if he or she has not been immunized against influenza, pertussis and measles.

Senate Bill (SB) 277 New Immunization Requirement: Beginning January 1, 2016, personal beliefs exemptions will no longer be an option for the vaccines that are currently required for entry into child care or school in California. Personal beliefs exemptions already on file will remain valid until the child reaches the next immunization checkpoint.

The following corrections are needed before a license will be considered:
· Front windows – applicant stated window screens being replaced
· Designate isolation area separate from child care areas
· Walk though gates between play areas (3 in total) are in need of repair
· Air vent in room 4 located in the ceiling needs to be secure
· Crib area near room 3 needs to be separate from activity area
· Outdoor backyard area repair gate panels, remove debris, and ceiling fan
· Outdoor front play yard secure entrance gate
· Outdoor front play yard Gate surrounding outdoor area measures 3.2 feet – must be 4 feet or higher
· Outdoor front play yard wires near hose area make inaccessible to children
· Replace first aid kit
· Display required postings
· Outdoor waiver request, include room schedules, outdoor schedule with 15 min delay between each group.


An exit interview was conducted with the above items discussed and a copy of this report was provided to the Applicant Zahra Haddadi and Niaz Saee Haddadi. Final license determination will be made upon review by the Licensing Program Manager and correction of the above issues. Applicant to correct items by 11/05/2021.
