On 12/12/2025 Licensing Program Analysts (LPA) Cristina Castellanos and Judy Laureano conducted an unannounced case management inspection for the purpose of ensuring the standards are being met in accordance with California Tittle 22 Regulations and California Health and Safety Codes.

During today’s inspection, nine (9) children and two (2) adult staff members were present in Classroom 2. Per the facility’s license, the toddler program serves children ages 18 months to 24 months. Furthermore, LPAs Castellanos and Laureano observed one toddler (C2) 18 months of age consistently commingling with eight preschool-aged children throughout the day. The oldest preschool-aged child present during today’s inspection was five and a half years old. The commingling occurred during multiple routine activities, including arrival, outdoor play time, and nap time. Upon arrival Room 1 (Toddler Classroom) was not being used for C2.

LPA Castellanos informed licensee Rivera and staff members on 11/07/2025, 11/10/2025, 12/02/2025 and during today’s inspection that in accordance with Title 22, Regulation 101216.4(a)(2), “The toddler program shall be conducted in areas physically separate from those used by older or younger children.” The observed commingling during today’s inspection is not in compliance with this regulation. Type A violation

During today’s inspection based on LPA’s observations and interviews with relevant staff, it was confirmed that the facility does not have a designated Director as of September 2025. This status places the facility out of compliance with Title 22, Section 101215.1(b), which requires each licensed child care center to have a qualified and designated Director responsible for the operation of the facility. Additionally, on 11/07/2025 and 11/10/2025 the facility was cited for section 101215.1(b). Staff member 2 (S2) confirmed to LPAs that she will be taking on the role of director. Per record review the director’s qualifications for S2 were not available for review. Type A violation

FACILITY EVALUATION REPORT California law requires a public report of each licensing visit/inspection. This report is a record for the facility and the licensing agency. This report is available for public review; therefore, care is taken not to disclose personal or confidential information. Inquiries concerning the location, maintenance, and contents of these reports may be directed to the Licensing Program Analyst or Regional Office whose address and telephone number are listed on the front of this form.

DEFICIENCIES A deficiency is an instance of noncompliance with licensing requirements, including applicable statutes, regulations, interim licensing standards, operating standards, and written directives. Applicants/ licensees must be notified in writing of all licensing deficiencies. Deficiencies are listed on the left side of this form, and the applicable licensing requirement upon which the deficiency is identified. There are two types of deficiencies:
  • Type A deficiencies are violations of licensing requirements that, if not corrected, have a direct and immediate risk to the health, safety, or personal rights of persons in care.
  • Type B deficiencies are violations of licensing requirements that, without correction, could become a risk to the health, safety, or personal rights of persons in care, a recordkeeping violation that could impact the care of said persons and/or protection of their resources, or a violation that could impact those services required to meet the needs of persons in care.

PLANS OF CORRECTION (POCs) The licensing agency is required to establish a reasonable length of time to correct a deficiency. In order to set the time, the licensing agency must take into consideration the seriousness of the violation, the number of persons in care involved, and the availability of equipment and personnel necessary to correct the violation. Applicants/licensees are requested to provide a specific plan for each violation on the right side of the form across from each deficiency. The more specific the plan, the less chance exists for any misunderstanding in setting time limits and reviewing corrections. The applicant/licensee who encounters problems beyond their control in completing the corrections within the specified time frame may request and may be granted an extension of the correction due date by the licensing agency.

CORRECTION NOTIFICATION The applicant/licensee is responsible for completing all corrections and promptly notifying the licensing agency of corrections. Applicants/licensees are advised to keep a dated copy of any correspondence sent to the licensing agency concerning corrections, or if corrections are telephoned to the licensing agency, the date, person contacted, and information given.

CIVIL PENALTIES The licensing agency is required by law to issue a Penalty Notice, when applicable, to all facilities holding a license issued by the licensing agency, or subject to licensure, except Certified Family Homes, Resource Families, and Foster Family Homes, or any governmental entity.

PENALTY NOTICE GIVEN The statement concerning civil penalties serves as a penalty notice on this Licensing Report and failure to correct cited licensing deficiencies will result in civil penalties. Applicants/ licensees are required to pay civil penalties when administrative appeals have been exhausted and in accordance with any payment arrangements made with the licensing agency.

APPEAL RIGHTS The applicant/licensee has a right without prejudice to discuss any disagreement in this report with the licensing agency concerning the proper application of licensing requirements. The applicant/ licensee may request a formal review by the licensing agency to amend or dismiss the notice of deficiency and/ or civil penalty. Requests for review shall be made in writing within 15 business days of receipt of a deficiency notification or civil penalty assessment. Licensing deficiencies may be appealed pursuant to the procedures in the LIC 9058 Applicant/Licensee Rights.

AGENCY REVIEW The licensing agency review of an appeal may be conducted based upon information provided in writing by the applicant/licensee. The applicant/licensee may request an office meeting to provide additional information. The applicant/licensee will be notified in writing of the results of the agency review within 60 business days of the date when all necessary information has been provided to the licensing agency.

EMAIL REQUIREMENT Adult Community Care Facilities, Residential Care Facilities for the Chronically Ill, and Residential Care Facilities for the Elderly are required to provide and maintain an active email address of record with the licensing agency.

LPAs confirmed through staff interview and observation that the telephone number on file belongs to owner Cherelle Rivera, who was not present during today’s inspection. Facility is not in compliance with section 101224(a) All child care centers shall have working telephone service on the premises. Type B Violation

At 11:33am LPAs observed C2 running out the facility’s gate to the sidewalk without proper supervision. Shortly after within a minute LPAs observed C2 walked back inside without any proper supervision. Facility is not in compliance with section 101229(a)(1) Responsibility for Providing Care and Supervision (a)The licensee shall provide care...(1) No children shall be left without the supervision of a teacher at any time...Supervision shall include visual observation. Type A violation

Based on observations, record review, and staff interviews conducted during today’s inspection, it was determined that the licensee failed to correct previously cited violations within the time specified by the Department. As a result of this continued noncompliance, civil penalties have been assessed.

Per Title 22, Division 12, Chapter 1, of the California Code of Regulations, there were four (4) deficiencies cited at this time for violation of Title 22 regulation; (see LIC809-D)

Upon receipt of this report, S1 shall post the Notice of Site Visit and any Licensing report documenting a Type “A” deficiency. The report and the Notice of Site Visit shall be posted for 30 consecutive days. Failure to maintain posting as required will result in an immediate $100 civil penalty. A copy of this report shall be provided to the parent/guardian of children currently enrolled by the next business day or immediately upon return. A copy of this report shall also be provided to the parent/guardian of any newly enrolled children for the next 12 months (1 year). The Acknowledgment of Receipt (LIC9224) form must be maintained in each child’s file immediately upon receipt from parent. S1 was provided with a copy of the Acknowledgement of Receipt of Licensing Reports (LIC 9224) Form during this visit.

An exit interview was conducted, and Plan of Correction was reviewed and developed with S1. A copy of this report and appeal rights were discussed and left with S1, whose signature on this form confirms receipt of these documents.
