32 | At approximately 11:00 AM, while staff members were preparing to distribute meals, Child 6 (C6) struck Child 4 (C4), resulting in C4 crying due to the impact. Although staff were present in the area, they were not visually observing or actively supervising the children at the time of the incident.
At approximately 11:41 AM during nap time, both Staff Member 1 (S1) and Staff Member 2 (S2) were observed using their personal phones. Neither staff member was visually monitoring the children, and both remained engaged with their phones throughout the observation.
As a result, LPA Castellanos issued findings related to the complaint investigation.
Based on LPA’s direct observations of today’s inspection it was found that there is Lack of staff supervision that resulted in a child hitting another child in care, the preponderance of evidence standard has been met, therefore the above allegation is found to be SUBSTANTIATED.
