13 | On 05/22/2023 @ 12:15 PM, Licensing Program Analyst (LPA), Miriam Cohen met with the licensee, Lihi Tamam, for the purpose of delivering the findings concerning the above allegations. LPA observed licensee and one assistant providing care for 11 children. Based upon the following observations below, facts revealed that, there is not a preponderance of the evidence to support that the licensee committed the allegations mentioned above:
A. Visual observations by LPA during initial visit on 03/27/2023 and delivery of finding visit today, 05/22/2023 – the facility is operating within capacity, the licensee is present in the facility, and the children are having lunch (homecooked meals with plenty of left over in the pot on the stove) with second helping/serving available upon request.
B. Interview with six parents of children currently enrolled revealed licensee conducts daycare in a professional manner; no evidence of the following - child sustained unexplained injuries while in care, day care child was handled in a rough manner, facility is operating over capacity, licensee is not meeting her 80% at the facility, not providing adequate food service to day care children, and not allowing parents into the facility.
Therefore, the following conclusion has been determined concerning the above allegation: Unsubstantiated - A finding that the complaint is unsubstantiated means that although the allegations may have happened or are valid, there is not a preponderance of the evidence to prove that the alleged violations occurred.
The investigation regarding the above allegations has been completed. No deficiencies will be issued.
An exit interview was conducted, and the above items discussed with licensee. A copy of this report was provided.
