On 7/27/2022 at 8:05 a.m. Licensing Program Analyst (LPA) Deborah Lowe met with applicant, Marilyn McKoy. The purpose of the visit was an announce pre-licensing inspection at the facility to ensure that health, safety and personal rights as requires by Title 22 and Health and Safety Regulations governing California Child Care Centers will be met. There were no children present during this inspection. This is an application for 16 children, ages 18 months to 5 ½ years old. The child care center will operate Monday – Friday 6:00 a.m. – 7:00 p.m and Saturday 8:00 am – 2:00 pm. The fire clearance was approved on 7/08/2022.

LPA Lowe toured and measured the on-limits areas and classrooms located at the facility. The facility has a total of 3 classrooms. Children will have access to 1 sink and 1 toilet.

Classroom measurements are:

Indoor total measurements of rooms 1, 2, and 3: 530.77 square (sq) feet (ft) divided by 35 sq ft = 15 children

Room 3 will be used as the Toddler Option room.

Outdoor Play measurements are:

Outdoor total measurements: 628.11 sq ft divided by 75 sq ft = 8 children.

LPA advised there shall be at least 75 square feet per child of outdoor activity space based on the total licensed capacity. Applicant stated they would like to apply for an outdoor waiver.

hazard were observed to be free of obstruction. The child care center was observed to be clean, safe, sanitary and in good repair. Tile floors of all rooms have a surface that is safe and clean. LPA Lowe observed 3 area rugs in the classrooms clean and in good condition placed on tile floor and observed to be movable. In room 1 LPA observed the area rug to be larger than the area placed in causing the ends to roll upward, possible trip hazard. LPA advised per Regulation 101238(b)(1) Protective devices including but not limited to nonslip material on rugs.

Per applicant facility has central heating and air to ensure a comfortable temperature for children is maintained at all times. Furniture and equipment were observed to be maintained in good condition, free of sharp, loose or pointed parts. Tables and chairs were observed to be meet the needs of the children. All play equipment and materials used by children were observed to be age-appropriate. LPA observed individual portable storage space for children’s clothing, personal belongings and/or bedding. All materials and surfaces accessible to children, including toys, were observed to be free of toxic substances.

Drinking water from a water cooler system was observed to be readily available both indoors and in the outdoor activity area. Water cooler system was observed with a safety switch in the back of cooler to turn off the hot water tab. LPA advised the licensee shall take measures to keep the center free of flies, other insects, and rodents. All trash cans were observed to have tightfitting covers and in good repair. No Fireplaces or open-faced heaters were observed at facility. All window screens in the classrooms were observed to be in good repair and free of insects, dirt and debris. LPA observed window screen in kitchen was observed in need of repair and children’s bathroom window screen is in need of installation. LPA Lowe observed screen leaning up against window frame. LPA Lowe advised per CCR 101239(b) All window screens shall be in good repair and free of insects, dirt and debris.

Carbon monoxide detector was observed in the kitchen, LPA Lowe heard a successful test.

Disinfectants, cleaning solutions, poisons and other items that could pose a danger if readily available to children were observed to be stored where inaccessible to children. Cabinet storage was observed with child safety latches. LPA advised storage areas for poisons shall be locked. LPA observed a current edition of a first-aid manual, sterile first-aid dressings, bandages or roller bandages, adhesive tape, scissors, tweezers, thermometer, and antiseptic solution.

Per applicant isolation area for any child who becomes ill during the day will be located in the director office.

LPA advised the isolation area shall be located to afford easy supervision of children by center staff. The isolation area shall be equipped with a mat, cot, couch or bed for each ill child. The isolation area shall not be located in the kitchen area or the general-use toilet area.

LPA advised all child care centers shall have working telephone service on the premises. Applicant stated they have a phone service but the phone has not been installed.

LPA observed a plan for children to be signed in / out with a place for parent/ guardian full signature. Applicant stated staff will conduct a wellness check of children during drop off. LPA advised smoking is prohibited on the premises of a child care center as specified in Health and Safety Code Section 1596.795(b). LPA advised a baby walker shall not be allowed on the premises of a child care center in accordance with Health and Safety Code Sections 1596.846(b) and (c).

LPA advised there shall be at least 35 square feet of indoor activity space per child based on the total licensed capacity. Based on the total licensed capacity, one toilet and one handwashing fixture shall be maintained for every 15 children, or fraction thereof.

Napping:

Facility has a combination of mats and cots for nap time. Cots used for napping were observed to be maintained in a safe condition. Mats observed to be constructed of foam at least 3/4 inch thick. Covered with vinyl or similar material that can be wiped. Marked or colored so that the sleeping side can be distinguished from the floor side. LPA advised wiped with a detergent/disinfectant weekly or when soiled or wet. LPA observed the mats to be maintained in a safe condition with no exposed foam. LPA advised each cot or mat shall be equipped with a sheet to cover the cot or mat and, depending on the weather, a sheet and/or blanket to cover the child. Applicant stated facility will provide sheets for bedding. Children will bring blanket from home.

LPA Lowe observed a variety of age-appropriate equipment, toys and materials in good condition and in sufficient quantity to allow children present to fully participate in planned activities.

Restrooms:

Children’s bathroom was observed with one toilet, two potty training chairs, one sink, and one bathtub with sliding door enclosure. Changing area was observed just outside the bathroom door with use of a wall mounted changing station that pulls down from wall. All toilets, handwashing and bathing facilities were

observed to be maintained in safe and sanitary operating condition. Facility was observed with step stools for children who need to use. LPA advised additional equipment, aids and/or conveniences shall be provided as needed in centers that serve children with physical disabilities.

LPA advised hot water temperature controls shall be maintained to automatically regulate temperature of hot water delivered to plumbing fixtures used by children to attain a hot water temperature of not less than 105 degrees F (40.5 degrees C) and not more than 120 degrees F (48.8 degrees C). Notwithstanding (e) and (e)(1) above, handwashing fixtures shall not be required to deliver hot water.

LPA advised there shall be one toilet and one handwashing fixture, separate from and in addition to the number of toilets and handwashing fixtures required in (h) above, designated for use by children who are ill, for use by staff, and for emergency use. This toilet and handwashing fixture shall be conveniently located in relation to the isolation area. Per the applicant the staff bathroom will be used for a child who is in isolation area. Facility has one staff bathroom located in the north east corner of room 2 near emergency exit door.

LPA advised common towels or washcloths are prohibited.

Outdoor:

LPA Lowe observed a shaded rest area for the children. Free of hazards including, but not limited to, holes, broken glass and other debris, and dry grasses that pose a fire hazard. LPA advised as a condition of licensure, the areas around and under high climbing equipment, swings, slides and other similar equipment shall be cushioned with material that absorbs falls. High climbing equipment was not observed during visit. LPA observed two little tykes movable slides that will need material that absorbs falls to be placed under them.

LPA advised sandboxes shall be inspected daily and kept free of hazardous foreign materials. LPA observed brown tarp placed over sandbox applicant stated will be used when not in use to assist in keeping the area clean.

LPA observed a metal meter box located in the sandbox area accessible to children. LPA Lowe advised meter box will need to be made inaccessible to children.

The playground was observed to be enclosed by a fence to protect children and to keep them in the outdoor activity area. The fence was observed to be at least four feet high.

LPA advised any construction or equipment that could pose a hazard in the outdoor activity area shall be made inaccessible to children in care. This shall include, but not be limited to, incinerators, air- conditioning equipment, water heaters, and fuse boxes.

No pools or other bodies of water were observed at facility.

Health Related Services:

Facility was observed with a cabinet designed for medication located in the kitchen inaccessible to children. A refrigerator was observed to be available to store any medication that requires refrigeration.

LPA advised the licensee shall develop and implement a written plan to record the administration of prescription and nonprescription medications and to inform the child's authorized representative daily when such medications have been given. LPA advised applicant about LIC 9221 Parent Consent for Administration of Medication and Medication Chart can be used to inform the child's authorized representative daily when such medications have been given. LPA Lowe provided a printed copy of LIC9221 to applicant.

Food Service:

Facility was observed with a kitchen with access from room 2. Entrance area was observed with a gate to ensure kitchen is inaccessible to children.

LPA advised all food shall be safe and of the quality and in the quantity necessary to meet the needs of the children. Each meal shall include, at a minimum, the amount of food components as specified by Title 7, Code of Federal Regulations, Part 226.20, (Revised January 1, 1990) Requirements for Meals, for the age group served. All food shall be selected, stored, prepared and served in a safe and healthful manner.

LPA advised all foods or beverages capable of supporting the rapid and progressive growth of microorganisms that can cause food infections or food intoxications shall be stored in covered containers at 45 degrees F (7.2 degrees C) or less.

LPA advised pesticides and other similar toxic substances shall not be stored in food storerooms, kitchen areas, food-preparation areas, or areas where kitchen equipment or utensils are stored. LPA did not observed any pesticides or similar toxic substance during visit.

Soaps, detergents, cleaning compounds or similar substances were observed to be stored in areas separate from food supplies located under the kitchen sink in a cabinet with child proof latches.

LPA advised all kitchen, food-preparation and storage areas shall be kept clean and free of litter and rubbish; and measures shall be taken to keep all such areas free of rodents and other vermin.

LPA advised the food-preparation area shall not be used for: Children's play activities, unless such activities are part of a supervised food-education program. Full-day programs shall offer a midmorning and a midafternoon snack.

LPA advised full-day programs shall ensure that each child has a lunch. Half-day programs shall offer a midmorning or midafternoon snack. Applicant stated children will bring lunch from home and facility will provide morning and afternoon snack.

Postings:

LPA Lowe observed the following postings located in room 3: LIC 613A (9/96), the PUB 393 (8/02), Child Care Center Notification of Parents' Rights Poster, LIC 610 Emergency Disaster Plan with the telephone number of the local health department, information on child passenger restraint systems, and a contingency plan for action during fires, floods and earthquakes. LPA observed a disaster drill log posted with required postings.

LPA observed menus to be in writing and posted to be review by the child's authorized representative. LPA advised copies of the menus as served shall be dated and kept on file for at least 30 days. Menus shall be made available for review by the child's authorized representative and the Department upon request.

Applicant is preparing a disaster and mass casualty plan of action in writing and stated they will send to LPA Lowe once completed.

LPA advised the applicant shall reveal each child care center license number in all advertisements in accordance with Health and Safety Code Section 1596.861.

Transportation: Per applicant no transportation will be provided.

Applicant was reminded that all adults 18 and over responsible for administration or direct supervision of staff, persons who provides care and supervision to children, and staff who have contact with children, including employees and volunteers, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a Child Care Center. A civil penalty of $100.00 minimum/day up to $500.00 maximum per day/per person will be assessed if this regulation is violated.

LPA discussed the safe sleep regulations with applicant and discussed the Child Care Licensing Safe Sleep webpage at https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-and-resources/safe-sleep as an additional resource. LPA also informed applicant of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment.

The following corrections are needed before a licensure will be considered. Corrections are due by 8/10/2022:
  1. Outdoor Waiver – prepare written waiver request with classroom schedules and outdoor schedules. Include the 15 minutes of transition time between groups.
  2. Area rugs need protective device including but not limited to nonslip material on rugs.
  3. Room 1 carpet does no fit the space in, causing the ends to roll upward – move or replace area rug to fit in area so edges do not roll up.
  4. Plug covers in all unused outlets.
  5. Window screen in kitchen is in need of repair and children’s bathroom window screen is in need of installation.
  6. Provide a Disaster and Mass Casualty Plan in writing
  7. Verify telephone service at facility
  8. Outdoor area provide material to absorb falls for the slides in the outdoor area
  9. Metal meter box located in outdoor sandbox make inaccessible to children.
  10. Completion of pending application documents

An exit interview was conducted with the above items discussed and a copy of this report was provided to the Applicant, Marilyn McKoy. Final license determination will be made upon review by the Licensing Program Manager and correction of the above issues.
