On 06/13/2023, Licensing Program Analyst (LPA) Adrian Risher, conducted a complaint subsequent visit regarding the above-mentioned allegatiosn to deliver the findings. Upon arrival, LPA met with Gabby Romero, Director. LPA explained the purpose of the inspection. LPA observed 26 infants with 9 staff.

On 04/18/2023, ESRO received a complaint regarding facility operating out of ratio, facility is unkempt and facility classroom is dirty. Information was reported that the staff have been out of ratio for over a month. The classrooms are dirty and unkempt.

On 4/24/2023, LPA Risher conducted the initial complaint visit. During the visit, LPA observed 22 infants and toddlers with 6 staff. LPA Risher interviewed the Director and Staff 1-3. LPA received copies of facility roster, personnel report, and face to name transition sheet for April 2023 for each classroom. The classrooms were clean and well-kept. LPA observed toys on the floor throughout the classrooms while the infants were playing. The toddler classroom was clean and orderly.

There is one infant teacher who arrives before 8am. The next teacher starts at 8:30am and 9am. Director stated most staff arrive 8am. There are 3 teachers assigned to the infant classroom. There are 2 teachers assigned to the toddler classroom. Director stated she is hiring more staff. Director will step into the classroom if they are short staffed. On 06/13/2023, LPA observed a total of 9 staff present in the infant and toddler classrooms. Director stated she has hired 5 additional staff in total.

Staff stated they have a cleaning schedule. Staff use disinfectant wipes and wipe down everything. Staff clean as they go throughout the day. Parents stated the classrooms appear clean when they drop off and pick up their child.

Although the allegations may have happened or is valid, there is not a preponderance of evidence to prove the above alleged violations did or did not occur, therefore the allegations of Ratio and Personal Rights are found to be unsubstantiated. Staff maintain ratio through out the day. Director has a plan in place to ensure that ratio is maintained. Director has hired additional staff for each classroom. The facility has a cleaning routine to make sure the classrooms are clean and well-kept. Based on interviews and observations, no evidence has shown that the facility is operating out of ratio, dirty or unkempt.

Exit interview was conducted and a copy of the report was provided. Appeal rights were reviewed and provided.
