32 | At approximately 10:00am LPA Castellanos observed six (6) infants and two (2) adult staff members in the infant outdoor play area. LPA Castellanos began to inspect the infant toys located outside in the designated infant outdoor play area. LPA observed the soft blocks to not be clean, when touched dirt residue was transferred to LPA hands and a sticky substance on surface. Furthermore, LPA Castellanos observed the plastic toy container holding the soft blocks to be broken, the toy container is not maintained in good repair and safe condition.
The facility did not comply with the following regulations:
101439.1(f)(3) - Infant Care Center Sleeping Equipment
101439(k)(5) - Infant Care Center Fixtures, Furniture, Equipment and Supplies
101438.1(d) - Infant Care General Sanitation
Based on information obtained and observation, it was found that staff are not providing a safe environment for sleeping infants, facility equipment pose a hazard to daycare children, and facility toys are not clean, the preponderance of evidence standard has been met, therefore the above allegations are found to be SUBSTANTIATED.
There were three (3) deficiencies cited during today’s visit in accordance with the California Code of Regulations, Title 22, Division 12, and Chapter 1. See LIC 9099-D for additional information, one (1) Type B and two (2) Type A.
Upon receipt of this report, the Licensee shall post the Notice of Site Visit and any Licensing report documenting a Type “A” deficiency. The report and the Notice of Site Visit shall be posted for 30 consecutive days. Failure to maintain posting as required, will result in an immediate $100 civil penalty. A copy of this report shall be provided to the parent/guardian of children currently enrolled by the next business day or immediately upon return. A copy of this report shall also be provided to the parent/guardian of any newly enrolled children for the next 12 months (1 year). The Acknowledgment of Receipt (LIC9224) form must be maintained in each child’s file immediately upon receipt from parent. Licensee was provided with a copy of the Acknowledgement of Receipt of Licensing Reports (LIC 9224) Form during this visit.
