On 10/04/2023 Licensing Program Analyst (LPA) Laticia Thompson and Jillinda Chandler met with Applicant, Omar Magee and Director, Darrell Pork. The purpose of the visit was an announced pre-licensing inspection at the facility to ensure that health, safety and personal rights as required by Title 22 and Health and Safety Regulations governing California Child Care Centers will be met. There were no children present during this inspection. This is an application for 35 children, ages 2 years to 5 years old. The child care center will operate Monday – Saturday 6:00 a.m. – 6:00 p.m. The fire clearance was approved on 05/31/2023. Applicant has a pending application for an Infant License #197495287.

LPA Laticia Thompson and Jillinda Chandler toured and measured the on-limits areas and classrooms located at the facility. The facility has a total of 3 classrooms. Classroom number 1 and 3 are dedicated to the preschool program and classroom 2 is dedicated to the infant program. Children will have access to 2 sinks and 2 toilets.

Classroom measurements are:

The Indoor total measurements contain a total of 1072 square feet, which will accommodate Applicant’s request for 35 preschool children.

Outdoor Play measurements are:

Outdoor total measurements contain a total of 2,380.20 square feet, which will accommodate Applicant’s request for 31 preschool children.

Indoor/Children’s Area:

All outdoor and indoor passageways, stairways, inclines, ramps, open porches and other areas of potential hazard were observed to be free of obstruction. The child care center was observed to be clean, safe, sanitary and in good repair for the safety and well-being of children, employees and visitors. The floors of all rooms have a surface that is safe and clean. There are 3 air-condition units and central heating that will provide a comfortable temperature for children at all times. The Furniture and equipment were observed to be maintained in good condition, free of sharp, loose or pointed parts. Tables and chairs were observed to meet the needs of the children. All play equipment and materials used by children were observed to be age-appropriate. The facility has cubbies for each child to use as storage space for his/her clothing, personal belongings and/or bedding. All materials and surfaces accessible to children, including toys, are free of toxic substances.

The facility will provide bottled drinking water that will be readily available both indoors and in the outdoor activity area. LPA advised per Health and Safety Code 1597.16(a)(1) Lead Testing and PIN-21-21-CCP Assembly Bill (AB) 2370, Chapter 676, Statutes of 2018, requires all licensed Child Care Centers (CCCs) constructed before January 1, 2010 to test their drinking water for lead contamination between January 1, 2020 and January 1, 2023, and then every 5 years after the date of the first test. Initial testing results shall be posted within 180 days of licensure. The director stated facility water was tested for lead contamination and results were delivered to the regional office.

The facility was observed to be free of flies, other insects, and rodents. Applicant will purchase storage bins with tight fitting cover lids that are leakproof and rodent-proof. There are no fireplaces and open-faced heaters in the facility. All window screens are in good repair and free of insects, dirt and debris.

The facility will store all disinfectants, cleaning solutions, and poisons in the cabinet area located in the staff kitchen. The cabinet has a padded lock to prevent access. There is a first aid kit on the wall located in classroom #1. LPA observed a current edition of a first-aid manual, sterile first-aid dressings, bandages or roller bandages, adhesive tape, scissors, tweezers, thermometer, and antiseptic solution.

The office will be used as an isolation area to care for any child who becomes ill during the day. LPA advised applicant that the isolation area shall be located to afford easy supervision of children by center staff. The isolation area shall be equipped with a mat, cot, couch or bed for each ill child. The isolation area shall not be located in the kitchen area or the general-use toilet area. The applicant shall be responsible for ensuring that children with obvious symptoms of illness including, but not limited to, fever or vomiting, are not accepted.

The facility has multiple carbon monoxide detectors that are in operable condition. The child care centers has a land line telephone service on the premises.

The sign-in and out sheets will be located at the entrance of the facility. LPA advised applicant that the applicant shall develop, maintain, and implement a written procedure to sign the child in/out of the child care center.

LPA advised applicant that smoking is prohibited on the premises of a child care center as specified in Health and Safety Code Section 1596.795(b). A baby walker shall not be allowed on the premises of a child care center in accordance with Health and Safety Code Sections 1596.846(b) and (c).

Napping:

The facility has cots that will be used for napping. LPA advised applicant that cots should be wiped with a detergent/disinfectant weekly or when soiled or wet. Each cot or mat shall be equipped with a sheet to cover the cot and, depending on the weather, a sheet and/or blanket to cover the child.

The facility has a variety of age-appropriate equipment, toys and materials in good condition and in sufficient quantity to allow children present to fully participate in planned activities.

Restrooms:

All toilets, handwashing and bathing facilities was observed to be in safe and sanitary operating condition. The preschool handwashing fixtures do not deliver hot water.

Outdoor:

The outdoor activity space was observed to be free of hazards including, but not limited to, holes broken glass and other debris. LPA observed cushioned turf material that will absorb falls. LPA observed fencing to protect children and to keep them in the outdoor activity area. The fence is at least four feet high.

Health Related Services:

Applicant stated medications will be stored in a cabinet located in the staff kitchen area. LPA observed a padded lock on the cabinet were medication will be store. The refrigerator located in the staff kitchen area will be used to store any medication that requires refrigeration. The licensee shall develop and implement a written plan to record the administration of prescription and nonprescription medications and to inform the child's authorized representative daily when such medications have been given.

Food Service:

Per applicant the facility will provide snacks and lunch. LPA advised applicant that all food shall be safe and of the quality and in the quantity necessary to meet the needs of the children. All food shall be selected, stored, prepared and served in a safe and healthful manner. All foods or beverages capable of supporting the rapid and progressive growth of microorganisms that can cause food infections or food intoxications shall be stored in covered containers at 45 degrees F (7.2 degrees C) or less.

Applicant will provide pictures of thermometers located in the refrigerators. Pesticides and other similar toxic substances shall not be stored in food storerooms, kitchen areas, food-preparation areas, or areas where kitchen equipment or utensils are stored. Soaps, detergents, cleaning compounds or similar substances shall be stored in areas separate from food supplies. All kitchen, food-preparation and storage areas shall be kept clean and free of litter and rubbish; and measures shall be taken to keep all such areas free of rodents and other vermin. The food-preparation area shall not be used for: Children's play activities, unless such activities are part of a supervised food-education program. Full-day programs shall offer a midmorning and a midafternoon snack.

Postings:

The posting board is located at the entrance of the facility in a prominent, publicly accessible area in the child care center. LPA provided applicant with a copy of the LIC 613A, PUB 393, Child Care Center Notification of Parents' Rights Poster. LPA advised applicant that menus shall be in writing and shall be posted at least one week in advance in an area accessible for review by the child's authorized representative. Copies of the menus as served shall be dated and kept on file for at least 30 days. Menus shall be made available for review by the child's authorized representative and the Department upon request. The applicant shall post signs at the entrance to the child care center that provide the telephone number of the local health department and information on child passenger restraint systems pursuant to Health and Safety Code section 1596.95(g) and Vehicle Code sections 27360 and 27360.5 and the LIC 610.

Applicant did not provide a mass casualty plan of action.

LPA observed the facility license number on advertisements. Facility has cameras located throughout the indoor and outdoor areas.

The following items were discussed:

Applicant was reminded that all adults 18 and over responsible for administration or direct supervision of staff, persons who provides care and supervision to children, and staff who have contact with children, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a Child Care Center. A civil penalty of $100.00 minimum/day for a maximum of 5-days or, if the penalty is for a repeat violation, for a maximum of 30-days per person will be assessed if this regulation is violated.

LPA discussed the safe sleep regulations with applicant and discussed the Child Care Licensing Safe Sleep webpage at: https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-and-resources/safe-sleep, as an additional resource. LPA also informed applicant of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at: https://www.cpsc.gov/, and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment.

Applicant was informed of the MyChildCarePlan.org site, a consumer education website that helps families obtain child care by connecting them to child care providers and Resource and Referral Agencies (R&Rs) throughout California..

Community Care Licensing Division (CCLD) regularly sends information to licensed facilities, providers, and stakeholders by way of Provider Information Notices (PIN), Program Quarterly Update Newsletters and other important information communication platforms.

The following corrections are needed before a licensure will be considered. Corrections are due by 10/13/2023:

  • Waiver for outdoor activity space per California Code of Regulations, Title 22, Division 12, Section 101238.2(a) requires 75 square feet per child of outdoor activity space based on the total licensed capacity.

An exit interview was conducted with the above items discussed and a copy of appeal rights and this report was provided to the applicant. Final license determination will be made upon review by the Licensing Program Manager and correction of the above issues.
