On 04/02/2025 Licensing Program Analysts (LPA)Tyra Chavies conducted an announced inspection with applicant April Gutierrez and Arianna Corralejo for the purpose of a pre-licensing inspection. The purpose of this inspection is to ensure the standards for a Family Child Care Home are being met in accordance to California Tittle 22 Regulations and California Health and Safety Codes.

The applicants are applying for a Small Family Child Care Home for a max capacity of 8. Living in the home are 3 adults and one minor child. Control of property was submitted to the El Segundo Office for review. Present during today’s inspection is applicants, Arianna Corralejo and April Gutierrez, fiancé Joel Musick and one child.

Per the application, at this time, the ages the applicant wishes to provide services to are as follows: newborn to 14 years old with the hours of Monday through Friday from 7:00 a.m. to 5:30 p.m. Applicant was informed that any changes to ages, hours and days of operation shall be submitted to the department for approval prior to initiation of changes; an updated LIC 279 will need to be submitted. LPA Chavies did confirm the phone number is 310-613-4983.

FACILITY EVALUATION REPORT California law requires a public report of each licensing visit/inspection. This report is a record for the facility and the licensing agency. This report is available for public review; therefore, care is taken not to disclose personal or confidential information. Inquiries concerning the location, maintenance, and contents of these reports may be directed to the Licensing Program Analyst or Regional Office whose address and telephone number are listed on the front of this form.

DEFICIENCIES A deficiency is an instance of noncompliance with licensing requirements, including applicable statutes, regulations, interim licensing standards, operating standards, and written directives. Applicants/ licensees must be notified in writing of all licensing deficiencies. Deficiencies are listed on the left side of this form, and the applicable licensing requirement upon which the deficiency is identified. There are two types of deficiencies:
  • Type A deficiencies are violations of licensing requirements that, if not corrected, have a direct and immediate risk to the health, safety, or personal rights of persons in care.
  • Type B deficiencies are violations of licensing requirements that, without correction, could become a risk to the health, safety, or personal rights of persons in care, a recordkeeping violation that could impact the care of said persons and/or protection of their resources, or a violation that could impact those services required to meet the needs of persons in care.

PLANS OF CORRECTION (POCs) The licensing agency is required to establish a reasonable length of time to correct a deficiency. In order to set the time, the licensing agency must take into consideration the seriousness of the violation, the number of persons in care involved, and the availability of equipment and personnel necessary to correct the violation. Applicants/licensees are requested to provide a specific plan for each violation on the right side of the form across from each deficiency. The more specific the plan, the less chance exists for any misunderstanding in setting time limits and reviewing corrections. The applicant/licensee who encounters problems beyond their control in completing the corrections within the specified time frame may request and may be granted an extension of the correction due date by the licensing agency.

CORRECTION NOTIFICATION The applicant/licensee is responsible for completing all corrections and promptly notifying the licensing agency of corrections. Applicants/licensees are advised to keep a dated copy of any correspondence sent to the licensing agency concerning corrections, or if corrections are telephoned to the licensing agency, the date, person contacted, and information given.

CIVIL PENALTIES The licensing agency is required by law to issue a Penalty Notice, when applicable, to all facilities holding a license issued by the licensing agency, or subject to licensure, except Certified Family Homes, Resource Families, and Foster Family Homes, or any governmental entity.

PENALTY NOTICE GIVEN The statement concerning civil penalties serves as a penalty notice on this Licensing Report and failure to correct cited licensing deficiencies will result in civil penalties. Applicants/ licensees are required to pay civil penalties when administrative appeals have been exhausted and in accordance with any payment arrangements made with the licensing agency.

APPEAL RIGHTS The applicant/licensee has a right without prejudice to discuss any disagreement in this report with the licensing agency concerning the proper application of licensing requirements. The applicant/ licensee may request a formal review by the licensing agency to amend or dismiss the notice of deficiency and/ or civil penalty. Requests for review shall be made in writing within 15 business days of receipt of a deficiency notification or civil penalty assessment. Licensing deficiencies may be appealed pursuant to the procedures in the LIC 9058 Applicant/Licensee Rights.

AGENCY REVIEW The licensing agency review of an appeal may be conducted based upon information provided in writing by the applicant/licensee. The applicant/licensee may request an office meeting to provide additional information. The applicant/licensee will be notified in writing of the results of the agency review within 60 business days of the date when all necessary information has been provided to the licensing agency.

EMAIL REQUIREMENT Adult Community Care Facilities, Residential Care Facilities for the Chronically Ill, and Residential Care Facilities for the Elderly are required to provide and maintain an active email address of record with the licensing agency.

The home is a two story dwelling located within a town home complex. The home includes 3 bedrooms,  2 and half bathrooms, a living room, dining room, kitchen, backyard and detached garage. The town home complex does have a pool area as well as a tennis court which requires a key fob to access. Both applicants will ensure that children are being supervised at all times. Keys and fob to the recreational areas will be stored in a locked drawer in the kitchen in a locked drawer. No pets are currently at the facility. 

Applicants confirmed the following areas are OFF LIMITS to the children in care: bedroom 1, bedroom 2, bedroom 3, bathroom 1,  and half bathroom which are located on the second floor.  Doors will be keep locked during the hours of operations or while children are in care. Bedroom 1, bedroom 2, and bedroom 3 were observed and inspected. The kitchen and  detached garage will also be off limits and does have a child safety gate in place to ensure inaccessibility. Both, the kitchen and detached garage was observed and inspected. Applicants confirmed the following areas are ON LIMITS to children in care: Living Room, Dining room, bathroom 2 and backyard. Families will enter the home through the main entrance. Living room are will be used for sleeping and dining room area will be used as the main activity area. Toys, books and appropriate materials were observed to be in good condition and are age appropriate. A working 3A40BC fire extinguisher was observed inside the living room closet a long with First Aid supplies.  Applicants do have a central A/C as well as heat. A stairway was observed that leads to the second floor.  LPA did observe a gate separating stairs from sleeping area. LPA reminded applicant to ensure gates remain in place during hours of operations and/or while children are present. LPA observed applicant test the carbon monoxide and smoke detector and it is in good condition.

Applicant confirmed meals and snacks will be provided by facility. LPAS discussed the importance of making sure a system is in place where dietary restrictions and allergies are noted.  LPAS encouraged applicant to contact their local resource and referral agency, Children's home society, to inquire about local Food Programs and other resources in the community. There are firearms and ammunition on the premises. LPA discussed the importance of the firing pins being moved and stored in separate area as well as ammunition. LPA observed Mr. Musick's firing arms and have approved them to be kept in the home. Mr. Musick has stored the firing pins and ammunition (with an exception of one fire arm having a triggering lock attached)  in the garage where it will stay during business hours. LPA did observe a community pool on the premises and have discuss with the applicant's the importance of supervision of children. 

LPA Chavies discussed Safe Sleep Regulations and resources with applicant. There is one crib or play yard for each infant in care, cribs and play yards are kept free from all loose articles and objects while infants are sleeping, and there are no objects hanging above or attached to the crib or play yard. All cribs or play yards shall meet the United States Consumer Product Safety Commission safety standards. Infants are not swaddled while in care.  Provider physically checks on sleeping infants every fifteen minutes and documents any signs of distress which includes but is not limited to flushed skin color, increase in body temperature, restlessness and labored breathing.  Infants can be visually observed through an open door if sleeping in a separate room.  Individual Infant Sleeping Plan will need to be completed and in file for each infant up to 12 months of age.  Infants up to 12 months of age are placed on their backs for sleeping.

LPA reviewed with applicant the LIC 311D, Forms/Records to Keep In Your Family Child Care Homes, children’s forms/records, facility forms/records, and information to be posted. Entrance Checklist was provided to the applicant.
 
Applicant was made aware that state law prohibits baby walkers, bouncy seats, saucers and any other items that fall into that category. Applicant was also reminded that only children who are eating may be in highchairs and that car seats are utilized only for transportation.

Commencing September 1, 2016, SB 792, prohibits a person from being employed or volunteering at a childcare facility or family day care if he or she has not been immunized against influenza, pertussis and measles. LPA discussed the influenza waiver during the inspection.

Licensee was reminded that all adults 18 and over living or working in the home, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a licensed Family Child Care Home. A civil penalty of $100.00 minimum/day for a maximum of 5 days or, if the penalty is for a repeat violation, for a maximum of 30 days per person will be assessed if this regulation is violated.

LPA discussed the safe sleep regulations with licensee and discussed the Child Care Licensing Safe Sleep webpage at https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-and-resources/safe-sleep as an additional resource. LPA also informed licensee [or facility representative] of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment.

On this date, 01/07/2025, the California Attorney General - Megan’s Law website was searched for information on sex offenders required to register with local law enforcement under California's Megan's Law. No registered sex offenders were found at the facility addresses. Under state law, some registered sex offenders are not subject to public disclosure; therefore, they may not have been included in this search. However, the Department conducts a monthly cross reference of each address on record for all registered sex offenders against all CCLD facility addresses pursuant to information shared by California DOJ.

 Notice of site visit was given and must remain posted for 30 days.
