Licensing Program Analyst (LPA) Sandra Urena conducted an initial visit to investigate the allegation listed above. The LPA arrived at the facility at 10:00 a.m., met with Administrator Lori McKay and explained the reason for the visit.

The LPA and the administrator conducted a tour of the physical plant at 10:30 a.m. The LPA checked for temperature readings recorded on the temperature thermostats found throughout the hallways in the facility on the first and second floor. At 12:30 p.m., the LPA interviewed residents, and staff.

On the allegation that ‘Staff do not provide a comfortable temperature for the residents in care’; it is the concern of the complainant that the temperature in the facility has been very hot during the heat wave, and that the air conditioning unit has not been turned on even though the temperature outside has reached 107 degrees.

The LPA interviewed residents about the temperature in their rooms, and in the facility overall. Seven out of ten residents’ interviews revealed that the temperature is ok, some said it was colder than what they like it to be. The LPA interviewed staff about the overall facility temperature, specifically during the recent and current heat wave, and staff interviews revealed that the facility keeps the temperature set the highest at 78 degrees. The thermostat is on automatic setting. The temperature can be managed manually by moving the dials found in the hallways. The facility temperature can also be controlled via cell phones, which are managed by administrative staff. The administrator stated that some residents complain of the temperature being too cold, while others complaint of the temperature being too hot. Most residents have single occupancy units. The residents have been offered a fan for additional comfort. The LPA noticed that the temperature felt more comfortable on one side of the building (East) vs. the otherwise of the building (West), and four rooms seemed warmer than others on the West side. The Administrator stated that there is one AC unit for every four rooms. The AC repairman will be called to check on the AC units, and air ducts to ensure that the temperature is being kept at a comfortable for all residents. The administrator will inform the LPA about the maintenance needs/repairs of the AC units, once the inspection is completed. The residents have been offered a room fan for additional comfort.

The facility tour revealed that on the first floor, six out to six thermostats, read between 70 and 74 degrees. The second-floor thermostats read between 71 and 72 degrees. The thermostats are located in the hallways of the facility. Per the administrator, only eight bedrooms actually have a thermostat inside the rooms.

Based on interviews and observation, the facility has made efforts to keep the facility at a comfortable temperature on days of extreme heat. And although the allegation that the AC is not kept on consistently may have happened due to AC units needing maintenance, there is not sufficient evidence that ‘staff do not provide a comfortable temperature for the residents in care’. Therefore, the allegation is deemed Unsubstantiated at this time.
