On 12/17/2025, Licensing Program Analysts (LPAs) Evelin Rios and Huma Rahimi conducted an unannounced subsequent complaint visit to deliver the findings on the above mentioned allegations. LPA contacted the Licensee representative/Administrator Tyrone Quals. LPA Rios explained the reason for the visit. LPAs met with the administrator at 2:35 p.m. to deliver the report.
On 5/22/2025 an initial unannounced complaint visit was conducted by LPAs Huma Rahimi, Evelin Rios and North Los Angeles County Regional Center Community Service Specialist, Andrea Messina. LPA Rahimi conducted a physical plant tour of the facility. The facility has no residents. During the investigation, LPA Rios obtained copies not limited to the following, Individual Program Plan (IPP), Special Incident Reports (SIR), facility’s procedure for eviction, Temporary Restraining Order, Individual Support Plan (ISP) and video of 05-12-2025 incident. On 5/22/2025 from 1:04 p.m. to 1:45 p.m. LPAs conducted a telephone interview with the administrator. LPAs also interviewed Staff #1 (S1) present at the facility. LPA Rios conducted telephone interviews with Resident #1 (R1) on 06/05/2025 and Resident #2 (R2) on 08/14/2025. LPA Rios conducted a telephone interview with Staff #2 (S2) on 08/11/2025. Allegation: Staff did not keep client free from corporal or unusual punishment, humiliation, intimidation, and threats. Regarding the allegation it was reported that staff got into a verbal and physical altercation with Resident #1 (R1). LPA’s interviews with R1 and the administrator corroborate that an incident occurred between them on 05/12/2025 over R1’s attempt to grab food out of the freezer and recording the encounter that escalated from verbal to physical. Each party identified the other as the instigator.

On 05-16-2025 LPA Rios received and reviewed video of 05-12-2025 incident. The video obtained shows two individuals, one is seen in the kitchen and the other is behind the recording device. They are heard discussing dinner. The video captures an individual identified as R1 whose tone, while not overtly upset, appears combative and boundary-testing. R1 is heard posing a hypothetical scenario, then acting on it by approaching the freezer and stating, “So if I were to go right here, and grab these. What exactly would you do? How is this going to go down?” As R1 reaches into the freezer, the administrator, initially facing the sink, turns and moves toward R1, reaching into the freezer while saying, “Excuse me, (R1’s name).” R1 responds, “You’re getting in my personal space.”

The video shows that while the administrator maintains a firm tone and does not raise their voice, they dismiss R1’s concerns and physically approach R1 after R1 reaches into the freezer. Although R1 moves closer to the administrator by reaching into the freezer the administrator moves around the refrigerator doors, standing directly next to R1. This caused R1 to loose grip and drop the phone. This action does not prioritize safety. According to R1's Individual Support Plan, it states, staff should stay out of R1s' reach and position themselves on the other side of a piece of furniture or another barrier and only move closer to keep R1 and other peers in the environment safe. The administrator’s response cannot be justified as a reaction to unexpected behavior, as R1 has a documented history, and Behavioral Support Strategies that should have informed their approach.

LPA’s review of R1’s IPP meeting date 11/12/2024 revealed not verbatim, R1 is clear when they are upset. R1 has been resistive at times when they feel they are not being respected. R1 has been doing well with self-regulating. Often needing time to themselves to process. IPP also revealed R1 has moved several times in 3 years usually due to breaking house rules regarding marijuana and increased agitation. Interview with R2, S1 and S2 revealed they were not present during the incident in question. S1 and S2 revealed they have not encountered issues as the incident described with R1.

Based on interviews and video review, there is corroborating evidence that the administrator did not follow R1’s documented Behavioral Support Strategies and failed to de-escalate the incident, which became physical. Therefore, the allegation is deemed Substantiated at this time.

Allegation: Staff did not comply with facility eviction policy.

Regarding the allegation it was reported that Resident #1 (R1) was denied access to the facility and administrator filed a restraining order instead of following the facility’s eviction policy. To investigate the allegation, LPA Rios conducted interviews with the administrator, Tyrone Quals, staff and two (2) out of two (2) residents. LPA reviewed the incident report for 05/12/2025 and Restraining Order documentation.

LPA’s Interview with the administrator and R1 corroborate, after the first incident when R1 left in an ambulance R1 returned the same night. R1 attempted to enter the facility and the administrator denied access. The administrator called 911 and the dispatcher told the administrator to let R1 in. Administrator did not comply, stating they were afraid for their life and would wait for deputies. R1 and the administrator confirmed that R1 gained access through a window after being denied entry.

LPA’s review of the Temporary Restraining order filed by the administrator and the accompanying documents revealed the Temporary Restraining Order (TRO) was, “Partly Granted and Partly Denied” until the court hearing. Specifically, the Stay-Away Order was denied until the hearing. The administrator had requested R1 to stay away at least 30 feet from them when they are entering, leaving, working, and residing at We R One Family Home, Inc (facility). During LPA’s interview with the administrator, they explained that they pursued the TRO because issuing an eviction notice would require prior approval from Community Care Licensing (CCL). The administrator stated that the responding Sheriff had suggested filing a restraining order earlier that day. The administrator also stated that the TRO was not served to R1 therefore they did not serve an eviction notice. The restraining order was so that R1 would keep their distance. However, R1 was residing at the facility address provided in the TRO, where the administrator is not a live-in staff.

Based on interviews and records review, it was determined that the administrator denied R1 access to the facility and pursued a restraining order in lieu of following eviction procedures. Therefore, the allegation is Substantiated at this time.
