25 | At 10:45 a.m. on 12/07/2023, Licensing Program Analyst (LPA) Nicholas Reed conducted an unannounced case management visit. LPA met with Staff #1 (S1) and Staff #2 (S2) and disclosed the reason for the visit.
Prior to this visit the Department conducted a review of the facility history and noted issues that require immediate attention. Based on licensing records, Licensee Davit Hakobyan informed LPA Melissa Ruiz that the facility was sold during a phone call at approximately 12:45 p.m. on 08/08/2023. Record review at 10:00 a.m. on 12/04/2023 revealed the licensee Love & Care Senior Living, Inc. underwent a corporate structure change on 04/10/2023 with Lurdes Laus becoming the CEO, CFO, and Secretary. The new owner has been operating under the old license for the duration of this time. The Department has not received a new application for a license. Since the sale of the facility, the Department conducted numerous Licensing visits and the facility was cited on 08/08/2023 and 09/21/2023 for the deficiencies posing and immediate and potential health and safety hazard to clients in care.
Today, LPA toured the facility at approximately 11:00 a.m., interviewed S1 and S2 at 11:15 a.m., and reviewed records at 11:45 a.m.
Based on the information revealed prior to and during this visit, the facility is operating without a current and valid license. LPA issued the Notice of Operating in Violation of the Law (NOVL) letter. LPA disclosed the possibility of civil penalties and civil and/or criminal action being taken pursuant to Health and Safety Code Sections 1520.3, 1550.5, 1568.065, 1569.16, 1569.50, 1596.851, or 1596.885. Deficiency for operating without a license issued. LPA left a voicemail for the licensee at 11:48 a.m. today notifying of today's report and NOVL letter.
