On June 17, 2026, Licensing Program Analyst (LPA) Annelise Villa met with Licensee Maria Garcia, who guided LPA on a tour of the facility. The purpose of this visit was to conduct a Case Management inspection regarding pool regulations and safety. Upon arrival LPA observed 9 children in care, along with 2 staff including the Licensee caring for them.

On June 3, 2026, Licensee was notified by Licensing Program Manger (LPM) Mariela Ramon the window located in the child care room gives access to the body of water on premises. LPM recommended to the Licensee to install an alarm on the window, if in case the window is opened, it will emit a loud sound to alert the Licensee and other staff. Licensee has placed an alarm on the window shutter and a secondary alarm on the window to ensure there is no access to the pool. LPA tested the alarms and observed both in operable condition.

Per local fire regulations, any client room with window locks or security bars must have interior release mechanisms that unlock/open security on the windows. They must be open from the interior by means of a pull or handle in the event of an emergency. To be in compliance with facility's fire clearance, Licensee has placed a single-action interior release latch on the shutter in case of an emergency.

There is a swimming pool and spa combination in the backyard. There is a 5 foot metal fence separating the accessible areas of the children’s play area from the pool area. The bodies of water are completely enclosed by a 5 ft metal fence. The fence runs all the way down to the concrete on which it sits, leaving minimal room between the bottom of the fence and the concrete. The pool gate was observed to have a locking mechanism. The gate has a locking mechanism and it is located within 6 inches from the top of the gate. The lever to open the gate is located at the top of the gate. The pool gate opens away from the body of water. All items rendering the fence climbable are moved away from the fence. The metal fencing is sturdy and capable of withstanding the impact of children's toys including bicycles.

FACILITY EVALUATION REPORT California law requires a public report of each licensing visit/inspection. This report is a record for the facility and the licensing agency. This report is available for public review; therefore, care is taken not to disclose personal or confidential information. Inquiries concerning the location, maintenance, and contents of these reports may be directed to the Licensing Program Analyst or Regional Office whose address and telephone number are listed on the front of this form.

DEFICIENCIES A deficiency is an instance of noncompliance with licensing requirements, including applicable statutes, regulations, interim licensing standards, operating standards, and written directives. Applicants/ licensees must be notified in writing of all licensing deficiencies. Deficiencies are listed on the left side of this form, and the applicable licensing requirement upon which the deficiency is identified. There are two types of deficiencies:
  • Type A deficiencies are violations of licensing requirements that, if not corrected, have a direct and immediate risk to the health, safety, or personal rights of persons in care.
  • Type B deficiencies are violations of licensing requirements that, without correction, could become a risk to the health, safety, or personal rights of persons in care, a recordkeeping violation that could impact the care of said persons and/or protection of their resources, or a violation that could impact those services required to meet the needs of persons in care.

PLANS OF CORRECTION (POCs) The licensing agency is required to establish a reasonable length of time to correct a deficiency. In order to set the time, the licensing agency must take into consideration the seriousness of the violation, the number of persons in care involved, and the availability of equipment and personnel necessary to correct the violation. Applicants/licensees are requested to provide a specific plan for each violation on the right side of the form across from each deficiency. The more specific the plan, the less chance exists for any misunderstanding in setting time limits and reviewing corrections. The applicant/licensee who encounters problems beyond their control in completing the corrections within the specified time frame may request and may be granted an extension of the correction due date by the licensing agency.

CORRECTION NOTIFICATION The applicant/licensee is responsible for completing all corrections and promptly notifying the licensing agency of corrections. Applicants/licensees are advised to keep a dated copy of any correspondence sent to the licensing agency concerning corrections, or if corrections are telephoned to the licensing agency, the date, person contacted, and information given.

CIVIL PENALTIES The licensing agency is required by law to issue a Penalty Notice, when applicable, to all facilities holding a license issued by the licensing agency, or subject to licensure, except Certified Family Homes, Resource Families, and Foster Family Homes, or any governmental entity.

PENALTY NOTICE GIVEN The statement concerning civil penalties serves as a penalty notice on this Licensing Report and failure to correct cited licensing deficiencies will result in civil penalties. Applicants/ licensees are required to pay civil penalties when administrative appeals have been exhausted and in accordance with any payment arrangements made with the licensing agency.

APPEAL RIGHTS The applicant/licensee has a right without prejudice to discuss any disagreement in this report with the licensing agency concerning the proper application of licensing requirements. The applicant/ licensee may request a formal review by the licensing agency to amend or dismiss the notice of deficiency and/ or civil penalty. Requests for review shall be made in writing within 15 business days of receipt of a deficiency notification or civil penalty assessment. Licensing deficiencies may be appealed pursuant to the procedures in the LIC 9058 Applicant/Licensee Rights.

AGENCY REVIEW The licensing agency review of an appeal may be conducted based upon information provided in writing by the applicant/licensee. The applicant/licensee may request an office meeting to provide additional information. The applicant/licensee will be notified in writing of the results of the agency review within 60 business days of the date when all necessary information has been provided to the licensing agency.

EMAIL REQUIREMENT Adult Community Care Facilities, Residential Care Facilities for the Chronically Ill, and Residential Care Facilities for the Elderly are required to provide and maintain an active email address of record with the licensing agency.

The following AB 2866 pool safety regulations were observed:

1. An access gate that opens away from the pool and is self-closing with a self-latching, lockable device that is no lower than 60 inches above the ground.
2. The enclosure must be at least 60 inches tall and the vertical clearance from the bottom of the enclosure to the ground must be no more than 2 inches.
3. No gaps in the enclosure that could allow for a sphere of 4 inches or larger to pass through.
4. The outside surface must be free of any physical characteristics that could be used as a handhold or
foothold for a child to climb over.

Licensee has all of the below safety equipment visible from the pool and available for immediate use:

1. A life ring with a diameter of at least 17 inches with a United States Coast Guard approval label.
2. A rescue pole with a body hook that is at least 12 feet long but must be long enough to effectively rescue a Child at the facility’s pool. It must be a fixed length – and not an adjustable pole. Additional guidance will be forthcoming in written directives to specify this requirement so that the pole must be long enough for a rescue at the facility’s pool. A wider pool may require a longer rescue pole.
3. An alarm that, when placed in a swimming pool, will sound upon detecting an entrance into the water. The alarm shall be turned on and be in working condition during a facility’s operating hours while the swimming pool is not in use.

LPA Villa explained the safety concerns associated with bodies of water requirements, emphasizing the risk to children and the importance of strict adherence to regulations. LPA observed Licensee to be in compliance with pool regulations.

Exit interview conducted, and report was reviewed with the Licensee. A notice of site visit was given and must remain posted for 30 days. No citation was given today as a result of this inspection.
