On 10/8/2024, Licensing Program Analyst (LPA) Carol Heath conducted an unannounced required annual inspection at the Diaz Banos Family Childcare Home. Upon arrival, LPA met with the licensee, Blanca Diaz Banos, who provided a facility tour. Family members residing in the home include three adults (the licensee, her husband, and her son) and one minor child (age 16). According to Guardian records, all adults in the facility have obtained criminal record clearance.
This large family childcare facility operates Monday through Friday, 23 hours. During the inspection, LPA observed 8 children in care (2 school-age child, two preschoolers, 4 toddlers, and 2 infants), under the supervision of the licensee and her assistants. According to the Licensing Information System, annual facility fees are current. Incidental Medical Services (IMS) were discussed, and the licensee stated that no children currently require IMS.
The home layout is as follows: it is a two-story, four-bedroom, 2.5-bathroom house with a kitchen, dining room, living room, family room, children's classroom (backroom den), laundry room, and garage. There are no bodies of water on the premises.
The following areas are used for daycare: the children's classroom (backroom den) and the living room, with children also having access to the family room and bathroom located in the hallway. Napping takes place on cots in the family room. Off-limit areas include all bedrooms (which are locked), the upstairs bathrooms, the entire upstairs, the kitchen (barricaded by a safety gate), and the laundry room/garage (secured with a key-locked doorknob).

The home was inspected inside and out for safety, comfort, cleanliness, phone service, heating and ventilation, and the inaccessibility of harmful substances, including poisons and detergents stored under the kitchen sink with a safety latch."
Backroom Den/ Living room/Family room: In the designated areas, there are adequate age-appropriate toys, books, games, napping mats, and hygienic diaper-changing equipment. LPA observed age-appropriate toys and furniture for the children. There are games and books on the premises of this facility. The carpets and other materials were observed to be in good condition.
Children's bathroom: Children will use the bathroom down the hall to the left. The bathroom was the tour. The bathroom was clean, sanitized, and in good repair. The toilet was inspected, and the sink/toilet is operable. The toilet and faucets are clean, safe, and operable. The bathroom was observed to be free and clear of hazardous items.
Kitchen/Dining Room: The kitchen was inspected to ensure dangerous items were inaccessible to children (Safety latches). LPA observed sharp knives are kept in a butcher block in the gated kitchen.
Backyard: The backyard was inspected; the children use the outdoor backyard for outside play. The backyard is gated all around. The outdoor play area was observed to be free of hazards and loose and sharp parts. The play area is clear and clean of debris, the play area is fenced and gated all around, and the play yard has grass and cement for playtime. LPA observed that both sides of the backyard were to be barricaded. LPA observed an outdoor air conditioner to be barricaded by a wooden fence. LPA observed age-appropriate toys for children.
Other:
The AC/Heating Unit was observed. It is located on the right side of the home and is inaccessible to children due to barrels blocking access to it.
Bodies of water: According to the licensee, there were no bodies of water in the home

Electrical outlets: All unused electrical outlets are plugged in and inaccessible to children.
Food: The licensee is enrolled in the Food program and will provide Breakfast, lunch, and snacks.
Fire extinguisher (2A10BC): LPA observed a required fire extinguisher (2A10BC) reading in Green. It is located next to the kitchen, which is inaccessible to children. It meets standards established by the State Fire Marshal.
Fireplace: The fireplace was observed in the living room and is screened to make it inaccessible to the children.
Hanging window blind cords: The cords are inaccessible to children.
Isolation area (Illness): Per the licensee, if the child shows signs of illness, they will be separated from other children and stay in the Family room.
Medications and cleaning solutions: Detergents/cleaning compounds are in the master bedroom, inaccessible to the children. Medications are in the off-limits bedroom.
Napping: Children will nap in designated areas with adult supervision. LPA observed 10 mats and 2 cribs.
Overnight Care: According to the licensee, No overnight care at this time.
Pets: Two small dogs and 1 big one is kept in the other site of the backyard during daycare hours and do not interact with childcare children. They have current vaccinations.
Phone service: There is a working landline or cell phone.
Smoke Detectors and Carbon Monoxide: The smoke detectors and carbon monoxide devices tested operable.
The First Aid kit is in the kitchen closet, inaccessible to children. It was observed to be complete with supplies and a first aid manual.
Transportation: The licensee does provide transportation for children. The licensee has a valid California driver's license, valid vehicle insurance, and vehicle registration.

Weapons or Firearms: Per the licensee, there are No Firearms at the facility at this time. LPA does not observe any firearms.
LPA reviewed the following Documentation:
Child files: LPA observed 8 children's files, and the documents were found to be in order.
CPR/First Aid: LPA observed licensee has current Pediatric CPR and First Aid Training with an expiration date (of 1/2024).
Fire Drill and Disaster Drill: Per the licensee, fire, and disaster drills are conducted every 6 months; the last drill was documented and performed on 9/3/2024.
Immunization: The licensee and her assistant have the required immunizations (MMR and DTaP). They also provided a written statement declining the influenza vaccination.
Infant Sleeping Plan (LIC 9227) and Sleeping Log: LPA observed 4 infants have LIC 9227, and the Sleeping log is also in each infant's file. LPA shared Safe sleeping regulations with the licensee.
Posting Requirement: The licensee posts all required information.
Mandated Reporter Training: The licensee has completed and renewed the online mandated reporter training at www.mandatedreporterca.com on 4/24/2022.
Staff Personnel File: LPA observed 3 staff information. The file contained all required licensing documents. LPA observed her assistants have on-line CPR/First Aid training. LPA let the licensee knows the CPR and First Aid training needs to be in-person training. LPA also let the licensee and her husband know it will be their responsible to make sure children’s safety during the pickup and drop off.
The following information was discussed with the licensee:
o A baby walker shall not be allowed on the premises of a family childcare home in accordance with Health and Safety Code sections 1596.848(b) and (c). State law prohibits baby walkers, bouncy seats, exersaucer, and other items that fall into that category.

o Capacity requirements, Roster requirements, Posting requirements, and Documentation requirements for disaster drills (fire and earthquake). Mandatory Forms for the children's and provider's files and Safe Sleep Awareness. The role and responsibilities of being a mandated reporter were reviewed. The licensee was reminded that supervision is always required for children in care.
o The licensee was advised of the requirement to report unusual incidents and/or injuries to the parent/guardian and Licensing within the time frame specified by the regulation and on the form LIC624B
o Licensee was advised to visit the CCL website (www.ccld.ca.gov) to obtain updates on courses and updates/changes to the regulations. Licensee was made aware that it is their responsibility to know the regulations as well as anyone who assists in providing care. The licensee was advised that the inaccessibility of hazards must be constantly reassessed depending on the children in care. Licensing must always have the facility's phone number; if the phone number is changed, licensing must be notified.
o Mandatory Forms for the children's files and provider's files.
o Our Quarterly updates come out every 3 months. They are also now in Spanish. Please log in to the CCLD website, or you can email our advocates to have the quarterly updates sent directly to your email. Child Care Advocates information: www.childcareadvocatesprogram@cdss.ca.gov
o Posting Requirements: Failure to comply with posting requirements shall result in an immediate civil penalty of $100.
o Requirements for fire drills, earthquake drills, and documentation for both.
o The Duty Worker is available for questions Monday through Friday at (661) 202-3318 from 8:00 a.m. - 5:00 p.m.
o The licensee is reminded that 100% supervision is required for children at all times.

The licensee was informed of the responsibility to report suspected Child Abuse by calling the Child Abuse Hotline at 1-800-540-4000. Also, call the CCL office and follow up with a written Unusual Incident/Injury Report (LIC 624B).
o The regulation prohibits the smoking of tobacco in a private residence that is licensed as a family childcare home and in those areas of the family childcare home where children are present (24/7 ban).
LPA discussed the safe sleep regulations with licensee [or facility representative] and discussed the Child Care Licensing Safe Sleep webpage at https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-and- resources/safe-sleep as an additional resource. LPA also informed licensee [or facility representative] of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment.
Licensee [or facility representative] was reminded that all adults 18 and over living or working in the home, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a licensed Family Child Care Home. A civil penalty of $100.00 minimum/day for a maximum of 5 days or, if the penalty is for a repeat violation, for a maximum of 30 days per person will be assessed if this regulation is violated.

ü Centers and Family Child Care Homes Licensee [or facility representative] was informed of the MyChildCarePlan.org website, a consumer education website that helps families obtain child care by connecting them to child care providers and Resource and Referral Agencies (R&Rs) throughout California.
ü Family Child Care Homes During the exit interview, the LICENSEE ****, confirmed that there are no Registered Sex Offenders living in the facility and LPA completed the RSO profile in FAS.
ü Family Child Care Homes A notice of site visit was given and must remain posted for 30 days.
