32 | Allegation #2 states Licensee spoke to daycare children in an inappropriate manner. During this investigation, LPA Villa conducted confidential interviews with all relevant parties involved. Based on the interviews conducted there were no disclosures of Licensee speaking inappropriately in the presence of the day care children. Licensee denies yelling at daycare children, further stating she communicates with the children calmly when problems arise and encourages sharing and redirection among the children. Based on conflicting statements, this allegations is unsubstantiated. Although the allegations may have happened or are valid, there is not a preponderance of evidence to prove the alleged violations did or did not occur.
Allegation #3 states that the Licensee did not provide daycare children with appropriate eating accommodations. The Licensee reported that she participates in a food program and follows the program’s established nutritional and meal service guidelines. As part of her participation, the Licensee stated that she receives regular, unannounced monitoring visits from the food program to assess compliance with program requirements. According to the Licensee, no violations or deficiencies related to meal service or food accommodations have been identified during these visits. Interviews conducted during the investigation further revealed that appropriate food and eating options are available to the children in care. The Licensee reported that accommodations or alternative food options are provided when requested based on a child’s needs or preferences. Information obtained through the interviews did not substantiate that children were denied appropriate eating accommodations. The available information indicates that the Licensee has established practices for providing meals and accommodating requests while maintaining compliance with the requirements of the food program. Based on conflicting statements, this allegations is unsubstantiated. Although the allegations may have happened or are valid, there is not a preponderance of evidence to prove the alleged violations did or did not occur.
An exit interview was conducted. A copy of this report was reviewed with and provided to the facility on this date, along with a copy of the appeal rights and Notice of Site Visit. |
