On 12/13/2023 at 10:05am, Licensing Program Analyst (LPA) Andrea Pittman conducted an announced prelicensing inspection for a Large Family Child Care Home. LPA was greeted by the Applicant, who permitted entry to the facility and guided the LPA on a tour according to the facility sketch. There are 0 children present during the inspection. The Applicant will operate Monday through Friday from 6:00am to 6:00pm, varied up to 23 hours depending on family's need. Applicant plans to make overnight care unavailable. The Applicant plans to serve ages 2 to 5 years old. Applicant was provided information to enroll in a Food Nutrition Program.

This is a one-story family home which consists of four bedrooms (one bedroom is used as a classroom,) two bathrooms, kitchen, living room, family room used as a play room, and back yard. The classroom, play room, and first bathroom will be the primary location in which care is provided. The Applicant will be providing napping: there are 6 cots and 1 playpens available for the capacity of the children; this is an inefficiency which must be corrected, 7 additional bedding must be acquired to meet capacity requirements. Children will utilize the bathroom located to the left of the main entrance. The off-limit areas include the following: bedrooms: 1, 2, 3, bathrooms 2, and the front yard.

The home was inspected inside and out for safety, comfort, cleanliness, service, heating, and central air ventilation. The home has age-appropriate toys, play equipment, and materials. The Applicant stores sharp knives in a kitchen cabinet secured by a safety latch, making it inaccessible to children in care. The Applicant stores medication in the off-limits bathroom and hallway closet that have safety knobs, making it inaccessible to children. The Applicant stores cleaning supplies in a kitchen cabinet secured by a safety lock. The Applicant has a complete First Aid Kit that includes the following supplies mandatory to the kit: tweezers, scissors, gauze, bandages, adhesive tape, cleansing pad/solution, thermometer, and a first aid manual, which is stored inaccessible to children in the closet.

·Electrical outlets: LPA observed that all unused electrical outlets have covers. Applicant is aware that all unused outlets must have covers at all times.
· Hanging window blind cords: LPA observed the blind cords were up out of reach of children in care or not installed on the windows at all.
· Isolation area (Illness): Per the Applicant, if the child shows signs of illness, they will be separated from other children by having them seated in the living room away from the healthy kids and with access to the bathroom.
· Pets: The Applicant stated they do not have any pets.
· Transportation: The Applicant will not be providing transportation.
· Weapons, Firearms, and Ammunition: Per the Applicant, there are no firearms at the facility at this time. LPA does not observe any weapons, firearms, or ammunition.
· Smoking: Applicant states that there will be no smoking on the premises
· Insurance: Applicant states that she does not have separate insurance for the child care. The Applicant was explained that the LIC 282 must be in the children’s records or proof of insurance for the child care.
· Door handles: LPA observed that the off-limit areas had safety knobs over the door handles making them inaccessible to children in care.
· Meals: The Applicant stated they will provide breakfast, lunch, dinner, and snacks.
· Outdoor: LPA Pittman observed the homes front, back, and side yards; however, the Applicant designated the back yard as the only yard for outdoor play. The back yard includes a concrete and dirt area in which children can play. LPA observed the toys and equipment to be in good condition; however, there is a swing set that needs to be securely anchored to the ground and is missing cushioning material under and around the swing set, a shed that has hazardous objects that needs to be made inaccessible, pipes protruding from the ground that need to be made inaccessible, and an AC unit that requires a cover which are all inefficiencies that need to be corrected prior to the Applicant utilizing the backyard for outdoor play. LPA observed a side yard that will be off-limits which is accessible by the neighbors, the Applicant stated the owner plans on making the backyard off-limits by installing a gate. This is an inefficiency. The back yard is gated all around and enclosed. The Applicant has completed a Declaration LIC 855 stating that the backyard will be off-limits until it is no longer accessible by the neighbors and the corrections are completed and licensing must review the corrections before the backyard can be utilized.

  • Affidavit: The Applicant completed a Declaration LIC 855 that she will ensure supervision of children in play in the backyard for the ledge once it has been corrected and that the backyard will not be utilized until corrections have been made and that outdoor play will occur at a nearby park with parent’s permission.

  • · Bodies of water: LPA observed there are no open bodies of water on the premises.

    Applicant did have all the required posted documents: (Notice of Parent's Rights Poster (PUB 394), Emergency Disaster Plan (LIC 610A), and Earthquake Preparedness Checklist (LIC 9148). Applicant has made the parent board and other Licensing required forms visible to parents.

    The Applicant does not have insurance on the family child care home and plans on having the parents complete the LIC 282-Affidavit Regarding Liability Insurance for Family Child Care Homes.

    LPA observed a fire extinguisher (3A40BC) that meets the State Fire Marshal standards (reading in green and last checked on 12/6/2023). The home meets State Fire Marshal standards for a Large Family Child Care Home by having a single-action door handle and a manual fire pull installed in the home. Applicant tested the smoke detector and carbon monoxide detector at 10:47am and 10:44am, respectively, and they were found to be in operable condition.



    The Applicant’s Pediatric CPR/First Aid expires in 6/2025. The Applicant had the required immunizations against Pertussis (Tdap), Measles (MMR), and Tuberculosis (TB). Family Child Care Orientation was completed 3/19/2019. Preventative Health and Safety training with lead and nutrition component is dated 2/5/2021. Child Care Provider Mandated Reporter training is dated 5/20/2023 and expires 5/2025.

    LPA ensured that the Applicant has the LIC 311D making the Applicant aware of the required documents needed in the facility files, personnel files, children’s records, and posted documents. Also, LPA ensured that the Applicant understands the capacity requirements, needing an assistant for any capacity greater than a small family childcare, and the requirement for personnel files. LPA also explained reporting requirements and ensured the Applicant understood their reporting responsibilities.
    The following were discussed: No smoking, infant walkers, Johnny jumpers, exersaucers and any other item that falls into that category which are not permitted in the facility. The LPA also discussed earthquake safety and necessity of drills, required forms for children’s files, facility files, posting requirements, and penalties. Applicant was reminded about ensuring proper care and visual supervision at all times.

    Facility Representative was reminded that all adults 18 and over living or working in the home, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a licensed Family Child Care Home. A civil penalty of $100.00 minimum/day for a maximum of 5 days or, if the penalty is for a repeat violation, for a maximum of 30 days per person will be assessed if this regulation is violated.

    The Licensee was reminded to report Unusual Incidents. A report shall be made to the department by telephone or fax during the department's normal business hours before the close of the next working day following the occurrence during the operation of family day care home. In addition, a written report shall be submitted to the department within seven days following the occurrence of any events specified above. The Licensee was informed to utilize the Unusual Incident Report/Injury Report Form LIC624B when submitting the report to the department.
    LPA discussed the safe sleep regulations with the Facility Representative and discussed the Child Care Licensing Safe Sleep webpage at https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-andresources/
    safe-sleep as an additional resource. LPA also informed the Facility Representative of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment. Provided Applicant with an Infant Sleep Plan form LIC 9227 and the sleep log.

    Beginning on January 1, 2018, Assembly Bill 1207 (2015) requires all licensed providers, applicants, directors and employees to complete training as specified on their mandated reporter duties and to renew their training every two years. Applicants must meet requirements as a precondition to licensure. New employees shall have 90 days from date of employment to complete training as required. The training may be conducted at the following website www.mandatedreporterca.com.

    Facility Representative was informed of the MyChildCarePlan.org website; a consumer education website that helps families obtain child care by connecting them to child care providers and Resource and Referral Agencies (R&Rs) throughout California.

    During the exit interview, the Applicant confirmed that there are no Registered Sex Offenders living in the facility and the RSO profile was completed in FAS 11/13/2023.

    The Applicant was informed of the responsibility to report suspected Child Abuse by calling the Child Abuse Hot-line at 1-800-540-4000.

    Facility does not meet Title 22 Regulations. The Applicant is not yet ready for licensure. The Applicant has stated the changes listed below to make their family child care home meet Title 22 Regulations with the following:

    · Making the backyard off-limits until the following has been corrected: stabilizing the swing set, placing a cover over the accessible AC Unit, making the backyard inaccessible to the neighbors, installing cushioning material underneath and around the perimeter of the swing set, fencing off/barricading the pipes protruding from the ground, making the fire pit inaccessible, and making the shed inaccessible
    · Proof of acquiring at least seven additional bedding of cots/mats/playpens/cribs up to the capacity of 14

    Once the above has been completed by the Applicant, the facility will be ready to be licensed.
    The Applicant agrees to have the correction completed by 12/27/2023. All licensing reports are recommended to keep for 3 years.

    An exit interview was conducted, a copy of the report and the Notice of Site visit was read and provided to the Applicant. The Notice of Site visit is to be posted and visible to parents for 30 days.
