On Tuesday, October 15, 2024, at 10:03 am, Licensing Program Analyst (LPA) Mayra Rivera conducted an unannounced annual inspection and met with director Heather Aranda who guided LPA Rivera on a tour of the facility.

This is a preschool program with toddler option component that serves children ages 18 months to 5.5 years. This program operates Monday to Friday 7:00 a.m. – 5:30 p.m. Sign in and out takes place at the main entrance area using the Brightwheel app. All areas identified on the facility sketch were toured and inspected both indoors and outdoors. Teacher and child ratio were observed, and present staff are fingerprinted cleared and 2 present staff have the Pediatric First Aid/CPR certification.



LPA entered classroom toddlers and observed age-appropriate furniture and equipment to be in good condition, free of sharp, not loose, or pointed parts and age-appropriate toys accessible to children. LPA observed a cubby for children to store their personal belongings next door to the classroom. LPA did not observe any cleaning solutions or hazards in the classroom. LPA Rivera observed a step trash bin with a lid in the classroom. LPA observed the cleaning solutions to be stored in the kitchen cabinet and observed a gate barrier installed between the classroom and kitchen to prevent children entering the kitchen and observed pad locks.

LPA entered classroom 4’s. and observed age-appropriate furniture and equipment to be in good condition, free of sharp, not loose, or pointed parts and age-appropriate toys accessible to children. LPA observed a cubby for children to store their personal belongings. LPA did not observe any cleaning solutions or hazards in the classroom.

LPA entered classroom 3’s. LPA Rivera observed the classroom to be unoccupied due to low enrollment. Classroom is only utilized for nap. LPA observed age-appropriate furniture and equipment to be in good condition, free of sharp, not loose, or pointed parts and age-appropriate toys accessible to children. LPA Rivera observed a step trash bin with a lid in the classroom. LPA observed a door that leads to an office closed and key locked.

Heating, lighting, and ventilation were evaluated by LPA Rivera. LPA observed central AC/heater and vents located on the ceiling. LPA observed the thermostat located in the hallway and the temperature to be between 69 degrees. LPA observed the fire extinguishers located in the hallway and classrooms and the valve on the required 2A10BC fire extinguishers indicating fully charged and serviced on 2/23/24. Smoke detectors were not tested during this visit due to the detectors being wired to the emergency pull down fire alarm system. Carbon monoxide detector located in the director’s office and director tested and LPA heard the sound. It is operable. Director was not able to provide documentation of last emergency drill. Director stated did not know where the clipboard is at. LPA observed napping equipment cots to be in good condition. First aid kit supplies are kept inside the storage room and LPA observed the kits to be fully equipped. During this visit, per director currently has no children with severe food allergies or on medication. LPA Rivera asked if there are any poisons, firearms, weapons, or bodies of water. Director stated no firearms, weapons, no poisons nor bodies of water. LPA did not observe firearms or weapons, poisons, nor bodies of water. Director stated the ill isolation area take place in the director’s office and utilize staff restroom.

Restrooms are in the hallway near the kitchen. LPA observed the restrooms to be in good condition with working toilets, sinks, hand soap dispenser and paper towels. LPA observed a total of 3 toilets, 3 hand washing sinks and koala diapering table arm’s length to a handwashing sink. LPA observed a waiver on file to share restroom between toddlers and preschoolers.

LPA entered the toddler outdoor play area to conduct and inspection. LPA observed the equipment to be in a safe condition, free of sharp, no lose or pointed parts. The surface of the outdoor activity space is maintained in a safe condition. For adequate shade, LPA observed a big tree. Areas around or under climbing equipment, are cushioned with artificial turf that may absorb a fall. The yard is fenced all around and LPA observed the gates closed and locked with a padlock. LPA reminded director, prior to children coming out to play, to make sure the leaves are picked up.

LPA entered the preschool outdoor play area and observed the equipment to be in a safe condition, free of sharp, no lose or pointed parts. Prior to children coming out to play, to make sure the leaves are picked up.

Lead testing has not been conducted and it is not required to be tested due to facility not utilizing the tap water for drinking or food preparation. Facility utilizes water bottles and filter 5-gallon water. This program provides meals and snacks and prepared on site. A monthly menu is available and posted in the Brightwheel app and in the kitchen. For water drinking, LPA observed a water dispenser in the kitchen. Staff refills children’ water bottles. LPA observed the food preparation area to be clean and free of litter, rubbish, rodents, and/or any other vermin and storage containers for solid waste, including moveable bins with tight-fitting covers that are kept on, and in good repair. The facility was observed to be free of flies, other insects, and rodents.



The following documents were posted in a prominent, publicly accessible area at the facility: Facility License, Notification of Parents' Rights (PUB 393), Personal Rights (LIC 613A), and Earthquake Preparedness (LIC 9148). PUB 269 Child Passenger System Poster, and Daily Schedule. LPA observed sign in/out sheets and observe 11 sign in signatures.

LPA reviewed children roster, children, and staff files. LPA observed staff files to be incomplete. LPA observed staff #1 and staff #3 missing LIC 503 Health Screening Report. Staff #2 and #3 missing proof of measles, pertussis and influenza or influenza declination. Director missing 8 hours of health and safety certification. Director stated she was not aware of the forms not being completed and that she needed to take the 8-hour training course in health and safety to meet the requirement of 16 hours.

LPA Rivera observed director Heather Aranda American Red Cross Pediatric First Aid/CPR certification dated 9/16/23, and has proof of immunization against Pertussis, MMR, and Influenza declination. Director has completed the mandated reporter dated 12/13/23. Director missing 8-hour training in Health and Safety.

Items discussed during this visit:

1. The following items are prohibited by Licensing: Refused Entry to a Facility or Any Part of a Facility is a violation of Section 1596.852, 1596.853 or 1597.09. Regulations 101238 (g) (2), The Presence of an Excluded Individual, Fire Clearance Violations, Accessible Bodies of Water, Accessible Firearms, Ammunition or Both

2. Breakfast/Lunch/Snack Menus: Menus are required to be posted one week in advance where it is visible by the child's authorized representative. Menus for the past 30 days must also be available upon request.

3. Current Children’s Roster: Each childcare facility shall maintain a current roster of children who are provided care in the facility. The roster shall include the name, address, and daytime telephone number of the child's parent or guardian, and the name and telephone number of the child's physician. This roster shall be available to the licensing agency upon request.



4.LIC 311A - Records to be Maintained at the Facility: LPAs advised that forms, regulations, and quarterly updates can be accessed on the Child Care Licensing website at: www.ccld.ca.gov.

5.Pediatric First Aid and CPR: At least one person trained in Pediatric First Aid and CPR and EMSA approved must be present.

6.Designated Staff: The name of the childcare center director or fully qualified teacher(s) designated to act in the director's absence must be on file.

9.Children’s Records: must be available for review; including but not limited to, the following: Name, address, and telephone number of the child's authorized representative and of relatives or others who can assume responsibility for the child if the authorized representative cannot be reached when necessary.

Director Heather was reminded that all adults 18 and over, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a Child Care Center. A civil penalty of $100.00 minimum/day for a maximum of 5 days or, if the penalty is for a repeat violation, for a maximum of 30 days per person will be assessed if this regulation is violated.



Bill (AB) 2370, Chapter 676, Statutes of 2018, requires all licensed Child Care Centers (CCCs) constructed before January 1, 2010, to test their water (used for drinking and food preparation) for lead contamination before January 1, 2023, and then every 5-years after the date of the first test.

LPA referred director Heather to the Department website for lead: Lead Toxicity Prevention and Water Testing Information.

LPA Rivera discussed the safe sleep regulations with director Heather and discussed the Child Care Licensing Safe Sleep webpage at https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-andresources/safe-sleep as an additional resource. LPA also informed director Heather of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment.

Director Heather was informed of the MyChildCarePlan.org website; a consumer education website that helps families obtain child care by connecting them to child care providers and Resource and Referral Agencies (R&Rs) throughout California.

The deficiencies listed on the following page was observed by LPA Rivera and is being cited in accordance with California Code of Regulations Title 22 and Health and Safety. Four type B deficiencies are being issued today for regulations 101174(d)(2), 101215.1(m), 101216(g)(2), and 1596.7995(a)(1). Please see attached LIC 809-D for citations. Due date 11/15/24.

A notice of site visit was given and must remain posted for 30 days. Failure to maintain posting as required will result in a $100.00 civil penalty. Exit interview conducted and report was reviewed with director Heather Aranda.
