25 | On September 29, 2021, at 9:05am Licensing Program Analysts (LPAs) Zirbes and Thompson-Miller conducted an unannounced follow-up Case Management inspection. During this inspection, LPA's met with Assistant Director Lindsey McClain and Administrator Veronica Rose. The purpose of the Case Management was to follow-up on a self reported unusual incident report (UIR) submitted to the Department on September 10, 2021. The UIR was regarding a personal rights incident involving staff 1 (S1) and child 1 (C1). (Refer to confidential names list, LIC 811 dated September 29, 2021). Upon arrival, there were 45 children and seven teachers at the facility.
During the investigation of the UIR, staff and children were interviewed, video of the incident was reviewed and relevant documentation was reviewed.
Based on the evidence reviewed it was determined that the personal rights of C1 were violated when S1 grabbed the child by the hand, pulled the child toward S1 and sat the child on the carpet in the presence of other day care children. This was done as a form of punishment due to C1 hitting another child with a toy. Although the Administrator took appropriate action to address S1's conduct, the personal rights violation did occur.
A deficiency is being cited based on interviews and record review, in accordance with California Code of Regulations, Title 22, see LIC 809D.
An exit interview was conducted, where the plan of correction was reviewed and developed with the Assistant Director and Administrator. A copy of this report and appeal rights were discussed with the Assistant Director. |
