32 | During the course of this investigation, LPA Rivera conducted confidential interviews with staff, children, and parents. Based on staff interviews, it was stated that staff # 5 during naptime was padding child’s back and child kept getting up and teacher kept trying to place the child back to the cot. Staff #5 always pats child’s back to soothe child, but that day child was just getting up and jumping all over staff #5. Staff #6 admitted that staff #5 spent too much time trying to put the child down to sleep. Like 20 to 30 minutes and was asked why staff #5 spent too much time and the answer was because child wanted to run around the classroom. The reason why child bit and pulled staff #5 hair, was because staff #5 was trying to lay child down to take a nap.
Based on interviews conducted, the preponderance of evidence standard has been met, therefore the above allegation is found to be Substantiated. One type B deficiency is being issued today for regulation: 101230-(b)- All children shall be given an opportunity to nap or rest without distraction or disturbance from other activities at the center- (3) No child shall be forced to stay awake or to stay in the napping area longer than the normal napping period. Exit interview was conducted with director Crystal Renderos. The director was provided a copy of the appeal rights (LIC 9058) and signature on this form acknowledges receipt of these forms.
The Notice of Site Visit (LIC 9213) – must remain posted for 30 days during the hours of operation after each site visit made by a licensing representative. Failure to maintain posting as required will result in a civil penalty of $100.00.
