32 | During the course of the investigation, LPA Rivera observed the video, interviewed staff and Child #1 file. LPA observed staff #1 changing a child’s diaper and child #1 and child #2 playing left side corner of the diapering table. Child #1 and Child #2 playing and child # 1 tried to take a toy away from Child #2 and with the right hand hit child #2 face. LPA observed staff #1 walked towards child #1 and child #2. Child #1 steps to the side, looks at child #2 and continues to play and Child #2 remains in the corner. Video has no audio. Based on interviews and file review, there is no history of child #1 hitting behavior. Staff #1 was present and within ratio near the two children. Child #2 injury was not sustained due to lack of supervision.
This agency has investigated the complaint alleging day care child sustained injury due to lack of supervision At this time, it is determined that although the allegation may have happened or is valid, there is not a preponderance of evidence to prove the alleged violation(s) did or did not occur, therefore at this time the above allegation is unsubstantiated. No deficiency given at this time.
The Notice of Site Visit (LIC 9213) – must remain posted for 30 days during the hours of operation after each site visit made by a licensing representative. Failure to maintain posting as required will result in a civil penalty of $100.00.
Exit interview was conducted with Administrator Duana Garrett. Administrator was provided copy of their appeal rights (LIC 9058) and their signature on this form acknowledges receipt of these forms.
