On January 15, 2026, Licensing Program Analyst (LPA), Ali conducted an unannounced complaint findings inspection to Academy of Excellence. LPA met with Director who granted access. The purpose of the inspection was to present findings from complaint investigation (10/27/25) regarding the above allegation. LPA discussed the allegation details with Director. LPA observed 22 school age children and 2 staff present in the facility.
During the investigation, LPA conducted interviews with all relevant parties. Based on interviews the evidence revealed Child (C1) was bullied by another child. Based on observation and interviews, Staff did not have visual observation of the children on the playground when the incident occurred. The evidence corroborates with the above allegation that staff did not intervene when other children were bullying another child on the playground, which lead to C1 being pushed by other child.
Therefore, the allegation is to be found substantiated. A finding that the complaint is substantiated means that the allegation happened or is valid, there is a preponderance of evidence to prove that the alleged occurred.

An exit interview was conducted, the report was read, and a copy of this report was left with the Director with notice of the site visit and appeal rights. Failure to maintain posting of the Notice of Site Visit for thirty (30) consecutive days will result in a $100 Civil Penalty.

Director/Licensee states that both staff 1&2 were retrained on 10/10/25. Staff will be positioned on playground at 11am and 5pm for supervision. Director/Licensee states that he will also conduct training for all staff on 1/24/26 for supervision and personal rights. Director/Licensee will provide proof of completeion to LPA via email 1/26/25.

This requirement was not met as evidence by: Based on observation, interviews and record reviews Staff did not have visual observation of the children on the playground when the incident occurred, which poses an immediate risk.....safety and personal rights of the clients in care.
