32 | Allegation 1: The first allegation states that staff spoke inappropriately to children in care. During the investigation, the LPA was able to discover that two staff have spoken directly to or about Child 1 inappropriately including yelling at the child. Child 1 has reacted to the conversations had with the staff by endangering or harming other children in care. One of the staff has been moved to another classroom; however, the second staff is still in place in this classroom. This is a Type B citation, see the LIC 9099D for the details.
Allegation 2: The second allegation states that there is inadequate staff in the classrooms. During the investigation, the LPA was able to determine that although there is a substitute list for the facility; all interviewed staff confirmed that the use of substitutes comes from other classrooms at the facility and not the substitute listing that was provided to the LPA during the investigation. The time of being out of ratio span from a few minutes to over 30 minutes. Additionally, multiple staff have stated that there have been several occurrences when the classrooms are out of ratio when teachers go on breaks, lunches, and covering absences due to not having enough staff at the facility to provide ratio coverage in the classrooms. Staff have stated that they have brought it up to management; however, it still occurs any time there is inadequate coverage in the facility’s staff. Based on information obtained, observations, and interviews with relevant complaint parties, the Allegation is deemed substantiated for allegation 2; as a result, a Type A citation and a Type B for allegation 1 will be issued. A finding of substantiated means that allegations were valid because the preponderance of the evidence standard has been met. As a Type A deficiency has been cited, a copy of the citation and licensing report must be posted for 30 days. The same report must be provided to Parents/Guardians and the Acknowledgment of Receipt of Licensing Reports LIC 9224 must be signed by Parents/Guardians of all enrolled children and any newly enrolled children in the next 12 months following the citation. If these requirements are not met, civil penalties per violation will be assessed.
An exit interview was conducted, a copy of this report read and provided to the Center Director, and the Notice of Site Visit and Appeal Rights was explained and given to the Center Director.
