LPA White conducted interviews with witnesses to the care the children receive, and reporting of any injuries children may or may not have received, and how that information is communicated or documented. Interviews revealed that if there is an injury to a child from the day care facility, Parents are notified by phone immediately, or told during pick up time from the facility. Staff stated that health checks are conducted, and if any markings are identified, the parent is called to confirm knowledge of the markings. Staff confirmed that some time parents will initiate the conversation if the child has an injury that occurred outside of the hours of the facility's operations. Staff state if an injury or marking is identified, it is documented. Supporting documents were provided to LPA White reflective of the notices that are sent home to parent if there is an injury to a child. During interviews it was mentioned by a witness that there was documentation from parents stating how pleased they are with the kindness, love, and level of trust they have for the teachers that work with their children. Interviews with witnesses revealed that they never witnessed a staff member mishandle a child or was it reported that a staff member mishandled a child. None of the interviews corroborated the narrative of the allegations that a staff member handled a child in a rough manner, spoke inappropriately to children, or had knowledge of a child coming home or being sent home with an unexplained injury.
LPA White reviewed facility records during each of the inspection visits. During these inspections, supporting documents such as updated facility rosters were provided, personnel records, parent / teacher notices for conferences, and assessment documentation for behavior of day care child. During the inspection visits, Children's files were reviewed for documentation of injury reports, and phone call to parents. Facility Representative Rosemary Ortiz, showed proof of time stamped communication from facility to parents where it is documented in a system called Center Track. This program keeps up with communication for attendance, as well as calls made to parents for school related reasons.
Based on observations, interviews, and record review there is not a preponderance of evidence to prove that allegations did or did not happen. Therefore, the allegations of Staff handled day care child in a rough manner, Staff speaks inappropriately to day care children, Child sustained unexplained injury are UNSUBSTANTIATED. There will be no deficiencies cited in accordance with California Title 22 Regulations.
