Licensing Program Analyst (LPA) Veronica Martinez Garza conducted an unannounced Case Management Incident inspection at the above facility on 11/26/24 at 10:25 a.m. The purpose of this inspection is to follow up on an incident reported to the Department on 11/18/24. LPA met with licensee Diana Esquer who guided LPA on a tour of the facility. Census was taken. Licensee’s husband/Co-licensee Alberto Esquer was also present.

On 11/15/24 at approximately 11:15 a.m. children were in the activity room dancing. Child #1 (C1) was in the activity room; however, C1 did not want to participate in the activity with the other children. C1 decided to grab a chair and sit while observing the other children dancing. According to the licensee, C1 does not like to dance; however, C1 remains in the activity room engaging in other activities. Licensee and Co-licensee were both in the activity with all the children when licensee observed C1 sitting and rocking on the chair. Licensee told C1 to not rock on the chair when suddenly C1 fell on the carpet floor. Licensee and co-licensee observed C1 fall on their right side and immediately began to cry. Licensee immediately assessed C1 for any injuries or marks; however, licensee did not observe any. Licensee provided C1 with an icepack and placed it on C1s right shoulder. According to the licensee, all children were heading outdoors and C1 began to put their shoes. Licensee and Co-licensee asked C1 if they had any pain and if it was ok to go outside. C1 joined the rest of the children outdoors and was observed to be fine throughout the day. Per licensee and Co-licensee, C1 did not complain of any pain and was interacting with other children. C1 had lunch, snack, and took a nap. When C1 woke up from a nap, C1 stated that they were in pain. Licensee asked C1 to sit in the living room furniture and provided another ice pack. Licensee did not call C1s parents due to assessing the child and not observing any injuries. Licensee provided an ouch report to C1s mother upon arrival.

C1 was taken to the Emergency Room (ER) where it was determined that C1 fractured their clavicle. Licensee followed up with C1s mother to inquire about the child’s well-being. Per text message, mom sent pictures of C1 with a sling and a doctor’s note that stated C1 can return on 11/20/24. Per licensee, C1 is no longer attending the facility. LPA took pictures of the activity room and child sized chair. Licensee and co-licensee have since removed all children’s chairs from the activity room to prevent future incidents or accidents. The incident happened so fast that it couldn't have been prevented.

During this inspection, LPA interviewed licensee and co-licensee. LPA reviewed child 1 (C1) file and took pictures of the activity room, chair, and ouch report.

At this time, the licensee is in compliance with California Title 22 Regulations. Therefore, there are no citations being issued today.

The Notice of Site Visit (LIC 9213) must remain posted for 30 days during the hours of operation after each site visit by a licensing representative, a civil penalty of $100 can be assessed.
