Complaint inspection conducted by Licensing Program Analyst Jennifer Hua. LPA met with assistant director Angel Haili. The purpose of the visit was announced. Covid-19 risk was assessment was conducted. Assistant Director took LPA on a tour of facility and LPA observed 13 infants in care supervised by 5 staff. Director Melissa Garcia arrived at 9:51AM.

During the visit interviews were conducted with assistant director, staff and director.

It was alleged that staff grabbed the bottle with cleaning solution instead of the bottle of water that is use for play with the kids, and sprayed child in the face. Staff noticed there is a scent and realized it was not water.

Per assistant director, she was not present at the time of the incident but was told about it the next day. Staff mentioned confirmed that she gabbed the wrong bottle because it wasn't labeled. Staff stated that at times, they spray water in the air and let the children play/touch the mist as a form of play.

Director stated that staff came and told her that she was doing the children's hair and had grabbed the wrong bottle. Staff did not realized it until another staff told her.

This agency has investigated the complaint alleging staff unknowingly sprayed a cleaning product into a day care child's face. . Based on LPA's interviews which were conducted and record review, the preponderance of evidence standard has been met, therefore the above allegation is found to be substantiated. California Code of Regulations, Title 22 are being cited on the attached LIC 9099D.

Upon receipt of this report documenting a substantiated complaint allegation and a Type A deficiency, the licensee shall do the following:
1. Post the Notice of Site visit and any licensing report documenting a Type “A” deficiency.
2. The report and the Notice of Site visit shall be posted for 30 consecutive days. Failure to maintain posting as required, will result in an immediate $100 civil penalty.
3. A copy of this report shall be provided to the parent/guardian of children currently enrolled by the next business day or immediately upon return. A copy of this report shall also be provided to the parent/guardian of any newly enrolled children for the next 12 months (1 year).
4. The Acknowledgement form (LIC 9224) must be maintained in each child’s file immediately upon receipt from parent. A copy of the parent Acknowledgement of Receipt of Licensing Reports Form was provided during this visit.

Exit interview was conducted with director Melissa Garcia, including, but not limited to Provider Rights, Appeal Procedures and Agencies Consultative Role. .

Per director, no longer spray children's hair, only use cleaning solution supplied by the facility, all bottles are labeled. Talked to all staff not to bring their own cleaning solution, and prior to using spray bottle water, to check it and fill bottle with water at that time.

evidenced by: Staff grabbed the bottle of cleaning solution instead of the bottle of water and sprayed it in the air as a form of play, as a result, the cleaning solution touched the child's face. This poses an immediate risk to the health and safety of children in care.
